ANNOUNCEMENT OVERVIEW
BROAD AGENCY ANNOUNCEMENT TITLE:
High Energy Laser Research & Development for HEL-JTO
BROAD AGENCY ANNOUNCEMENT NUMBER: BAA 09-RD-03
BRIEF PROGRAM SUMMARY:
This is a Broad Agency Announcement (BAA) describing the research areas of interest for the High Energy Laser Research & Development for HEL-JTO program. Several Indefinite Delivery/Indefinite Quantity (ID/IQ) contract awards (30-35) are anticipated with a period of performance of not to exceed 48 months. Initial task order awards will be for not more than a 12 month technical period of performance and shall not exceed the cost values stated below for the topic areas of interest.

WHITE PAPER DUE DATE AND TIME: White Papers for all areas will be due by 12:00 p.m. (Noon), Mountain Daylight Time (MDT) July 29, 2009. Late white paper submissions will not be accepted after this due date.
PROPOSAL DUE DATE AND TIME: Full proposals for all areas shall be due 12:00 p.m. (Noon) MDT, on the specified proposal submission date set forth in the Request for Full Proposal. Proposals received after this due date and time shall be governed by the provisions of FAR 52.215-1(c) (3).
ANTICIPATED FUNDING: The total anticipated funding by the HEL-JTO for the program (not per contract or award) is $32M spread over FY10: $12M; FY11: $12M; FY12: $8M. Additional funding estimated at of $16M may become available from other sources spread over FY10, FY11 and FY12. This funding profile is an estimate only and will not be a contractual obligation for funding. All funding is subject to change due to government discretion and availability. All potential offerors should be aware that due to unanticipated budget fluctuations, funding in any or all areas may change with little or no notice.
GENERAL INFORMATION: The applicable NAICS code for this announcement is 541712 with a size standard of 500 employees. This acquisition is unrestricted. This BAA is issued under the provisions of Federal Acquisition Regulation paragraph 6.102(d)(2) that provides for the competitive selection of research proposals. Proposals submitted in response to this BAA that are selected for award are considered to be the result of full and open competition and in full compliance with the provisions of PL 98-369, the Competition In Contracting Act of 1984. There will be no other announcement issued for this requirement. Offerors MUST monitor FedBizOps/EPS http://www.fbo.gov in the event this announcement is amended.
TYPE OF CONTRACTS/INSTRUMENTS: The HEL-JTO reserves the right to award the instrument best suited to the nature of research proposed. Accordingly, the Government may award any appropriate contract type under the Federal Acquisition Regulation. It is anticipated that awards under this BAA will generally be Indefinite Delivery/Indefinite Quantity (ID/IQ) contracts with Cost Plus Fixed Fee (CPFF), completion form task orders, that require successful offerors to have an accounting system considered adequate for tracking costs applicable to the contract.
ANTICIPATED NUMBER OF AWARDS: The HEL JTO anticipates making several (30-35) awards/contracts depending upon the number of white papers, subsequent full proposals selected and availability of funds. The total number of awards under this solicitation is unknown at this time. The estimated cumulative cost/maximum ordering amount for all contracts awarded shall not exceed $48M. Individual contracts will not exceed $5M (the aggregate amount of all task orders that may be awarded under a basic contract).

HIGH ENERGY LASER – JOINT TECHNOLOGY OFFICE (HEL-JTO)
FULL TEXT ANNOUNCEMENT
1. REQUIREMENT DESCRIPTION
A. The High Energy Laser Joint -Technology Office (HEL-JTO), Office of the Deputy Under Secretary of Defense for Science and Technology (DUSD(S&T)), Albuquerque, New Mexico, is soliciting proposals for science and technology projects required to support directed energy (DE) weapon systems. The DUSD(S&T) HEL-JTO program develops and executes a DoD-wide, coordinated management and investment strategy to take advantage of opportunities presented by advances in HEL (high energy laser) technologies. The HEL-JTO vision is that HELs will be a viable weapons alternative in modern warfare. The HEL-JTO mission is to lead DoD’s integrated development of HEL weapon technology. The objective is to make HELs lightweight, affordable, supportable, and effective on the modern battlefield. The program promotes projects, research, scientific studies, or other initiatives providing farsighted, high payoff research leading to advances in HEL science and technology.
B. This is a Broad Agency Announcement (BAA) describing the research areas of interest for the High Energy Research & Development for HEL-JTO program. The initial contract awards, up to 30-35, are anticipated with a technical period of performance of 12 months per task order.
C. TECHNICAL TOPIC AREAS. Technical Topic Areas of interest are listed below. Full descriptions of each area are set forth in Attachment A.

The following data deliverables are representative of the types of data that may be required: (a) Technical and Management Work Plan (Program Plan) (A001) with updates as needed; (b) Presentation Materials (A002); (c) Status Reports (A003); (d) Final Report (A004 or A007), draft and final ); (e); (e) Computer Software Product (A005); (f) Unique Identification Designator (UID) (A006). (g) Software Requirements Specifications; (h) Software Development Plan. Data deliverables are subject to negotiation. See Attachment H.

4. COMMUNICATIONS
A. Prospective offerors are reminded to contact the technical point of contact to verify interest in the effort to be proposed PRIOR to committing any resources to the preparation of any white papers/proposals in response to this announcement. Foreign owned firms are advised to contact the Contracting Officer or Technical Point of Contact to determine whether there are restrictions on receiving an award.
B. During White Paper evaluation, offerors may be contacted by the HEL-JTO organization for clarification(s) of the white paper as submitted. There will be no communication with offerors as to the status of the evaluation. Notification of selection for Full Proposal will be from the Contracting Office. Dialogue between prospective offerors and Government representatives is encouraged until submission of full proposals. Dialogue between the time of request for full proposal and submission shall be THROUGH the Contracting Office. Discussions with any of the points of contact shall not constitute a commitment by the Government to subsequently fund or award any proposed effort. Only Contracting Officers are legally authorized to commit the Government.
C. White papers are due by 12:00 p.m., Mountain Daylight Time (MDT), July 29, 2009. White papers received after this date and time will not be accepted.
D. Full proposals are due by 12:00 p.m. (Noon) MDT, on the specified proposal submission date set forth in the Request for Full Proposal. Proposals received after the due date and time specified shall be governed by the provisions of FAR 52.215-1(c) (3).
E. White papers and subsequent full proposals for FAR type contracts shall be submitted to: Contracting Officer, HEL-JTO, 901 University Blvd SE, Suite 100, Albuquerque, NM 87106. White papers or full proposals sent to any other address are ineligible for award. White papers or full proposals for FAR contracts sent via facsimile or other electronic means will not be accepted.
F. There will be no other announcement issued for this requirement. Offerors MUST monitor FedBizOps/EPS http://www.fbo.gov in the event this announcement is amended. Offerors must monitor these systems to ensure they receive the maximum proposal preparation time for subsequent amendments as this is the official notification vehicle to request proposals.
G. INDUSTRY BRIEFING – As published in the Presolicitation Notice on the Federal Business Opportunity website on May 27, 2009, an Industry Briefing is scheduled for Monday, June 29, 2009, for the High Energy Laser Joint Technology Office (HEL-JTO) Broad Agency Announcement (BAA) 09-RD-03. This will be an informational meeting to relay the technical topic areas as well as the proposal and contracting processes. Attendance at this briefing is not required to participate in the BAA. The meeting will be held in Newton, MA, in conjunction with the Directed Energy Professional Society’s (DEPS) Solid State and Diode Laser Technology Review (SSDLTR).

5. GENERAL INFORMATION
Potential offerors are advised of the following:

C. Organizational Conflict of Interest may apply to this action but cannot be determined prior to issuance of this announcement. This issue and the need for applicable clauses will be resolved prior to the award of any instrument resulting from an offeror’s proposal.
