PERFORMANCE WORK STATEMENT (PWS)
150-Ton Chiller Lease
PART 1
GENERAL
INFORMATION
1. GENERAL: This is a non-personal services contract to provide one (1 ea.) portable water chiller unit capable of 150-ton capacity, air-cooled, with accessory equipment. The Government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.
1.1 Description of Services: The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide one (1 ea.) portable water chiller unit capable of 150-ton capacity, air-cooled, with accessory equipment as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract.
1.2 Background: In support of maintenance being conducted on 688 class Submarine during the 1SC project availability, PSNS & IMF requires one (1 ea.) portable water chiller unit capable of 150-ton capacity, air-cooled, with accessory equipment. The chiller will be installed in the weather on the pier to provide chilled water (CW) to portions of the ship with widely varying chilled water flow rates and heat loads. The contract shall also include setup, startup assistance, operator training, and all maintenance. Throughout this specification, the completed system, including all components, is referred to as “the chiller”.
1.3 Objectives: Provide Chiller to supply chilled water to 688 class Submarine during 1SC availability.
1.4 Scope: The chiller and accessory equipment shall be delivered and set up by the contractor. The vendor shall provide training to three government personnel who shall operate the equipment during the rental period and change the chilled water filters as needed. All other maintenance and repairs shall be the responsibility of the vendor. The government will connect electrical power to the chiller and pumps, connect temporary freshwater to the surge tank and connect the supply and return hoses to the government distribution system.
1.5 Period of Performance (POP): August 2023 to February 2024. (Note: This notional POP is provided for planning purposes only. The Government is not obligated to pursue this schedule or a future solicitation because of this Sources Sought.)
1.6 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. Submit with proposal a quality control plan (QCP). After acceptance of the quality control plan the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system.
1.6.1 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.7 Location:
1.7.1 Place of Performance: Naval Base Point Loma.
1.7.2 Hours of Operation: The contractor is responsible for conducting business, between the hours of [0800-1600] Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons.
When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.7.3 Recognized Holidays: Contractor is not required to perform services on federal holidays. The list of current federal holidays can be found here:

1.8 Security Requirements: Naval Base Point Loma
1.8.1 Contractors who have a need to access a government computer system may be eligible for a contractor CAC; most contractors are not eligible for a CAC. Contact the Contracting Officer’s Representative (COR) or Contracting Officer’s Security Officer for assistance as need a. Access verification is required for all personnel requesting entry into the Enclave via the turnstile for pedestrians or vehicle gates for government and authorized commercial/contract vehicles.
1.8.2 In order to use Enclave entry control points, Armed Forces and Department of Defense (DoD) personnel desiring access to the piers require an encoded Armed Forces Identification Common Access Card (CAC) for Active Duty Military Personnel, DoD CAC for civilian personnel, a DBIDS badge for contractor personnel, or a temporary access badge issued by the Pass and ID office. The process for enrollment into the database is discussed in the following paragraphs.
Access to NBPL’s Enclave does not grant individuals access to other installation Enclave areas.
1.8.3 Only Government vehicles (GOVs), golf carts, or licensed commercial vehicles making deliveries are authorized entry into the Enclave. Afloat tenant commands and ashore commands that perform support functions for the afloat units will be authorized Enclave access in government vehicles. At no time will parking be allowed on the piers; as vehicle access is granted for loading and unloading of personnel and/or equipment. Any commands or contractors in violation of parking on the piers will be forwarded to the NBPL Commanding Officer and are subject to the loss of vehicle access privileges into the Enclave. Commands and contractors will be required to request permission from the NBPL Commanding Officer (CO) for privilege reinstatement.
1.8.4 GOVs, golf carts, and approved licensed commercial vehicles, are the only vehicles allowed access inside the Enclave. Private Motor Vehicles (PMVs) and rental vehicles are not authorized access to the Enclave area. Only GOVs and golf carts assigned to units operating within the Enclave will be authorized to park in designated parking spaces overnight. GOVs and golf carts must be parked in a designated parking space within the Enclave, but not on the pier. For security concerns, ships deploying, or getting underway, for one week or longer, will be required to park their vehicles outside of the Enclave.
