About this file
This is a Worker Protection and Investment Certification Form (BOP-2201) issued by the Commonwealth of Pennsylvania pursuant to Executive Order 2021-06, applicable to the Department of Corrections' athletic mat installation project at SCI Phoenix in Collegeville, Pennsylvania. The form requires all contractors and grantees to certify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws, including provisions related to workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examination fees, seasonal farm labor, wage payment and collection, industrial homework, construction industry employee verification, healthcare overtime limitations, apprenticeship and training, and employment records inspection. The certification must be executed by an authorized official of the contractor or grantee and submitted as part of the bidding process.
The Commonwealth of Pennsylvania imposes significant penalties for false certifications, including contract termination and three-year ineligibility to bid on future contracts under 62 Pa. C.S. § 531. Certifying officials must understand that the certification is subject to Pennsylvania's unsworn falsification to authorities statute (18 Pa. C.S. § 4904) and are obligated to immediately report any changes in the contractor's or grantee's compliance status to the purchasing agency. The form was published on February 4, 2022, and serves as a mandatory prerequisite for all vendors bidding on Commonwealth contracts and grants, with electronic bid responses required through the PA Supplier Portal.
