About this file
This document is a Sole Source/Brand Name Justification for the procurement of HP network printers under the Simplified Acquisition Threshold. The justification explains that HP printers are the only brand that meets the specific requirements of the Naval Surface Warfare Center Carderock Division (NSWCCD), including large format printing, duplexing, color printing, and high print speeds. HP is the sole source provider, as they have exclusive licensing agreements and proprietary rights over the required features. The estimated cost is for the hardware only. The related federal contract opportunity is a solicitation (N0016725Q0024) for the procurement of HP network printers on a brand name basis for NSWCCD.

NSWCCD Sole Source/Brand Name Justification SAT rev 1 Effective September 2020
USE OF OTHER THAN FULL AND OPEN COMPETITION LESS THAN
SIMPLIFIED ACQUISITION THRESHOLD MEMO
FROM:
CODE: 8309
SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &
Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)
I. BACKGROUND
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
3. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.
II. DESCRIPTION OF ITEM OR SERVICE
An RDTE network printers comprehensive printing hardware refresh at JEBLC-FS- building 1602, NRFK buildings V-47 & V-82, and NSWC building 904. Desktop printers and larger footprint models will provide large format printing, duplexing, manual feed, color printing, etc.

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION
A. BRAND NAME: Item required must be a brand name product, or feature of a product, particular to one manufacturer.
1. Restrictive Rights:
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer
(OEM).
3. Other Reasons:
HP is a used extensively in the DoD industry and has an active user base. NSWCCD uses HP printers in high volume and demands a minimal failure rate. Little Creek has logistics in place to support HP products. If another brand was chosen we would expend a duplication of equipment where our current inventory for HP universal transfer rollers, maintenance kits , fusers etc would become worthless. And we d duplicate those purchase for another brand.

Their large format capability is a command requirement. The speed of PPM is necessary for high print jobs. The duplex feature set is a paper saver and HP offers a cleaner duplex which is highly reliable. Other brands are slower and have a higher failure rate.
B. SOLE SOURCE (select all that apply)
1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.
2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer
