About this file
This sole source justification document proposes awarding a firm fixed price purchase order on a sole source basis to Chase Supply Inc. for various diving life support parts including CO2 canisters, filter elements, regulator assemblies, and other components. The total value of this procurement was not specified. The justification is that Chase Supply Inc., doing business as Chase Defense Partners, is the original equipment manufacturer and only approved source for these components, as deviation from specifications could endanger diver safety. The contracting office at the Naval Sea Systems Command, Naval Surface Warfare Center Panama City Division determined this sole source award represents the best value in terms of cost, schedule, and technical acceptability compared to pursuing alternative solutions from other vendors that could not meet requirements. Market research was not conducted as Chase Supply Inc. was identified as the only contractor able to fulfill requirements.

Subj: SOLE SOURCE JUSTIFICATION FOR JFD/CHASE DEFENSE PARTNERS FOR
DIVERS’ LIFE SUPPORT SYSTEMS.
1. Identification of the agency and the contracting activity, and specific identification of the document as a “Limited Source Justification.”
This is a sole source justification. Contracting activity is the Naval Sea Systems Command, Naval Surface Warfare Center, Panama City Division (NSWC PCD), 110 Vernon Avenue, Panama City, FL 32407-7001.
2. Nature and/or description of the action being approved.
This action will award a firm fixed price purchase order on a sole source basis to Chase Supply Inc, dba Chase Defense Partners (CAGE 1RZM1) to acquire various diving life support parts.
3. A description of the supplies or services required to meet the agency’s needs (including the estimated value).
This is a procurement for:

The Government's minimum needs have been verified by the certifying technical and requirements personnel. This memo does not authorize acquisition for other requirements. This acquisition will be conducted using simplified acquisition procedures with a total dollar value above micro-purchase levels.
4. Identification of the justification rationale and, if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.
10 U.S.C. 2304(c)(5), Authorized or Required by Statute, FAR 6.302-5(b)(5).
JFD/Chase Defense Partners is the only vendor to provide NSD with the required diver’s life support equipment to maintain multiple underwater breathing apparatuses (UBA) in an “as built, as certified” condition. Our UBAs were manufactured by JFD and repair parts are only available through Chase Defense Partners. Deviation from NAVSEA approved drawings for these UBAs is strictly prohibited and may cause serious injury or death to divers while at depth. Deviation to another UBA would cause undue expense to the USN.
As such, the Government does not expect significant savings through competition and does expects significant and unacceptable delays that will negatively impact this requirement.
Therefore, it is in the Government’s best interest to award on a sole source basis to Chase Defense/Chase Supply Inc.
5. A determination by the ordering activity contracting officer that the order represents the best value consistent with FAR 13.106-1(b).
The Contracting Officer has determined that the order represents the best value and results in the lowest overall cost alternative (considering price, special features, administrative costs, etc.) to meet the Government’s needs.
6. A description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.
For reasons specified in paragraph 4 above, Chase Defense Supply/Chase Defense/JFD is the only source that can meet the Government’s needs. This requirement will be synopsized in the government point of entry SAM.gov because it is estimated to be less than $25,000.00.
7. Any other facts supporting the justification.
In purchasing these items, NSD will be able to maintain UBAs in an “as built, as certified” condition IAW NAVSEA procedures and certifying authorities.
8. A statement of the actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
As stated in paragraph 4 above, Chase Supply, Inc, is the only source that can meet this requirement.
