JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
SOURCE SELECTION INFORMATION
SEE FAR 2.101 AND 3.104
FOR OFFICIAL USE ONLY
1. Defense Logistics Agency (DLA) Troop Support, Construction and Equipment (C&E) Supply Chain, is the contracting activity.
2. The action being approved is the ability to solicit for supplies on an other than full and open competition basis.
3. Following are the supplies required to meet DLA’s needs:
Item Description: BATTERY PACK National Stock Number (NSN): 4520-01-493-2796 Manufacturer/Supplier Part Number:
HDT Expeditionary Systems, Inc. (HDT) P/N 5-13-5469 Windward Enterprises, LLC (authorized dealer)
Quantity: Annual Estimated Quantity 700 each Number of Options: This solicitation has a one-year base and four (4) one (1) year options Estimated Unit Price: $1,020.00 Each Estimated Annual Dollar Value: $714,000.00 Maximum Annual Dollar Value: $1,400,000.00 Estimated Total Dollar Value: $3,570,000.00 Maximum Dollar Value: $7,000,000.00
4. The applicable statutory authority permitting other than full and open competition is 41 U.S.C. 1901, as implemented by FAR 13.501(a), Sole Source Acquisition.
5. The use of this authority is necessary because HDT Expeditionary Systems, Inc. (HDT) is the only known approved source of the subject battery pack system that meets the needs of the Government. This item is used in HDT’s Space Heater Convective (SHC). A SHC is a tent heater used by all branches of the military. The SHC sits outside of a tent and has ducts/returns inside and outside the tent. This heater was made specifically by HDT for the military. The main benefit of this heater is that instead of plugging into a generator, this SHC generates power by thermo-electric energy. The subject battery pack system is needed to start the heater; however, once the heater is operational, the batteries stop transmitting as a power source and the heater then runs itself by thermo-electric energy.
This NSN is a modified commercial item. Although this exact item is made specifically to fit the SHC assembly for military requirements, all the components of the battery pack are purchased through the commercial marketplace. The battery pack system is made from the following components: batteries, fuses, a heat strip, a sensor, and a nine (9) pin connector connecting to the Space Heater Convective (SHC). After being commercially purchased, the components are then modified at a third-party location for HDT to create a battery pack system that fits their SHC.
The batteries in the battery pack are commercially available, as HDT does not manufacture batteries. HDT has the wire connection of the batteries modified by their supplier. Twelve modified batteries are then potted in a case with two banks (six (6) batteries per row). The potting material stabilizes the batteries in the case. The case fits in the compartment in the SHC heater. For visualization purposes, the batteries are similar to a D sized battery but are a little bigger and have both DC terminals on top.
The heat strip and sensor are also purchased through the commercial marketplace. The sensor detects the temperature of the batteries in the battery pack. The batteries are electro chemical.
When batteries get cold, the chemical reactions slow down. The batteries must be warmed first to take a charge. The SHC must operate in extreme cold climates (-25 degrees and lower). Once the temperature drops below a set point, the sensor alerts the SHC, which sends power to the battery pack heat strip. The heat strip then warms the batteries. The battery system contains a sensor that tells the battery to turn on and off. The sensor also tells the SHC when to turn off, so the batteries do not overheat.
Both the heat strip and sensor need to be modified to fit the battery pack system. They are modified by attaching wires that fit into the nine (9) pin connector, which is also a commercially available component of the battery pack system. There are also two fuses in the battery pack system that are commercially available.
The vendor compared this item to a car battery. The car battery is specific to the type of car;
however, the form, fit and function is basically the same across all car batteries. Like a car battery, this subject item generates power to start the heater, then stops transmitting energy and re-charges while the heater runs itself. This item is the only battery pack system that will fit the HDT Space Heater Convective. Even though all the components of the battery pack system are bought commercially, they are then modified to fit into the battery pack case that fits into HDT’s heater. According to HDT, all modifications made to the commercial components are minor in nature.
6. The proposed acquisition will be synopsized in Contract Opportunities. In addition, this J&A will be posted with the solicitation in accordance with FAR 6.305(c).
7. As the contracting officer, I hereby determine the anticipated cost to the Government will be fair and reasonable based on price analysis techniques in accordance with FAR 15.404-1(b)(2), specifically comparison to historical prices paid for the same item and a published catalog price.
8. Market research was conducted in October 2020 through a Market Research Survey provided to Windward Enterprises, LLC as they are the only known authorized dealer for this NSN. A Sources Sought notice was posted to Contract Opportunities on September 23, 2020 for 30 days with only one response from Windward.
9. There are no other facts supporting the use of this authority.
10. Windward Enterprises, LLC is the only source expressing an interest in this acquisition.
11. Procurement Notes M06, Evaluation of Offers for Part Numbered Items and L04, Offers for Part Numbered Items, encouraging the submission of offers for alternate products will be included in the solicitation. Any alternate offers received will be forwarded to the Product Specialist for evaluation and approval.
12. As the contracting officer, I hereby certify that this Justification is accurate and complete to the best of my knowledge and belief.
