Project Summary

The Town seeks a qualified consultant (or team of consultants) to assist in evaluating and updating the Unified Development Code (“UDC”) and Development Design Standards Booklet (“Design Standards”) for the Town. The initial product of this effort will be a UDC and Design Standards Evaluation that summarizes the review and engagement conducted and identifies major changes planned for the update. The final product of this effort will be an adopted update to the UDC and a new set of adopted Design Standards.

The Town recently completed a major Comprehensive Plan update after a 2-year process with extensive community engagement and collaboration among Town departments. One of the main purposes of updating the UDC and Design Standards is to ensure the regulations and standards reflect the vision, goals, and policies outlined in the Comprehensive Plan.

Project Management and Timeline

The update process for the UDC and Design Standards will be led by the Town’s chosen Proposer (the “Consultant”) and will include coordination and engagement with Town staff, a task force, Planning Commission, Town Council, and the community. Project Background and Description Town Overview

The Town is a full-service community located in Boulder and Weld Counties just west of I-25. The Town’s incorporated area is approximately 20 square miles, with a planning area that spans 39 square miles extending approximately from the north side of State Highway 52, south to State Highway 7, and between US 287 on the west and I-25 to the east. The Town is a growing community currently comprised of approximately 13,000 residential units and 40,000 residents, more than triple the population of 15 years prior.

The Comprehensive Plan Future Land Use Map buildout estimates that Erie could reach 73,000 to 80,000 residents by 2050.

UDC and Design Standards Overview

The UDC can be found in Title 10 of the Town of Erie Municipal Code. The UDC contains the Town’s subdivision and zoning regulations and the land use application processes that are required for development within the Town.

Town staff completed a series of updates to the UDC from October 2019 through February 2022. Phase 1 updates, which occurred from 2019-2020, streamlined and addressed a number of technical issues and clarified standards throughout the UDC. In January 2022, the Board of Trustees (now the Town Council) approved a major Phase 2 update to the UDC, which went into effect on February 18, 2022. The Phase 2 updates included creating the Development Design Standards booklet, which provides site and building design standards for new residential development in a more user-friendly format with illustrations and diagrams. The Phase 2 updates were reviewed by the Denver Metro Home Builders Association; the Planning Commission and Board of Trustees both held study sessions to discuss the changes in the fall of 2021; and the Planning Commission reviewed and made its recommendation regarding the UDC updates to the Board of Trustees at its October 20, 2021, and November 3, 2021, meetings.

Additional updates from 2022-2026 have included administrative review for minor amendments, alternative standards for affordable housing projects, permitting process and regulations for mobile vendors, and flood damage prevention.

Project Goals

The Comprehensive Plan includes numerous policies that require updates to the UDC, and Town staff have identified a number of issues in the UDC related to zoning districts, development standards, and processes.

Town staff have identified the following goals for the UDC and Design Standards update effort:

- Implement Comprehensive Plan policies and goals, including the needs of infill development and flexibility for affordable housing.

- Create transparent, predictable, and consistent processes.

- Respond to feedback and concerns from the community, business owners, developers, and builders.

- Remain consistent with State and federal law.

- Ensure prior individual UDC updates are cohesive.

- Increase use of standard zoning districts instead of Planned Development (PD) zone district.

- Address technical concerns identified by Town staff since the 2019-2022 updates.

Scope of Work The scope of work includes, but is not limited to, the following key tasks:

1. Align with the Elevate Erie Comprehensive Plan update. Ensure the UDC and Design Standards update reflects the Comprehensive Plan’s core values of Livability, Sustainability, and Connectivity. Implement the policies specifically directing UDC updates, which include topics of water conservation, green infrastructure, green building practices, infill development, diverse housing options, and housing affordability.

2. Facilitate community engagement. Gather community input through task force focus groups, online engagement sites, social media, surveys, and public open houses. Summarize findings of community engagement and how it is reflected in UDC and Design Standards updates.

3. Simplify code language. Holistically evaluate UDC updates from the last five years and revise as needed to reduce redundancies and ensure a comprehensive and aligned code.

4. Update zoning map, districts, and permitted uses. Evaluate changes to zoning districts and permitted uses to support the Comprehensive Plan’s vision and goals and provide clear guidance. Evaluate historic use of the Planned Development (PD) zone district and identify strategies to increase use of standard zoning districts.

5. Enhance clarity and usability of standards. Evaluate changes to development, design, dimensional, and subdivision standards to be user-friendly and responsive to market trends. Considerations include:

a. Respond to UDC and Design Standards issues and opportunities already identified by Town staff, which include infill development and adaptive reuse, parking incentives, off-street parking guidelines, mixed use design standards, lighting, emergency access, setbacks, fencing, and signs.

b. Incorporate updated Transportation Mobility Plan priorities and policies.

c. Incorporate Waterwise landscaping principles in the UDC and other UDC updates occurring separately.

d. Work closely with UDC users—including Town staff, developers, residents, and builders—to understand additional concerns and test feasibility of potential changes.

6. Streamline review and approval procedures. Evaluate changes to the Development Review and Approval Procedures—including the use of Development Agreements—to provide simplification and flexibility.
