JUSTIFICATION & APPROVAL FOR FAR SUBPART 13.5 SOLE

SOURCE (INCLUDING BRAND NAME) ACQUISITIONS

Treasury Standard Form – 1013 (Rev 12/15)

Prescribed by Treasury: DTAP 1013.501

1. Identification of the agency and the contracting activity:

The Department of the Treasury, Internal Revenue Service (IRS), Bureau of Engraving and Printing (BEP) Acquisition Branch, purchasing for the BEP Office of Critical Infrastructure & IT Security (OCIITS).

2. Nature and/or description of the action being approved:

New Firm-Fixed-Price (FFP) contract. Competition using FAR 13.5, “Simplified Procedures for Certain Commercial Items”, restricted to brand name Identiv, Intellisense, Magicard, Dell and 3m items only. This brand name justification covers all items being purchased. (Requisition 123713)

3.a A description of the supplies or services required to meet the agency’s needs:

BEP OCIITS needs to purchase 41 items manufactured by Identiv, Intellisense, Magicard, Dell and 3m for the Integrated Security System (ISS) Installation project at the BEP Washington, DC Facility (DCF) and Landover, Maryland Facility. (See attached product list for model numbers, descriptions, and quantities)

Delivery is 30 days after contract award. Award is anticipated on/about September 1, 2017.

No substitutions or partial deliveries will be accepted.

3.b Estimated value:

4. Identification of the authority being used (Check the appropriate box that applies):

41 U.S.C. 1901 – Simplified acquisition procedures.

41 U.S.C. 1903 – Special emergency procurement authority.

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited:

The Bureau of Engraving and Printing (BEP) is currently undergoing a large-scale project to deploy an Integrated Security System (ISS) based on the Identiv Velocity version 3.6 system at its Washington, DC Facility (DCF); Western Currency Facility (WCF) in Dallas Fort-Worth, TX; and Landover, MD Facility. The Government has already invested more than two million dollars for a contractor to perform survey and design work under previous task orders against the competitively awarded ISS Blanket Purchase Agreement (BPA). This resulted in the delivery of a comprehensive design plan that included a Bill of Material (BOM) for each of the three facilities. The BOMs delivered for the DCF and Landover, MD facilities are the basis for the items in this current requirement.

The BOM contains 41 different items manufactured by Identiv, Intellisense, Magicard, Dell and 3m. The current design plan relies on utilizing the items listed in the BOM, and all of the items are integral to the execution of the ISS Installation project. Success of the ISS project relies on the integration of more than ten thousand pieces of equipment with software among the three BEP locations. Therefore, ensuring that each item is compatible with the Identiv system and the overall design plan is critical. The significant investment in the survey and design included comprehensive research to ensure that all items in the BOM will be compatible with the design plan and provide the capabilities required by BEP.

The same solution of items in this requirement has already been purchased and is being installed

Treasury Standard Form – 1013 (Rev 12/15)

Prescribed by Treasury: DTAP 1013.501 in the ISS Installation phase for the WCF. The same items need to be purchased for DCF and Landover due to the need for consistency and standardization of the ISS system, as well as compatibility between the three facilities and the Identiv System.

It is not currently possible for the Government to consider any alternate items without introducing unacceptably high risk to the ISS Project due to the uncertainty of the integration and compatibility capability with BEP’s ISS Design.

Considering the acceptability of alternate items would result in substantial duplication of the work that was already performed during the design phase and would not be practicable. The Government would have to issue a new order or contract to another contractor to research and test each substitute item for compatibility and determine how it integrates with the current Identiv solution. Since the current design plan is reliant on including all items in the BOM, it would have to be rewritten to accommodate the new items. In addition, this additional work would significantly delay the ISS Installation Project for DCF and Landover, which is anticipated to begin on or about October of 2017. The original Survey and Design of the DCF and Landover Facilities required more than nine months to complete.

Therefore, this acquisition must be restricted to only Identiv, Intellisense, Magicard, Dell and 3m brand name items.

6. A description of efforts to ensure that offers were solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR subpart 5.2 and, if not, which exception under FAR 5.202 applies:

Multiple resellers are capable of providing all items required on the open market. This acquisition will be solicited via Federal Business Opportunities (FBO) to ensure all capable vendors are provided the opportunity to compete for award.

7. A determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable:

The anticipated price to the Government will be fair and reasonable. The Contracting Officer will ensure that pricing obtained is fair and reasonable based on adequate competition. In addition, the pricing will be compared to historical pricing and established pricing on GSA Advantage and/or NASA Solutions for Enterprise Wide Procurement (SEWP).

8. A description of the market research conducted (see FAR part 10) and the results or a statement of the reason market research was not conducted:

Significant market research was performed by the contractor during the survey and design work for all three BEP facilities, under a previous task order. This included researching equipment capabilities and resulted in the deliverable of a comprehensive design plan and Bill of Material (BOM) for each of the three facilities. The Bill of Materials serves as the basis for this purchase.

The Government performed market research to confirm that all items are not available on GSA Schedule or SEWP. However, several capable resellers were identified on the open market.

9. Any other facts supporting this justification:

The Independent Government Cost Estimate (IGCE) and product list supports this justification.

10. A listing of sources, if any, that expressed, in writing, an interest in the acquisition:

No sources expressed, in writing, an interest in this acquisition.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required:

This is a one-time purchase that is necessary to provide items for the ISS Installation Project.

For any possible subsequent acquisitions, the Government will conduct additional Market Research and confirm whether the Brand Name restriction remains necessary.