1.8.5 All contractors requiring access to the Enclave will contact their government sponsor for entry approval. After confirming the legitimate requirement for that specific contractor to have vehicular access to the Enclave, the Force Protection Department will grant permission and then provide the contractor access. All licensed commercial vehicles entering the Enclave are subject to vehicle inspection prior to entry.
1.8.6 Normal hours of operation for vehicular access is 24/7.
1.8.7 CAC holders may escort personnel into the Enclave area under the following conditions:
1.8.8 The guest(s) will enter/exit through the main Enclave entrance, Post 14. The sponsor shall remain physically present with the personnel they are escorting at all times. The limit to the number of personnel a single sponsor may escort is ten (10). However, if the sponsor cannot maintain physical control of all sponsored personnel, then additional escort personnel are required. In the instance visitors/guests should require access outside of normal working hours, access shall be granted through the COG, upon verification of necessity. The sponsor will escort the guest(s) from time of entry to the time of exit of the Enclave area. Upon completion of the visit, the sponsor shall escort the guest(s) to the main Enclave entrance and verify the guest(s) have left the restricted area.
1.8.9 This access/authorization is not inherited by or extended to contractors. Contractors may not act as sponsors for individuals or groups.
1.8.10 Escorted personnel over the age of 16, in the restricted area, must have a current state or federally-issued identification.
1.8.11 To reiterate access controls for the Enclave area, NBPL Enclave is a restricted area requiring enrolled access. The Enclave fence line and turnstiles are monitored and recorded by a digitalized date/time stamped camera system. Additionally, the turnstiles report each access made with a date/time stamp and name of encoded card utilized for entry to the Enclave.
Allowing access for anyone other than who the CAC/DBIDS Card is issued to is in violation of a lawful order and is subject to suspension of encoded card privileges. This includes swiping cards for others “piggybacking” to allow multiple entries under one access.
1.8.12 For Vehicle Access, contractors shall provide a valid, current Driver's License, vehicle registration, and proof of insurance to Naval Base Point Loma Pass & ID Office.
1.8.13 Cell phones equipped with cameras are PROHIBITED in the Waterfront Restricted Areas.
1.8.14 Contractor Employees shall adhere to PSNS&IMF NOTICE 5239.6 PORTABLE
ELECTRONIC DEVICE (PED) GUIDANCE.
1.8.15 ALL portable electronic devices are STRICTLY PROHIBITED onboard submarines (e.g.
phones, mp3 devices, computing devices, recording equipment, removable storage media, etc.).
1.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.10 Contracting Officer Representative (COR): The (COR) will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance:
maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.11 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.
PART 2
DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1 DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER. A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S.
Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4 DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5 QUALITY ASSURANCE. The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.6 QUALITY ASSURANCE Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.7 QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.

GOVERNMENT FURNISHED PROPERTY, EQUIPMENT, AND SERVICES
3. GOVERNMENT FURNISHED ITEMS AND SERVICES:
3.1 Services: The government will provide forklift and rigging services for loading and unloading rented chiller equipment.
3.2 The government will connect electrical power to the chiller and pumps, connect temporary freshwater to the surge tank and connect the supply and return hoses to the government distribution system as required.
PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract that are not listed under Section 3 of this PWS.
4.2 Preventive Maintenance: Determine the need for and conduct preventative maintenance on the equipment, other than changing the chill water filters, (if used). If the equipment will need to be taken out of service to conduct this service, the contractor shall notify the customer and obtain permission prior to securing the compressor.
