Justification For Other Than Full and Open Competition

1. Contracting Activity

Department of Commerce Enterprise Services 1401 Constitution Ave. NW Washington, DC 20230

2. Organization/Line Office Requiring Activity

Department of Commerce Bureau of Economic Analysis 1401 Constitution Ave. NW Washington, DC 20230

3. Nature and/or Description of Action

This Justification For Other Than Full and Open Competition is for the award of a follow-on contract to an authorized supplier of motor vehicle registrations, leasing, and vehicles-in-operation data from all 50 states (including the District of Columbia). Approval is requested to award to the only responsible source, without full and open competition.

4. Description of the Supplies or Services Required to Meet the Agency’s Needs

The objective of this procurement is to procure motor vehicle registrations, leasing, and vehicles-in-operation data from all 50 states (including the District of Columbia) for a 12-month period with an approximated value of $716,000. This procurement will provide motor vehicle registrations, leasing, and vehicles-in-operation data used in the estimation of U.S. Gross Domestic Product (GPD) for the Department of Commerce (DOC), Bureau of Economic Analysis (BEA).

The goal of the BEA is to promote a better understanding of the U.S. economy by providing the most timely, relevant, and accurate economic accounts data in an objective and cost-effective manner. In support of this goal, BEA continually seeks to improve the timeliness, accuracy and comprehensiveness of its economic accounts data; in part by upgrading data architectures and standard platforms on an ongoing, incremental basis. The IHSM Polk (R.L. Polk & Co.) has been selected as BEA’s data structure standard for time series data. The R.L. Polk & Co. motor vehicle registration data allows users to track personal consumption expenditures (PCE) of auto and truck registration, which is an important and rapidly changing sector of consumption. Since BEA publishes the GPD which is time series data based on the auto and truck registration source data, continuity is critical and R.L. Polk & Co. data will be used to build/customize BEA’s specific motor vehicle registration database.

5. Identification of the Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 3304(a)(1); Only one responsible source and no other supplies or services will satisfy agency requirements.

6. Demonstration that the Proposed Contractor’s Unique Qualifications or the Nature of the Acquisition Requires Use of the Authority Cited

R.L. Polk & Co. is the only manufacturer of the proprietary motor vehicle registrations, leasing, and vehicles-in-operation data from all 50 states (including the District of Columbia) and this is a follow-on contract.

7. Description of Efforts Made to Ensure That Offers are Solicited From As Many Potential Sources As Is Practicable, Including Whether a Notice Was or Will Be Publicized As Required by Subpart 5.2

The Contract Specialist posted the intent to sole source notice along with a summary of the Statement of Work on FedBizOpps for 15 days. This posting allowed other interested and potentially capable vendors to submit a proposal if they felt like they could perform this work.

Other proposals were not received, in result of this posting.

8. Determination By the Contracting Officer That the Anticipated Cost to the Government Will Be Fair and Reasonable

The Contracting Officer will evaluate the price in accordance with the proposal analysis techniques for commercial items at 15.404-1 to ensure that the price is fair and reasonable. The Contracting Officer will evaluate historical prices paid for the same/similar items; request the advice and assistance of subject matter experts in the technical field; and comparison of the proposed price with the Independent Government Cost Estimate. The complexity and circumstances of each acquisition will determine the level of detail of the required analysis.

9. Description of the Market Research Conducted (see Part 10) and the Results or a Statement of the Reason Market Research Was Not Conducted

The Contract Specialist ensured that no other database is compatible with R.L. Polk & Co. auto and truck registration database. The Contract Specialist also searched GSA, online resources, FedLink, and NASA Sewp but could not find any potential sources that provided the same product/service. As information was gathered and conclusions were reached, it was found that there is only one authorized seller of R.L. Polk & Co.’s motor vehicle registrations, leasing, and vehicles-in-operation data from all 50 states (including the District of Columbia), which is a large business.

10. Any Other Facts Supporting the Use of Other Than Full and Open Competition
