JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
(JOFOC)
FAR SUBPART 6.3
I recommend the use of other than full and open competition for the acquisition of the following supplies or services. If this acquisition is to be made with only one source or a limited number of sources, negotiations will be conducted with the indicated proposed supplier(s).
1. IDENTIFICATION OF THE AGENCY AND CONTRACTING ACTIVITY:
The Department of the Treasury, Internal Revenue Service (IRS), Bureau of Engraving and Printing (BEP) Information Technology (IT) Acquisition Branch purchasing for the BEP Office of the Chief Information Officer (CIO).
2. NATURE/DESCRIPTION OF THE ACTION BEING APPROVED:
This is a new Firm-Fixed Price contract using FY 15 Procurement funds. There is one base year and four option periods for this requirement.
3. DESCRIPTION OF SUPPLIES OR SERVICES
Pay.gov is a secure government-wide collection portal. The Pay.gov Payment Gateway allows government agencies to collect payments over the internet. The application is web based allowing customers to access their accounts from any computer with Internet access. Pay.gov provides a suite of services allowing agencies to obtain and process collections in an efficient and timely manner. The Pay.gov application consists of four services: Collections (credit card), Forms, Billing, and Reporting.

17. JUSTIFICATION (ADD PAGES IF NEEDED)
A. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR
THE NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED.
Pay.Gov Application Programming and Analytical Services identifies specific IT services which the contractor will be required to provide, to support the Bureau’s current and future use of the Pay.Gov credit card Transactions processing system used by BEP’s eCommerce website hosted at Network Solutions. Bureau’s eCommerce website, launched in November 30, 2009 uses Pay.gov payment gateway built by Network Solutions. Current API was built at Network Solutions to communicate with pay.gov and uses the TCS Single server-to-server interface.
This acquisition is a brand name request for Network Solutions built in payment gateway application interfacing with www.moneyfactorystore.gov. Network Solutions will be able to provide support needed for BEP’s use of Pay.Gov on a Network Solutions hosted platform, using their proprietary application interface to Pay.Gov. A brand name or equivalent from a contractor who can provide support is hereby solicited for this requirement due to its uniqueness.
B. DESCRIBE THE EFFORTS TAKEN TO ENSURE OFFERS WERE SOLICITED FROM AS MANY
POTENTIAL SOURCES AS IS PRACTICABLE, INCLUDING WHETHER A NOTICE WAS OR
WILL BE PUBLISHED AS REQUIRED BY SUBPART 5.2 AND, IF NOT, WHICH EXCEPTION
UNDER 5.202 APPLIES.
The Service anticipates at least one response to a FBO synopsis. A notice of intent will not be posted.
Market Research shows that there is a third party resource currently available via open market that’s able to provide support from Network Solutions.
C. DETERMINATION THAT THE ANTICIPATED COST TO THE GOVERNMENT WILL BE FAIR
AND REASONABLE.
The Contracting Officer will determine the prices to be fair and reasonable based on applicable price analysis techniques.
D. DESCRIBE THE MARKET RESEARCH THAT WAS CONDUCTED AND THE RESULTS OF
THAT SURVEY. IF ACTIONS WERE TAKEN BY PROCUREMENT PERSONNEL TO SATISFY
THIS REQUIREMENT SUCH AS A GPE SOURCES SOUGHT SYNOPSIS, PLEASE SPECIFY.
Market Research was performed on July 17, 2015 by searching Google.com and Network Solutions website.
This payment gateway has been built by Network Solutions and is hosted solely by them, however support from Network Solutions can only be accessed through third party companies, and these sources are available via open market.

Future requirements of this nature will be competed through FBO.
H. STATEMENT THAT REQUIREMENT DOES NOT RESULT FROM A LACK OF PLANNING OR
THE EXPIRATION OF FUNDS.
This requirement does not result from a lack of planning or the expiration of funds. The program office was aware of the requirement on April 21, 2015 and submitted the request in a timely manner, before the expiration of funds.