4.3 Preparation for Delivery:
4.3.1. Prior to delivery, the contractor shall ensure the chiller and components are clean, fully charged with Freon, new filters (if used), has no deferred maintenance, and is fully operational with all operating parameters within the limits prescribed in the manual. If the chiller and associated components cannot be made fully operational within 48 hours of delivery, the contractor shall replace the compressor with a fully operational chiller unit and/or associated components, or may, at the government’s option, be declared to be in default of the contract.
4.3.2. The chiller unit and associated components must be preserved and packaged per the manufacturer's commercial practice. Packing shall be in a manner that will insure acceptance by a common carrier and safe delivery at the destination. The shipping container and method of packing must comply with the Uniform Freight Classification Rules or other carrier regulation as applicable to the mode of transportation.
PART 5 SPECIFIC
TASKS
5. SPECIFIC TASKS:
5.1 Chiller supply parameters:
5.1.1 The chiller shall be rated for at least a 150-ton nominal and 150-ton design refrigeration capacity and shall be capable of supplying at least 300 GPM with a pressure loss of 40 psi in the customer loop (i.e. from the chiller CW discharge to the chiller CW inlet). The chiller shall be capable of being operated from no cooling load up to 150-tons continuously where compressors shall automatically come on and off line as required and the automatic recirculation valve shall open to maintain the required minimum flow through the chiller during low flow conditions and close during high chill water demand conditions. The water to be chilled is freshwater.
5.1.2 The chiller controls shall be capable of being adjusted to supply chilled water at a temperature of 42ºF with a temperature difference (Delta T) of 10ºF. The controls shall be capable of being adjusted to maintain the temperature within a 1ºF modulating band between 40 and 50ºF.
5.1.3 Only equipment generating 90 dBA or less when tested IAW ANSI S12.16 is acceptable. The contractor shall identify any product being offered that is certified as a low-noise-emission product per 42 USC 4907.”
5.2 Equipment Requirements:
5.2.1 The chiller shall be air-cooled and electrical-powered, suitable for a 460-volt, 3-phase power supply. The chiller package shall be self-contained so that it is capable of chilling water and circulating the chilled water in the customer’s loop without any additional utilities or equipment once the electrical power supply, freshwater supply, and chilled water supply and return lines are connected.
5.2.2 The required accessory equipment includes, the following so that the package with accessory equipment connected functions as a self-contained chiller once the government-provided utilities are connected and the package is connected to the government distribution system as shown in the diagram in reference 6.4.
a. Pump, 300 GPM minimum at a TDH of at least 115 feet.
b. (2ea) 4” LPA flanged Tee assemblies, (2ea) 4” 90 degree elbows, (600 ft.) 4” hose assemblies, (1ea) 4” LPA flanged isolation valves with 4” LPA flange x 2-1/2 male camlock, (1ea) 4” LPA flanged isolation valves with 4” LPA flange x 2-1/2 female camlock fitting, and (2ea) 4” isolation valves as necessary to connect the accessory equipment to the chiller as shown on the attached diagram.
c. One 500 gallon minimum surge tank with a float-operated valve for freshwater make-up supply and an atmospheric vent.
d. One automatic bypass recirculation valve.
e. Cam Lok to Terminal Lug Pigtail Adapters (25 feet) for electrical connections.
5.2.3 The chiller shall include a strainer or filter which handles the entire chill water flow. There shall not be any bypass around the strainer. The strainer shall be designed for the rated flowrate.
5.2.4 The chiller shall have electric condenser fans which cycle on and off as needed, to accommodate the varying load and varying outdoor temperature.
5.2.5 The chiller unit shall be self-regulating with fully automatic controls, alarms, and indicators so that the chiller package requires monitoring no more than once every three days by the chiller operator.
5.2.6 Required instrumentation: chilled water flowmeter, chilled water inlet and outlet temperature gages, chilled water inlet and outlet pressure gages, and other instruments as necessary to monitor the operation of the unit.
5.2.7 The connected load will consist of cooling coils and industrial equipment, all of which will be cycled on and off. The total load will vary from nearly no load to 150-tons. Each chiller shall include controls and flow components to permit the chiller to automatically accommodate these widely varying loads and flow rates. It is permitted for the refrigeration equipment in the chiller to automatically cycle on and off to accommodate the varying load.
