Specifically for HR the software licenses support the check-in check-out (CICO) process which is used to facilitate the tracking and completion of onboarding and off-boarding requirements for transitioning workforce members (WFMs) across the ONR enterprise and each ONR division plays a vital role. 4. IDENTIFICATION OF STATUTORY AUTHORITY.
The statutory authority permitting an exception to fair opportunity is Section 41 USC from only one source in the case of a follow- uplication of cost
The additional authority is (FAR) 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. RATIONALE JUSTIFYING USE OF CITED STATUTORY AUTHORITY.
More than one awardee is capable of providing the maintenance and technical support required, but fair opportunity is limited by restriction to a brand name. ONR has already purchased the software licenses and invested over $1M in software licenses and contractor support to establish workflows and implement ServiceNow. Even if a competitor offered their product for zero cost in the first year to the Government, ONR would not recover the sunk cost already invested.
Furthermore, only the OEM, ServiceNow, or an OEM authorized reseller can provide the standardize and improve the overall efficiency of a variety of business applications including both Human Resources (HR) and Information Technology (IT). There are no known sources, other than the OEM or authorized resellers, who have the capability or OEM proprietary permission for system access, to perform the required maintenance services such as delivery of software patches, maintenance releases, and 24/7 technical support.
6. DESCRIPTION OF EFFORTS TO ENSURE OTHER POTENIAL SOURCES WERE
SOUGHT.
Several products were reviewed including Remedy, People First, and ServiceNow. In addition, NAVSUP had already selected and successfully implemented ServiceNow in 2017 to automate and approved the purchase of ServiceNow on 1 June 2018. Subsequently, PIIM initiated a limited purchase of the software and hosting in FY19 and commenced the development of workflows and processes to be utilized by the software.
7. DETERMINATION OF FAIR AND REASONABLE COST.
vehicle. Competition and the use of the DoD ESI vehicle will ensure fair and reasonable pricing.
8. ACTIONS TAKEN TO REMOVE BARRIERS TO COMPETITION.
After full implementation of ONR requirements, future ONR purchases will consider full and open competition and other solutions that comply with DoD mandated solutions.
