About this file

This is a Worker Protection and Investment Certification Form (BOP-2201) issued by the Commonwealth of Pennsylvania, applicable to the Department of Environmental Protection's Recycling Hotline Services contract. The certification requires all contractors and grantees to verify compliance with Pennsylvania's Unemployment Compensation Law, Workers' Compensation Law, and applicable state labor and workforce safety laws. These laws encompass thirteen specific areas including workplace misclassification, child labor, minimum wage, prevailing wage, equal pay, employment medical examination fees, seasonal farm labor, wage payment and collection, industrial homework, employee verification, healthcare overtime restrictions, apprenticeship and training, and employment records inspection requirements.

The certification must be executed by an authorized official of the contracting entity and submitted to the purchasing agency. Pennsylvania law imposes significant penalties for false certifications, including contract termination and a three-year debarment from bidding on Commonwealth contracts under 62 Pa. C.S. § 531. The certifying official must also report any changes in compliance status to the purchasing agency immediately upon occurrence. The certification is subject to criminal penalties under 18 Pa. C.S. § 4904 for unsworn falsification to authorities. The form was published on February 4, 2022, and serves as a mandatory compliance requirement for the recycling hotline staffing and operational services throughout Pennsylvania.