D. An “Administrative Access to Proprietary Information” consent provision is applicable to this announcement with anticipation of incorporation of the provision by reference into any resulting award instrument. The provision is included as Attachment F to the solicitation. This requirement is applicable only to white papers selected for full proposal. It must be signed and submitted with the offeror’s full proposal or if an offeror objects, rationale must be submitted as indicated on the consent form.
E. Department of Energy (DOE) FFRDCs may submit white papers in response to this solicitation/announcement. Department of Defense (DOD) Federally Funded Research and Development Centers (FFRDCs) (C31 Lab, Lincoln Laboratory, or Software Engineering Institute) may not submit proposals in response to this announcement. Contractors that propose using FFRDCs not discussed herein shall provide rationale in their proposal that the research is within the purpose, mission, general scope of effort or special competency of the FFRDC and that research to be performed would not place the FFRDC in direct competition with the private sector. The Government does not intend that FFRDCs use privileged information or access to facilities to compete with the private sector. If a contractor proposes using a FFRDC as a subcontractor, it must provide rationale in its proposal that supports the unique capability of the FFRDC. Also, the contractor’s proposal must demonstrate that the FFRDC can accept work from other than the sponsor.
F. Research areas may involve technology that is subject to U.S. Export Control Laws. It is anticipated that awards will be unclassified with limited access. Therefore, only offerors who are certified by the Defense Logistics Information Service (DLIS) may submit proposals. G. All offerors are required to accept Disclosure of Information requirements per DFARS 252.204-7000. No exceptions will be made. Award will not be made to any offeror who does not accept this requirement. A statement accepting this requirement shall be provided at the time of white paper submittal.
6. AWARD INFORMATION
A. ANTICIPATED NUMBER OF AWARDS: The HEL-JTO anticipates making several awards (in the range of 30-35) pursuant to this BAA depending upon the number of white papers and subsequent full proposals selected and availability of funds. The total number of awards under this BAA is unknown at this time. The estimated cumulative cost/maximum ordering amount for all contracts awarded shall not exceed $48M. Individual contracts will not exceed $5M (the aggregate amount of all task orders that may be awarded under a basic contract).
C. Proposals are intended to be evaluated, and award made without discussions, unless discussions are determined to be necessary. However, the Government may obtain clarifications to determine proposal acceptability. Discussions may be held with prospective awardees prior to award if needed. In the event the Government is unable to conclude negotiations with the apparent successful offeror(s), it reserves the right to conduct negotiations with another acceptable offeror.
7. WHITE PAPER PROCESS
A. All White papers are due July 29, 2009, by 12:00 p.m. (Noon) Mountain Daylight Time (MDT).
B. Late white papers submissions will not be accepted.
C. Classified white papers will not be accepted.
D. Detailed preparation and submissions are set forth in Attachment B.
White Paper Submittal Address: White papers shall be submitted to Contracting Officer, HEL-JTO, 901 University Blvd SE, Suite 100, Albuquerque, NM 87106.
E. (1) Evaluation of white papers will be accomplished through a technical peer review of each paper using the criteria below, in descending order of importance. No further evaluation criteria will be used in assessing the papers. Organization and clarity of information are critical to all of the evaluation criteria.
(a) Consistency with HEL-JTO vision and mission and its significance to DoD HEL S&T objectives.
(b) Overall scientific and technical merits of the proposed effort, comprised of: (1) soundness of approach; (2) technical innovativeness of the idea(s), approach(es), or procedure(s) proposed; (3) offeror’s capabilities including experience, facilities, competence/availability of personnel; and (4) technical risk
(c) Affordability
(2) All offerors will be notified, in writing, of the results. The Contracting Office will attempt to make notification within 45 days from receipt of white papers.
(3) Only those offerors whose white papers meet the criteria will be issued a Request for Full Proposal to include a 40-minute PowerPoint briefing. However, any offeror who submitted a white paper may elect to submit a full proposal. Such proposals will be evaluated in accordance with the Proposal Evaluation Criteria set forth in paragraph 10 below. Notify the Contracting Office immediately if a proposal will be submitted for a white paper not initially selected.
