FBO Title: Laser Engraving Machine

Notice No: BEP-RFP-14-0325

PSC: 36 -- Special industry machinery

NAICS: 333517, Laser Boring, drilling, and cutting machines, metalworking, manufacturing

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6, in conjunction with Subpart 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation;

proposals are being requested and a written solicitation will not be issued.

(ii) Solicitation number BEP-RFP-14-0325 is issued as a Request for Proposal (RFP).

(iii) The solicitation document incorporates the following provisions and clauses in effect through

Federal Acquisition Circular FAC 2005-73 effective April 29, 2014.

(iv) The associated North American Industrial Classification System (NAICS) code for this procurement is 333517.

(v) A list of contract line item number(s) and items, quantities and units of measures

(vi) Description of requirements for the items to be acquired.

The Bureau of Engraving and Printing (BEP) Eastern Currency Facility (ECF) has a requirement for a Laser Engraving Machine. See Attachment A, Statement of Work (SOW)

(vii) Period of Performance: Contractor shall deliver all equipment within 45 days after receipt of order. Installation and training should be approximately 15 days. The total period of performance to include delivery of equipment and preventative maintenance, including options, is 5 years and 2 months.

Offerors shall submit the following:

Volume I: Pricing (no page limitations): Offeror shall submit a firm fixed price for the Laser

Engraving Machine. Pricing shall include the full breakdown of all price including shipping installation and training, and preventive maintenance.

CLIN 0008: Option Year 4 – Preventive Maintenance

Volume II: Technical (limited to 10 pages): Offeror shall provide technical description of the equipment being proposed. Description shall include full specifications and capabilities of the product proposed. Product description must meet or exceed the technical standards stated in the

Statement of Work. Offeror shall provide warranty information.

Volume III: Sample Submission: Offerers will be provided with two digital files (one seal image, one signature image) and one flat D2 Steel blank, one flat piece of Graphite and one flat piece of brass with crosshair datums already marked in the pieces (refer to Attachments B & C). Please refer to Attachment A, Statement of Work, Section 5.0 for material sample submission requirements.

Prospective offerors are to contact the Contract Specialist, Carol Pope, carol.pope@bep.gov to request the digital files and materials on which to perform the engraving samples. Instructions for submitting the samples will be provided at that time. Offerors have up until the date the solicitation closes to submit sample submissions.

Volume IV: Past Performance: Offerors shall provide up to three (3) past performance references for the same or similar scope as described in the solicitation. References can be for either government or non-government contracts, completed or in progress, during the past five (5) years.

Offerors shall include the contract numbers, a short description of each contract requirement, and the names, phone numbers, and email address of the persons knowledgeable of past performance.

(ix) FAR 52.212-2 Evaluation—Commercial Items (JAN 1999)

Award may be made without discussions unless the Contracting Officer determines discussions are necessary. One award may be made to the Offeror whose proposal is determined to best meet the needs of the Government after consideration of all factors, that is, the proposal that provides the best value to the Government. Best value is defined as the offer that results in the most advantageous acquisition decision for the Government as determined by an integrated assessment and trade-off analysis among non-price and price factors.

The Government may award to other than the lowest priced offer or other than the Offeror with the highest non-price rating.

The Government will evaluate price, technical, sample submission, and past performance. Technical and sample submissions are more important than past performance and price. When combined, technical, sample submission, and past performance are more important than price.

Volume I: Price – The Government will evaluate price to determine fair and reasonableness. The

Government will evaluate offers for award purposes by adding the total price for all contract line items (i.e., base plus option years). The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the

Government to exercise the option(s).

Volume II: Technical – The Government will evaluate the degree to which the Offeror’s proposal satisfies the requirements set forth in the SOW.

The Marking Requirements and criteria listed in Section 5.0 of the SOW will weigh the most then the Minimum Machine Requirements in Section 4.0 will be evaluated next. Offerors need to clearly address each item (4.1 – 4.18) in Section 4.0, failure to do so will result in a Technically

Unacceptable Rating.

Deliverables: Proposed Maintenance/Support Service Approach, Warranty Information and

Delivery Date, etc. Offerors are required to specifically address items listed in Section 8 of the

SOW.

Volume III: Sample Submission: Please refer to Attachment A, Statement of Work, Section 5.0 for material sample evaluation criteria.

