SUBJ: S O L E S O U R C E MEMORANDUM TO ACQUIRE HYPERBARIC TEST

CHAMBER FROM ARC CONTROLS

1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”

This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval

Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama

City, FL 32407-7001 (Contracts Department Code 02).

2. Nature and/or description of the action being approved.

This action will award a firm fixed price order, on a sole source basis, to Arc Controls

Incorporated, 4875 Tufts Road, Mobile, AL 36619 to acquire a hyperbaric test chamber. The test chamber will be used to conduct evaluations of underwater breathing apparatus at the Navy

Experimental Dive Unit (NEDU).

3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).

This requirement is to purchase the following:

Nomenclature Quantity

Hyperbaric test chamber, 36” diameter, 50” length 1 each

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels, but not exceeding the simplified acquisition threshold of

$250,000.00. All software and/or licenses will be delivered no later than thirty (30) days after award of the order. The purchase will be funded with FY 22 Research, Development, Test and

Evaluation (RDT&E) funds.

4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service. 10

U.S.C. 2304(c)(1), 10 U.S.C. 2304(d)(1)(B). Only One Responsible Source and No Other

Supplies or Services Will Satisfy Agency Requirements FAR 6.302-1(a)(2)(iii)(B).

Arc Controls is the original equipment manufacturer of hyperbaric engineering equipment and have produced hyperbaric chambers that NEDU N31 Department uses to conduct evaluations of underwater breathing apparatus. These hyperbaric chambers are a critical component of the experimental diving facility mission. The intimate knowledge the contractor has of the precise penetrator fittings, materials, openings, and hyperbaric chamber design requirements is well-proven as their chambers are in use across the Navy as well as other commercial facilities using hyperbaric chambers. Execution of this contract allows for significant cost savings to the government if Arc Controls, Inc. is to provide this material. Their unique experience and ability the meet our needs allow for less risk and lower costs of this service. Additionally, time constraints are applicable as we are currently operating, and have requirements for all N31 hyperbaric chambers to perform mission essential tasking and have requirements that will become due before a contract bid process could be completed. Recent market surveys of available alternatives have demonstrated higher costs and longer lead times for lesser chambers that do not meet the ultimate requirements of NEDU. As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement. Therefore, it is in the Governments’ best interest to award on a sole source basis to Arc Controls, Incorporated.

4. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).

The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.

5. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

The Arc Controls, Inc. chamber represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the

Government’s needs.

6. Any other facts supporting the justification.

None

7. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.

As stated in paragraph 4 above, Arc Controls Incorporated is the only source that can meet the requirement.
