About this file
This document contains procurement terms and conditions established by the State of Ohio, effective October 2025, applicable to contracts awarded through the Ohio Department of Development and related state agencies. The document outlines mandatory compliance requirements for suppliers engaging in state contracting, including affirmative action program verification, supplier registration procedures, and non-discrimination standards. New suppliers must complete a Supplier Information Form and IRS Form W-9 through the Ohio Supplier Portal, while existing state suppliers need only submit a current W-9 form with their quotes. All suppliers must comply with state and federal equal employment opportunity laws, including Ohio Revised Code Section 125.111, and are encouraged to source goods and services from Minority Business Enterprise (MBE) and Encouraging Diversity, Growth and Equity (EDGE) vendors.
The terms establish strict prohibitions on offshore service delivery and data processing, restricting suppliers from performing services or storing state data outside the United States without obtaining a signed waiver from the State. Additionally, all suppliers are prohibited from conducting business with Russian institutions or companies, with the State reserving the right to recover any funds expended in violation of these restrictions. Suppliers must complete and submit the Contractor/Subcontractor Affirmation and Disclosure Form with their quotes, confirming understanding of and commitment to meeting these prohibitions. Any changes to service locations disclosed on the form must be reported through submission of a revised form during contract performance. The Affirmative Action Program Verification Form is required for contracts valued at $5,000.00 or more. A Sales and Use Tax Blanket Exemption is available upon request.