(4) To be considered for award, a white paper must be submitted.
8. FULL PROPOSAL
A. Full proposals shall be due at 12:00 p.m. (Noon) MDT, 30 days from the request date or other date as specified in the request. Proposals shall be submitted to Contracting Officer, HEL-JTO, 901 University Blvd SE, Suite 100, Albuquerque, NM 87106.
B. Full proposals (to include an Oral Presentation) shall be prepared in accordance with the instructions set forth in Attachments C, D, and E.
C. Proposals shall be valid for a period of not less than 120 days after the due date.
9. PROPOSAL PREPARATION
A. GENERAL INSTRUCTIONS:
1. This BAA is an expression of interest only and does not commit the Government to pay for proposal preparation cost. The cost of preparing white papers/proposals in response to this BAA is not considered an allowable direct charge to any resulting contract or to any other contract. However, it may be an allowable indirect expense as specified in FAR 31.205-18.
2. Offerors must identify proposal information considered proprietary by marking their proposals with the restrictive language contained in FAR 52.215-1(e), Instructions to Offerors—Competitive Acquisition. See Attachment C, paragraph 6.
3. DoD policy, per DFARS 227.7103-1, is to acquire only the technical data and the rights in that data, necessary to satisfy government needs. The Government anticipates receiving, as a minimum, “Government Purpose Rights” to technical data developed under contracts awarded based on proposals received in response to this announcement. Data rights offered other than “Unlimited Rights,” as defined in DFARS 227.7103-5, should be identified in DFARS clause 252.227-7017, Identification and Assertion of Use, Release, or Disclosure Restrictions, and addressed in the business section of the cost proposal.
5. White papers/proposals may be ineligible for award if all requirements of this announcement are not met by the white paper/proposal due date and time.
6. Prospective offerors are to submit annual representations and certifications via the Online Representations and Certifications Application (ORCA). Offerors can complete electronic annual representations and certifications at http://www.bpn.gov in conjunction with the required registration in the Central Contractor Registration (CCR) database. Offerors must complete other required representations and certifications at Attachment G. Offerors may be required to provide proposal specific representations and certifications identified and requested by the cognizant contracting officer.
7. Offerors are advised that data included in the technical, cost and business proposals submitted to the Government in response to this BAA will be released to non-Government advisors for review and analysis. The current non-Government advisor is Schafer Corporation, Chelmsford, MA. Any non-Government advisor will strictly serve in an advisory capacity only to the Government evaluators. All Non-Government advisors will have appropriate Organizational Conflict of Interest clauses in their contracts with HEL-JTO and have nondisclosure agreements on file with HEL-JTO. All offerors must clearly indicate in their proposals if they have any objections or concerns regarding the use of non-Government advisors. See Attachment I.
10. PROPOSAL REVIEW AND EVALUATION PROCEDURES
A. GENERAL.
The Government reserves the right to select for award to responsible offerors/ contractors any, all, part, or none of the proposals received in response to this announcement, subject to the availability of funds. The technical, cost and business proposals will be evaluated at the same time. White papers/proposals may be ineligible for award if all requirements of this announcement are not met by the proposal due date and time. At a minimum, incomplete proposals may be given lower priority and, although technically acceptable, not awarded due to funding limitations. No further evaluation criteria will be used.
B. EVALUATION CRITERIA.
The selection of one or more sources for award will be based on an evaluation of each offeror’s proposal to determine the overall merit of the proposal in response to this announcement. Proposals will be evaluated in accordance with FAR 35.016. The proposals will be evaluated utilizing a peer or scientific review process and shall be evaluated based on the following criteria that are listed in descending order of importance:
(a) Consistency with HEL-JTO vision and mission and its significance to DoD HEL S&T objectives.
