Note: This MFR is only applicable to acquisitions under the Simplified Acquisition Threshold. Acquisitions using FAR Subpart 13.5 shall follow the special documentation requirements at FAR 13.501.

MEMORANDUM FOR RECORD

SUBJECT: Use of a Single Source below the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

A. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).

B. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

The 775 CES Fire and Emergency Services - EMS Program, Hill Air Force Base, Utah requires a Hazardous Material (HazMat) Substance Identifier that is capable of identifying the name and concentrate of unknown substances in all three physical property states of solids, liquids, and gases. The HazMat Substance Identifier required must contain the following characteristics:

- Can identify solids, liquids, and gases using Fourier-Transform Infrared (FTIR) technology.

Note: This MFR is only applicable to acquisitions under the Simplified Acquisition Threshold. Acquisitions

- Full decontamination ability for Hot and Warm zones.

- A library of gases containing 5500+ gases and 22000+ solids and liquids.

- Built-in Hazard information - critical for responder safety and victim protection.

- Built-in Android Tablet with easy-to-use interface.

- Operable while first responders are in a Level A HazMat Suit.

- Team Leader App downloaded onto Tablet for further analysis outside the hot zone by Command Staff.

Product Part Number: 200-00-0020 ThreatID GLS - Includes: Full spectrum FTIR spectrometer with hot-swappable batteries. Upgradeable sample interface for solids and liquids, gases or all. Integrated video beneath interface for ease of sample placement/verification of solids/liquids interface cleanliness. Large, hardened touch screen compatible with gloved hands. ThreatAssistTM Chemical Properties Database -proprietary on-board chemical properties database provides instant access to actionable data on ALL library spectra including:

Common name, physical appearance and common uses, IDLH and Vapor pressure as well as ghs hazard class pictograms and NFPA diamonds. Reachback 1 Year Support Package - free software and library upgrades for life of support package. Full warranty on all parts and labor to repair system. Free loaner system during repair. 24/7/365 access to Ph.D chemists, product engineers and application specialists for spectral interpretation assistance and/or technical support Operational training is provided in an online, easy to access format using pre-supplied samples. Training session is recorded for use as refresher training or to train other shifts.

Product Part Number: 200-00-2010 4 meter gas cell in a 6 inch body. Infrared light passes through the sample 24 times for maximum sensitivity. This allows the instant analysis of gases and vapor with no pre-concentration. The gas interface is positioned over pins and locked into position with no need for alignment. The gas cell is accompanied by a 5,500 spectra library of gases and vapors.

Product Part Number: 200-00-2001 Solids/Liquids sample interface consisting of a diamond crystal, pressure device and liquids well. This allows the instant analysis of solids, liquids, pastes and gels with no preparation. The interface is positioned over pins and locked into position with no need for alignment. The Solids/liquids interface is provided with more than 23,000 library spectra including TICS, TIMS, Drugs (including fentanyl derivatives), MD agents including blister, nerve and next generation agents, pesticides, common consumer products and common mixtures.

TRAINING- CHEMICAL SAMPLING CLASS.

Market Research has indicates RedWave's ThreatID GLS is the only product capable of meeting all of the necessary requirements. The 775 CES Fire and Emergency - EMS Program not currently possess the ability to identify unknown substances in all three physical states which greatly increases potential for responder and civilian harm. This technology is needed to quickly identify and mitigate Hazardous Material incidents which pose catastrophic atmospheric health risks and would bridge the severe performance gap identified during the innovation research. Market Research attempted to find other companies which could provide the technology needed. Other potential sources could identify HazMat substances in two physical states.

None of the companies found could provide a product that is capable of identifying HazMat substances in all three physical states as required. This limitation from other products on the market would drive the need for a minimum of two different identification devices extending unneeded exposure time. Per the Hill AFB EPCRA CERCLA Report, the ThreatID GLS by RedWave was the only monitor on the market that can identify all three physical states for substances. Additionally, use of the ThreatID GLS reduces on scene time from 3-6 hours to 1-3 hours, limiting exposure times. This acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company. A determination by the contracting officer will be made that the anticipated cost to the Government will be fair and reasonable. To remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required in the future, the government will review the specifications of the required identifier.

North American Industry Classification System (NAICS) 334516 Analytical Laboratory Instrument Manufacturing is applicable to this effort.

B. UNUSUAL AND COMPELLING URGENCY.

The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:

1. Date on which the requirement was first identified.

2. Required delivery date/period of performance.

3. Explanation of why delivery/commencement of services by the date mentioned above is required:

Item was awarded under the 75 ABW Innovation program. Earliest delivery possible is requested to get the equipment in service immediately.

4. If appropriate, include any additional pertinent information.
