4. STATUTORY AUTHORITY: This contractual action will be executed under the authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1(c), Application for brand-name descriptions.
5. RATIONALE SUPPORTING USE OF AUTHORITY CITED: The work specification package identifies the brand name components specified above, which are essential to the Government’s requirements as identified below, thereby precluding consideration of products manufactured by other companies.
Emergency Use: The Cougar spillway gates are operated only during times of emergency, and it is therefore essential that spare components fit on both of the spillway gates. Maintaining a second set of spares that does not fit on both gates creates an unacceptable risk of failure as spares and operational equipment are stored at Lookout Point. Maintaining and storing two separate sets of equipment creates a risk of pulling the incorrect set, leading to gate inoperability at a time of emergency. Driving to Lookout Point takes at least 1 hour and 15 minutes each way in good weather, meaning an incorrectly pulled set of equipment would add at a minimum an additional 2 hours and 30 minutes to the emergency response time. Failure of the Cougar spillway gates would result in uncontrolled release of water. Therefore, the brand name components identified above were selected because they both match components that were installed in the rehabilitation of Gate 1 and fit on both gates.
Long Term Maintenance: Cougar Spillway Gate 2 is maintained in-house by project staff. As the supplies described in section 3 were installed in the rehabilitation of Gate 1, an additional brand or product would increase the effort to maintain the gates that are otherwise identical, requiring double storage of a component that functions the same. Matching what was most recently installed would also allow for the purchasing of spares that could be used in case of failure on either gate, eliminating the need for double storage. Critical mechanical equipment spares were not acquired on the initial contract. As Cougar’s spillway gates are dedicated to emergency use only, it is critical to have spares on hand that can be used to quickly bring the gates back to an operational condition. The concern of long-term maintenance applies to all the below listed brands.
ABB Baldor-Reliance Industrial Motors: The motors provided in the previous contract were designed with a much flatter torque curve than other commercially available motors. A flatter torque curve is needed in this application as the motor must provide enough torque to lift the gate without stalling while also not over-tensioning the wire ropes. Over-tensioning can be avoided with the use of torque limiting devices; however a design decision was previously made for this site to use custom wound motors. Completion of construction in the original vein is recommended, as additional design work would be required to locate and accurately set the torque limiting devices. Other sites have used these devices and have experienced multiple issues with false trips causing the gate to not raise. The required torque curve for this application cannot be achieved by any of the standard NEMA designs and as a result requires a custom winding. The flatter torque curve is difficult to produce to natural variations in materials and requires testing to verify that it has been achieved.
In discussion with three motor manufacturers, it was determined that the development costs of this motor exceed the reasonable cost of sale. The development of this custom wound motor is costly as it is difficult both to develop the torque curve that is theoretically capable of performing the task and fabricate the motor that matches that exact curve. Between these two factors, most manufacturers will not fabricate this type of custom wound motor as it is a very limited use case that does not recoup development costs. Baldor-Reliance has already completed the design work needed to produce these motors and have stated that they are willing to produce additional units. The cost to complete this design work was included in the original purchase price of the motors.
A minimum of one custom wound motor is needed as a part of this contract as no spares were purchased in the original contract for Gate 1 and the custom wound motors require a minimum of 16–18-week lead time to be obtained and cannot be replaced with a motor held in normal inventory.
Kop-Flex Matching pinion shaft and line shaft coupling materials to Gate 1 would allow for the purchasing of spares that can be used in case of failure on either gate. The shaft couplings are a critical component in case of failure and should be stored on site. As mentioned above, storage space is limited on site. The purchasing of a spare component of a different brand will require a different shaft finish and fit.
Stromag Matching the limit switch of Gate 1 would allow for the purchasing of a single spare that can be used in case of failure on either gate. As well as requiring double storage and additional training for site staff, the use of an alternate brand creates a risk of replacement with an incorrect component, described in the above Emergency Use paragraph. The limit switches are a key equipment protection component, and the use of an incorrectly adjusted limit switch could result in gate damage ranging from hoist equipment overload to buckling of structural components.
Descase Descase desiccant breathers are used across the WVP and project staff are trained to correctly size and replace breathers based on their part numbers and end of life indication color. Purchasing an alternate brand would require double storage and double effort to train staff. Having an alternate brand with a different indication color also creates a risk that the breather will not be replaced at the correct time, leading to contamination of the parallel shaft reducer oil bath. Spare breathers would not have to be purchased within the scope of this contract if the breathers are standardized.
EDT Corp / Polyround Solution Matching pillow block and bearing materials to Gate 1 would allow for the purchasing of spares that can be used in case of failure on either gate. These greaseless bearings are also used across the WVP.
These bearing inserts are designed to be replaced quickly in case of seizing. The bearing inserts can be replaced in less than 20 minutes. Specification of this component cannot be provided without divulging the design of other vendor’s materials. Use of an alternate brand would result in the risks described in the above Emergency Use paragraph.
BEST Best Lock B Series are used throughout the Valley and issuing a second unique key to all applicable WVP personnel to fit a “one off” lock would be thousands of dollars and cause thousands of dollars annually in key accountability. Additionally, it creates a risk that site personnel will not have the correct key to operate the gate during a time of emergency.
OMEGA Omega heater disconnects are used across the WVP. Spare heater disconnects would not have to be purchased within the scope of this contract if the heater disconnects are standardized. As the scope of Gate 2 connects to existing systems connection compatibility is required. Connector landing pads designs are proprietary and unique to the manufacturer. To ensure compatibility, the same brand of connector must be used.
Hubbel Hubbel pendant control station has been used as the basis of design across the WVP. As the scope of Gate 2 connects to existing systems connection compatibility is required. Connector landing pads designs are proprietary and unique to the manufacturer. To ensure compatibility, the same brand of connector must be used. Use of an alternate brand results in the risk described in the Emergency Use paragraph. The control station is the only way to operate the gate. If an operator has the incorrect control station, the gate cannot be operated for at least another 2 hours and 30 minutes during a time of emergency.
Corning Matching the pigtailed splice cassette materials to the Intake Towers system would allow for the purchasing of spares that can be used in case of failure on either fiber optic patch panel system. As the scope of Gate 2 connects to existing systems connection compatibility is required. Connector landing pads designs are proprietary and unique to the manufacturer. To ensure compatibility, the same brand of connector must be used.
Lubricating Products Lubricating products including Chevron Meropa, Chevron Ultiplex EP, Citgo Premium Lithium EP2, Sprayon S0000201, and Bostik Findlay Marine Grade Never-Seez are already used on site. Additional brands of products would require double storage and may result in the application of an incorrect lubricant. Two different lubricants with proprietary blends mixing results in unknown consequences ranging from loss of material properties and an increase in friction to the production of toxic H2S gas, as occurred at Blue River in 2016. If an incorrect lubricant is used, the entire piece of machinery will need to be drained and refilled with new oil. In the case of the parallel shaft reducer this would be approximately 40 gallons of oil. If the error is not caught, the machinery may seize and not operate.