(b) Overall scientific and technical merits of the proposed effort, comprised of: (1) soundness of approach; (2) technical innovativeness of the idea(s), approach(es), or procedure(s) proposed; (3) offeror’s capabilities including experience, facilities, competence/availability of personnel; and (4) technical risk
(c) Affordability
Price will be a substantial consideration in selecting proposals for awards, but will be secondary to technical considerations. Cost realism and reasonableness shall also be considered to the extent appropriate. Price will be evaluated and may be negotiated if necessary on proposals selected for award.
C. REVIEW AND SELECTION PROCESS
The technical, cost and business proposals will be evaluated at the same time and categorized as follows:
1. CATEGORY I: Proposal is well conceived, scientifically and technically sound, pertinent to the program goals and objectives, and offered by a responsible contractor with the competent scientific and technical staff and supporting resources needed to ensure satisfactory program results. Proposals in Category I are recommended for acceptance (subject to availability of funds) and normally are displaced only by other Category I proposals.
2. CATEGORY II: Proposal is scientifically or technically sound, requiring further development and is recommended for acceptance, but at a lower priority than Category I.
3. CATEGORY III: Proposal is not technically sound or does not meet agency needs.
D. AWARD NOTICES
Offerors will be notified in writing whether or not their proposal is recommended for award. An award recommendation is not to be construed to mean the award of a contract is assured as availability of funds and successful negotiations are prerequisites to any award.
E. DEBRIEFINGS
When requested, a debriefing will be provided. The debriefing process will follow the time guidelines set out in 10 USC 2305(b)(5), but the debriefing content will vary to be consistent with the procedures set out in FAR 35.016 governing BAAs.
11. OTHER INFORMATION
A. SUBCONTRACTING PLANS: Small Business Subcontracting Plans are required under FAR 19.702 for efforts anticipated to exceed $550,000. Prospective offerors shall submit applicable subcontracting plans in accordance with the requirements set forth in FAR 19.704 and DFARS 219.704 along with the technical and cost proposals. Small business is exempt from this requirement. If a company has a master subcontracting plan, as described in FAR 19.701 or a comprehensive subcontracting plan, as described in DFARS 219.702, a copy of the plan shall be submitted with the proposal. The subcontracting plan is a part of the business proposal and will not be included in the page count.
B. WIDE AREA WORK FLOW NOTICE: Any contract award resulting from this announcement will contain the clause at DFARS 252.232-7003, Electronic Submission of Payment Requests, which requires electronic submission of all payment requests. The clause cites three possible electronic formats through which to submit electronic payment requests. Effective 01 October 2006, the Department of Defense will adopt Wide Area Work Flow-Receipt and Acceptance (WAWF-RA), as the electronic format for submission of electronic payment requests. Any contract resulting from this announcement will establish a requirement to use WAWF-RA for payment requests and receipt/acceptance, and provide coding instructions applicable to this contract. Contractors are encouraged to take advantage of available training (both web-based and through your cognizant DCMA office), and to register in the WAWF-RA system. C. ITEM IDENTIFICATION AND VALUATION. Any contract award resulting from this announcement may contain the clause at DFARS 252.211-7003, Item Identification and Valuation, (Aug 2008) which requires unique item identification and valuation of any deliverable item for which the government’s unit acquisition cost is $5,000 or more; subassemblies, components, and parts embedded within an item valued at $5,000 or more; or items for which the government’s unit acquisition cost is less than $5,000 when determined necessary by the requiring activity for serially managed, mission essential, or controlled inventory. Also included are any DoD serially managed subassembly, component, or part embedded within a delivered item and the parent item that contains the embedded subassembly, component, or part. Per DFARS 211.274-3 policy for valuation, it is DoD policy that contractors shall be required to identify the government’s unit acquisition cost for all items delivered, even if none of the criteria for placing a unique item identification mark applies. Therefore, your proposal must clearly break out the unit acquisition cost for any deliverable items. Per DFARS 211.274-3 policy for valuation, “the government’s unit acquisition cost is the contractor’s estimated fully burdened unit cost at time of delivery to the government for cost type or undefinitized line, subline, or exhibit line items” (per DoD, “fully burdened unit costs” to the government would include all direct, indirect, G&A costs, and an appropriate portion of fee.).