Volume IV: Past Performance – The Government will assess the Offeror’s capability to perform under this contract by evaluating’s past performance on previous same or similar contracts. The

Government will consider the depth and relevance of an Offeror's experience in relation to providing equipment, supplies and services that are same or similar in scope as described in this solicitation.

The Government may contact those references during the evaluation process. In addition, the

Government may, at its discretion, obtain and evaluate information from sources other than those provided by the Offeror.

The lack of recent and relevant past performance information will result in the assignment of a neutral rating and will be considered acceptable.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records --

Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller

General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

FAR 52.217-8, Option to Extend Services (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting

Officer may exercise the option by written notice to the Contractor prior to expiration of the contract performance period.

FAR 52.217-9, Option to Extend the Term of the Contract (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within

30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the

Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

DTAR 1052.201-70, Contracting Officer's Representative (COR) - Appointment and Authority

(AUG 2011)

(a) The COR is To-Be-Completed at time of award.

(b) Performance of work under this contract must be subject to the technical direction of the COR identified above, or a representative designated in writing. The term "technical direction" includes, without limitation, direction to the contractor that directs or redirects the labor effort, - shifts the work between work areas or locations, fills in details and otherwise serves to ensure that tasks outlined in the work statement are accomplished satisfactorily.

(c) Technical direction must be within the scope of the specification(s)/work statement. The COR does not have authority to issue technical direction that:

(1) constitutes a change of assignment or additional work outside the specification(s)/work statement;

(2) constitutes a change as defined in the clause entitled "Changes";

(3) in any manner causes an increase or decrease in the contract price, or the time required for contract performance;

(4) changes any of the terms, conditions, or specification(s)/work statement of the contract;

(5) interferes with the contractor's right to perform under the terms and conditions of the contract; or

(6) directs, supervises or otherwise controls the actions of the contractor's employees.

(d) Technical direction may be oral or in writing. The COR shall confirm oral direction in writing within five work days, with a copy to the contracting officer.

(e) The contractor shall proceed promptly with performance resulting from the technical direction issued by the COTR. If, in the opinion of the contractor, any direction of the COR, or his/her designee, falls within the limitations in (c) above, the contractor shall immediately notify the contracting officer no later than the beginning of the next Government work day.

(f) Failure of the contractor and the contracting officer to agree that technical direction is within the scope of the contract shall be subject to the terms of the clause entitled "Disputes."

DTAR 1052.210-70, Contractor Publicity (AUG 2011)

The Contractor, or any entity or representative acting on behalf of the Contractor, shall not refer to the equipment or services furnished pursuant to the provisions of this contract in any news release or commercial advertising, or in connection with any news release or commercial advertising, without first obtaining explicit written consent to do so from the Contracting Officer. Should any reference to such equipment or services appear in any news release or commercial advertising issued by or on behalf of the Contractor without the required consent, the Government shall consider institution of all remedies available under applicable law, including 31 U.S.C. 333, and this contract. Further, any violation of this provision may be considered during the evaluation of past performance in future competitively negotiated acquisitions.

DTAR 1052.232-7003, Electronic submission of payment requests (OCT 2012)

Electronic Submission of Payment Requests

(a) Definitions. As used in this clause-

(1) " Payment request " means a bill, voucher, invoice, or request for contract financing payment with associated supporting documentation. The payment request must comply with the requirements identified in FAR 32.905(b), "Payment documentation and process" and the applicable Payment clause included in this contract.

(b) Except as provided in paragraph (c) of this clause, the Contractor shall submit payment requests electronically using the Internet Payment Platform (IPP). Information regarding IPP is available on the Internet at www.ipp.gov . Assistance with enrollment can be obtained by contacting the IPP

(c) The Contractor may submit payment requests using other than IPP only when the Contracting

Officer authorizes alternate procedures in writing.

(d) If alternate payment procedures are authorized, the Contractor shall include a copy of the

Contracting Officer's written authorization with each payment request.

