About this file
This document is a Brand Name Justification for an exception to the fair opportunity process for a federal contract opportunity to replace the security camera system at the U.S. Naval Undersea Museum.
The proposed acquisition is a firm-fixed-price order for the replacement of the museum's CCTV system, including a video management server, camera licenses, viewing stations, network switches, and various IP cameras from Pelco and Avigilon. The total estimated cost is $4. The justification cites that the Pelco and Avigilon products are the only ones compatible with the existing cabling and network infrastructure, and are compliant with Section 889 regulations prohibiting certain telecommunications and video surveillance equipment. The procurement will be set aside for authorized resellers and distributors of Motorola Solutions, Inc., the parent company of Pelco and Avigilon. The installation must be completed within 6 weeks of contract award. The contracting activity is NAVSUP Fleet Logistics Center Norfolk, and the requiring activity is the Naval History and Heritage Command.

4. Identification of the justification rationale. The statutory authority that permits not providing each awardee a fair opportunity to be considered for each order exceeding the MPT issued under a multiple award contract is 10 U.S.C. 3406(c)(5), as implemented by FAR 16.505(b)(2)(i). The applicable exception to the fair opportunity process for this justification for the award of an order exceeding the MPT, but not exceeding the simplified acquisition threshold, is:
FAR 16.505(b)(2)(i)(B) - Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.
This is a justification for the use of items particular to one manufacturer, under the authority of 10 U.S.C. 3406(c)(5), as implemented by FAR 16.505(a)).
The manufacturer is Motorola Solutions, Inc., 500 W. Monroe St, Chicago, IL 60661, USA.
The proposed acquisition requires replacement equipment from Motorola Solutions, Inc.’s two subsidiaries:
1. Pelco, Inc.

The U.S. Naval Undersea Museum requires replacement of its CCTV system, as the current system is not compliant with Section 889. On 11 August 2020, Defense Pricing and Contracting (DPC) issued memo, GCPC Guidance related to Implementation of the Section 889 (a)(1)(B) Prohibition on Contracting with Entities Using Certain Telecommunications and Video Surveillance Services or Equipment.
Public Law 115-232 prohibits executive agencies from entering into, extending, or renewing a contract with a contractor or merchant which uses any equipment, system, or service that uses telecommunications or video surveillance equipment or services from certain named companies as a substantial or essential component of any system or as critical technology as part of any system. The proscribed companies are Huawei, ZTE, Hikvision, Hytera, and Dahua and their subsidiaries and affiliates. This law went into effect on August 13, 2020. Section 889 (a)(1)(B) applies to all purchases including micro purchase transactions.
The Pelco and Avigilon products are Section 889 compliant. The majority of security cameras and supporting accessories available in the open market are NOT compliant. Thorough research has been done to find quality products that are compliant, and the determination was that Pelco and Avigilon are the brands that must be used, as they will also work with the existing cabling.
5. Specific characteristics of the supplies or services support an exception to the fair opportunity process (i.e., unique features, function of the item, etc.). Describe in detail why only this/these supplies/services and/or awardee(s) can furnish the requirements to the exclusion of other supplies/services and/or awardees.
The supplies or services must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. While the requirement calls for the removal of the obsolete cameras, the existing cabling, mounts, and monitors will be re-used. The Avigilon Unity and Pelco CCTV System is Section 889 compliant and is the only system that is compatible with the existing cabling and network backhauls between the CCTV network switch locations installed at NHHC.
6. Market Research. Provide a description of the market research conducted among awardees and the results thereof OR a statement of the reason market research was not conducted.
