Scope of Work/Specifications

Background:

The City of Brighton, Colorado, located in the plains north-east of Denver in both Adams and Weld Counties, has more than doubled in size over the last 20 years. Now a municipality of 50,040 residents, Brighton’s rapid growth has created numerous challenges. Brighton holds many acres of undeveloped land and is mostly surrounded by large-lot and vacant unincorporated properties.

As Brighton continues to see new growth, new and unforeseen land uses have made their way into conversations with City staff. Specifically, the City has been approached by Developers to discuss, process, and approve the construction of data centers.

The City of Brighton is seeking professional assistance to define standards related to noise for future data centers. The standards should ensure protection of the health, safety, and welfare of people on properties near a data center. The City is seeking a consulting team with demonstrable experience in data center noise modeling and mitigation, a proven ability to draft code regulations related to data centers, assistance in drafting the parameters of a noise study, and knowledge of state and federal regulations.

Objectives: The Consultant shall be responsible for educating and informing City staff on any state and federal requirements related to data centers and any potential noise and vibration effects produced by data centers. Further, the Consultant shall assist staff with drafting regulations for the City’s Land Use and Development Code specific to data centers with respect to noise and vibration.

Specifications: The Consultant shall provide assistance to City staff to draft noise standards related to data centers, draft a model noise study to be used to review the noise and sound emissions from proposed data centers, and draft other model noise studies/memorandums to be used to continuously monitor and ensure data centers are operating within the noise maximums.

The Consultant shall be responsible for educating and advising City staff on the effects of data center noise on surrounding residents and land uses, and further taking the lead to draft Municipal Code language specific to data center noise emissions. Additionally, the Consultant shall be responsible to draft model noise studies and conformance memorandums that ensure future data centers are operating within the allowed maximums. This can be achieved through coordination with City staff to provide the basics of the City’s existing codes, review processes and other information as needed.

The Consultant shall coordinate directly with the City’s Community Development Department staff regarding all aspects of the updated Municipal Code (Code) language and model studies/memorandums.

Deliverables: The following section describes the specific minimum components which shall be delivered upon the completion of the project. City staff will finalize the scope of work with the selected Consultant prior to commencement of the Consultant’s services. The City is open to suggestions other than those items listed which the Consultant believes will be of value in producing viable Code regulations and requirements centered around noise effects from data centers.

2025.05.29 Page 6 of 9 RFP# 26500329

1) The Code language draft shall include;

a) Maximum noise and vibration levels measured at the property line to ensure the health, safety and welfare of varying adjacent land uses.

b) Mitigation measures necessary to ensure the health, safety, and welfare of varying adjacent land uses.

c) Ensure the Code language meets all state and federal requirements.

2) The noise study requirements shall include:

a) A model noise study to be used by data center applicants.

3) Continuous Monitoring of Noise Studies

a) A draft conformance noise study/memorandum that ensures data center users are adhering to the limits modeled by the original noise study and the noise limits of the City’s Land Use & Development Code.

City Staff Role: The City staff will provide a strong supporting role to the Consultant in a variety of ways. City staff will actively engage in this process to maximize the time and engagement of the Consultant in their area of expertise.

1) Information gathering to aid Consultant.

2) Coordination and involvement of City staff, such as the City Manager, and Department

Directors to provide review, feedback, or expertise supporting the Consultant’s activities, and information gathering.
