Subj: JUSTIFICATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION FOR

A FAR PART 13 ACQUISITION UNDER THE SIMPLIFIED ACQUISITION

THRESHOLD FOR REQUISITION 25DMD0023

I. BACKGROUND:

1. FAR 13.106-l (b)(l )(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

2. As required by FAR 13.106-3(b )(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a po1tion of the requirement) and the requirement ( or portion of the requirement to be sole-sourced) is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE:

30Ft Contender Tournament center console vessel with twin 300HP Yamaha IDES (V6) gray outboards, Garmin chart plotter/radar electronics package and an aluminum double axle trailer.

III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN COMPETITION IS

BASED ON THE FOLLOWING (select all that apply):

1. _ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.

2. _ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.

3. OTHER REASONS.

B. _x_ BRAND NAME

Item required must be a Contender brand vessel with Yamaha engines, Garmin Electronics and an Ameritrail trailer for the following reasons.

1. Standardization - The Marine Training Branch (MTB) has been training students with

Contender center console boats for over 20 years. Acquiring a new vessel that is virtually identical to the existing fleet allows the students and staff to train from all the MTB vessels in a safe and effective manner. This is particularly valuable when it comes time to complete performance evaluations as the students will always be evaluated on a vessel similar to what they've been training on.

2. Durability - Contender vessels have shown to be durable and well made. The

Contender boat that this acquisition is replacing has endured over 18 years of use in the

Marine Training Branch Fleet. The vessel being replaced has over 5000 hours of utilization in the harsh marine environment. The vessel subject to this acquisition will be manufactured with the resin infusion process which will yield an even more durable and efficient hull. Additionally, the specified electronics package will utilize digital switching which will simplify and ruggedize the vessel's electrical system.

3. Maintenance and repairs - For the purposes of maintaining and repairing MTB vessels, the MTB marine technician is familiar with the systems on Contender boats which ensures the vessels are available for training. The MTB technician is also Yamaha certified to do maintenance on the engines which helps lower service costs and reduce the number of spare parts required to keep the fleet operational.

For the purposes of training availability and safety, it is difficult to overstate the importance of the above factors when acquiring a replacement MTB vessel.

C. __ URGENT AND COMPELLING. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
