About this file

This document is a Non-Competitive Procurement Justification Memo for the Naval Surface Warfare Center Carderock Division (NSWCCD) seeking to procure the Ouster OS1 Rev 7.1 LiDAR sensor. The procurement is for a single Ouster OS1 LiDAR sensor bundle, which includes specific components like firmware, version, and 5m sensor box kit, all of which are Buy America and Buy American Certified. The justification memo highlights the sensor's unique capabilities, including 182 beam configurations, a minimum range of 90m on dark targets, a 170m range on lighter targets, and a 42.4-degree vertical field of view.

The memo provides detailed rationale for a sole-source, brand-name procurement, emphasizing that the Ouster OS1 sensor meets specific technical requirements and complies with Trade Agreements Act (TAA) regulations. The document argues that alternative sensors lack comparable capabilities, are more expensive, and would require significant time and resources to integrate into the existing project setup. The estimated delivery date is 15 August 2025, and the procurement is being processed under the simplified acquisition threshold, with the contracting officer's digital signature approving the sole-source solicitation on 16 May 2025.

NSWCCD SAP Non-Competitive Procurement Justification Memo Effective April 2025

MEMORANDUM FOR FILE

FROM:

CODE: 861

TO: Code 02 DATE: 11 June 2025 SUBJECT: Non-Competitive Procurement Justification Memo for Actions Under SAT

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6 allows for limiting sources for orders or BPAs under Federal Supply Schedules under certain circumstances or for items peculiar to one manufacturer

3. As required by FAR 13.106-3(b)(3)(i), FAR 8.405-6(a)(1), or FAR 8.405-6(b)(2), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

II. DESCRIPTION OF ITEM OR SERVICE (Include manufacture/sole source name and address.)

The Ouster OS1 is a digital LiDAR sensor known for its high-resolution 3D sensing capabilities. LiDAR is used in object detection and mapping of environments, especially for environments with a lot of unknown factors. The Ouster OS1 is designed to have high reliability in the most rugged environments and is designed for a variety of weather conditions. With 182 Beam Configurations/Channels, it has a minimum range of 90m on a dark 10% target, a 170m range for a much lighter 80% target. It also has a vertical field of view of 42.4 degrees. The OS1 sensor is designed for industrial automation, autonomous vehicles and other applications, which means that it is perfectly suited for this project.

Manufacturer: Ouster Address: 350 Treat Ave San Francisco, CA 94110 Phone: (415) 949-0108 or +1 415-949-0108 POC: Kip Nix

Estimated delivery: 15 August 2025

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

A. BRAND NAME. The item required must be a brand name product, or feature of a product, particular to one manufacturer.

The ouster os1 LiDAR sensor is a high value option for the technical specs that we have, and has the option to be made in America, therefore will comply with the TAA regulations. We have to adhere to the technical specifications that are met by the suggested vendor which is Ouster OS1 LiDAR sensor.

Many other companies sensors lack this range of capabilities, are more expensive, and do not meet the Buy American/ TAA compliance. The equipment setup is already designed to work with this sensor, with little training required. This already in place setup will ensure cost savings while providing the Government mission success with this project. Other alternative sensors with the same or improved specifications would require time to adjust the setup of our project. That could take a week for one engineer to update, assuming that no additional parts would need to be purchased, not to mention any lead time for the other higher spec, more expensive parts, and any additional equipment.

1. Restrictive Rights. Ouster is the only place to get Ouster products.

2. Exclusive Licensing Agreements.

3. Federal Supply Schedule (FSS) IAW FAR 8.405-6(b).

4. Other Reasons.

B. SOLE SOURCE. (select all that apply)

1. Restrictive Rights.

2. Exclusive Licensing Agreements.

3. Other Reasons.

4. Federal Supply Schedules (FSS): IAW FAR 8.405-6(a)(1)

a. An urgent and compelling need exists, and following the procedures would result in unacceptable delays;

b. Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; or

c. In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order or BPA must not have been previously issued under sole-source or limited-sources procedures.

Provide details as to how the requirement fits into the circumstances selected above. Provide details on why another source would not be capable of meeting the requirement.

IV. CERTIFICATIONS & APPROVALS

A. Technical/Requirements Certification: I certify that the facts and representation under my cognizance, which are included in this justification, are complete and accurate to the best of my knowledge and belief.

B. Certification/Approval: Upon the basis of the above justification and authority, I hereby approve the solicitation of the proposed procurement(s) described herein from a sole source or limited sources,.