DTAR 1052.222-70, Minority and Women Inclusion, (APR 2014)

Contractor confirms its commitment to equal opportunity in employment and contracting. To implement this commitment, the Contractor shall ensure, to the maximum extent possible consistent with applicable law, the fair inclusion of minorities and women in its workforce. The Contractor shall insert the substance of this clause in all subcontracts awarded under this Contract whose dollar value exceeds $150,000. Within ten business days of a written request from the contracting officer, or such longer time as the contracting officer determines, and without any additional consideration required from the Agency, the Contractor shall provide documentation, satisfactory to the Agency, of the actions it (and as applicable, its subcontractors) has undertaken to demonstrate its good faith

For purposes of this contract, good faith effort'' may include actions by the contractor intended to identify and, if present, remove barriers to minority and women employment or expansion of employment opportunities for minorities and women within its workforce. Efforts to remove such barriers may include, but are not limited to, recruiting minorities and women, providing job-related training, or other activity that could lead to those results.

The documentation requested by the contracting officer to demonstrate good faith effort'' may include, but is not limited to, one or more of the following:

(1) The total number of Contractor's employees, and the number of minority and women employees, by race, ethnicity, and gender (e.g., an EEO-1);

(2) A list of subcontract awards under the Contract that includes: dollar amount, date of award, and subcontractor's race, ethnicity, and/or gender ownership status;

(3) Information similar to that required in item 1, above, with respect to each subcontractor; and/or

(4) The Contractor's plan to ensure that minorities and women have appropriate opportunities to enter and advance within its workforce, including outreach efforts.

Consistent with Section 342(c)(3) of the Dodd-Frank Wall Street Reform and Consumer Protection

Act (Pub. L. 111-203) (Dodd-Frank Act), a failure to demonstrate to the Director of the Agency's

Office of Minority and Women Inclusion such good faith efforts to include minorities and women in the Contractor's workforce (and as applicable, the workforce of its subcontractors), may result in termination of the Contract for default, other contractual remedies, or referral to the Office of

Federal Contract Compliance Programs. Compliance with this clause does not, however, necessarily satisfy the requirements of Executive Order 11246, as amended, nor does it preclude OFCCP compliance evaluations and/or enforcement actions undertaken pursuant to that Order.

For purposes of this clause, the terms minority, minority-owned business and women-owned business shall have the meanings set forth in Section 342(g) of the Dodd-Frank Act.''

PACKAGING AND MARKING

NOTICE OF PACKING SLIP REQUIREMENTS:

The following outlines the Bureau of Engraving and Printing’s packing slip requirements to ensure efficient processing of shipments to Washington, DC (BEP-ECF):

The Bureau of Engraving and Printing requires that all packing slips be placed in a self-adhesive pack list envelope and affixed to the outside a shipment.

The packing list will include, at minimum, the following information:

GENERAL ITEMS

Purchase Order Number – The order number the BEP assigned to this purchase.

Shipping Address – Point from which the merchandise was shipped.

Telephone Number – The telephone number to be called for inquires related to the merchandise.

Customer Information – The name and address of the party to which the merchandise is being shipped.

Total Weight of Packages

If items are drop shipped from a supplier, you must ensure the proper purchase order number is written on the packing slip by your supplier.

Quantity Ordered – Quantity on the purchase order

Quantity Shipped – With the packing slip

If the packing slip contains multiple purchase orders, each line item should include the applicable purchase order number.

NOTICE OF SHIPPING LABEL REQUIREMENTS:

Every box/skid must have at least one shipping label applied to it. The label is to include, at minimum, the following information:

Customer Name & Address

Failure to adhere to the packing slip and label requirements could result in shipment rejection, processing delay, or payment delay.

DELIVERY AND INVOICING REQUIREMENTS

A. Delivery Requirements

The following DELIVERY information must be provided when scheduling delivery appointments: (1) Name of supplier/manufacturer; (2) Contract/Purchase Order #; (3)

Total number of items; (4) Total weight; and (5) Date and time of delivery.

B. Deliveries to EASTERN CURRENCY FACILITY, 14 th and C Street S.W

WASHINGTON, DC:

1. Vendors must call the appointment hotline at (202) 874-2333 twenty-four (24) hours in advance to schedule approximate delivery times. The hotline is manned from 6:30 am to

3:00 pm Monday through Friday. A voicemail message maybe left after normal working hours. Deliveries are accepted between 7:30 am and 2:30 pm, Monday through Friday, excluding holidays.

2. Over the road vehicles having an overall height exceeding 12’6” (3.8 meters) empty, or an overall length exceeding 40’ (12.2 meters) cannot be accommodated at our receiving platform.

(xiv) The Defense Priorities and Allocations System and assigned rating are not applicable.