5.2.8 The inlet and outlet chill water connections shall be 4” LPA with exception of the 4” isolation valve discharge shall be 2-1/2” M/F camlock fitting.
5.2.9 The chiller package shall be suitable for operation in an outdoor marine environment.
5.2.10 The chiller package shall be capable of being operated, continuously, 24 hours per day, without requiring shut down for maintenance, except the chiller may require shutdown to change or clean the chilled water strainers/filters.
5.2.11 The chiller package and accessory equipment shall be constructed to permit lifting by a crane and forklift or mounted on a wheeled trailer and shall comply with the applicable ASME Boiler and Pressure Vessel code.
5.2.12 A backpressure regulator shall be installed as shown in Figure 1 to provide the minimum required chiller flow rate if the flow in the government distribution system is zero. The set point shall be the matching point on the pump curve. The backpressure regulator shall be similar to a Jordan Valve Model 50 or equal.
5.2.13 Hose assemblies shall be 4” with LPA flanges and 25-ft long to be equivalent to Goodall N325 except that hoses installed on the pump suction side shall be non-collapsible rated for full vacuum. Shorter lengths are acceptable to facilitate connecting contractor – provided accessory equipment together shown on the attached diagram.
5.3. Construction:
5.3.1 The control panel shall be listed by Underwriter’s Laboratory or other Nationally Recognized Testing Laboratory for use in the weather. A label or other NRTL marking shall be present on the control panel.
5.3.2 The chiller and associated components shall be constructed to be portable and capable of being transported by both forklift and crane.
5.4 Additional Contractor Services/Requirements:
5.4.1 Contractor shall use all General Occupational Safety requirements in accordance with Reference 6.1.
5.4.2 Deliver and setup the chiller and accessory equipment. Connect the accessory equipment that is not integral to the chiller package, such as the recirculation pump, hoses and surge tank to the chiller unit so that it functions as a self-contained unit once the necessary electrical and water supply has been connected to the chiller unit and pump by the government.
5.4.3 The contractor shall provide start up training for the chiller and associated components on-site at Naval Base Point Loma, San Diego, CA. The training shall be conducted the day of, or the next day after the chiller and associated components are setup and operational. Training shall require no more than one instructor and shall last no longer than one workday. All other maintenance and repairs shall be the responsibility of the vendor.
5.4.4 The contractor shall make the chiller and accessory equipment available on a 24 hour notice for inspection by PSNS&IMF personnel prior to delivery of the equipment.
5.4.5 Connect chillers and the accessory equipment together using 4” hose so that the chiller with accessory equipment connected functions as a self-contained system once the government-provided utilities and distribution system are connected to the contractor- provided system package as shown on the attached diagram.
5.4.6 Provide operating instruction manuals for the chiller package.
5.4.7 Provide a written hose hydrostatic test report that provides objective qualitative evidence that the hoses have been hydrostatically tested to at least 150 PSIG within the last year. The contractor shall certify that hose assemblies are free of leaks, excessive twisting or kinking; that end fittings are not damaged or faulty, and that the end fittings and ferrules are still properly positioned on the hose ends. Also that the hose does not have hairline cracks, breaks, abrasions, soft spots, bulges, or other defects in the outer cover. Written certification of satisfactory hydrostatically tested (100% of hoses) shall be provided with shipped hoses.
5.4.8 Provide 24 hour a day, seven day a week on-call repair. The contractor will be responsible for initiating repairs within 24 hours of verbal or written notification that the equipment has malfunctioned.
5.4.8.1 In the event that the Chiller unit fails to operate at any time, the Contractor shall supply a manufacturers repair/service technician to repair or determine needed replacement of Chiller unit within 24 hours of verbal or written notification that the equipment has malfunctioned. If replacement is needed replace unit within 48 hours.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form.
