LIMITED SOURCE JUSTIFICATION (FAR 8.4-GSA/FSS)
1. Contracting Activity:
Naval Air Systems Command (NAVAIR), Commander, Fleet Readiness Center (COMFRC), Patuxent River, MD
2. Nature and/or Description of Action being Approved:
This Limited Source Justification (LSJ) authorizes and approves the issuance of a delivery order on a sole source basis against the General Service Administration (GSA) e-buy schedule to provide continuing customer support, development and software licensing of the Joint Command
Maintenance Information System (JCMIS) software. The resultant order will be Firm Fixed Price delivery order.
3. Description of the Supplies or Services Required to Meet the Agency’s Needs
(including the estimated value):
The proposed acquisition is to provide continued JCMIS software licensing and customer support for the Navy and Marine Corps aviation community. JCMIS is essential to NAVAIR requirements to provide data reconstruction to fleet users. The Independent Government Estimate for this action is $2,375,947.08. 4. Identification of the Justification Rationale (see FAR 8.405-6(b)) and, if applicable, a Demonstration of the Proposed Contractor/s Unique Qualifications to Prove the
Required Supply or Services:
Under FAR 8.405-6(a)(1)(i)(B), Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized. JCMIS software is proprietary to Hexagon US Federal and there are no authorized resellers. Therefore, Hexagon US Federal is the only vendor from which this software can be procured. Hexagon US Federal is the Original Equipment Manufacturer (OEM) of the JCMIS software and the system already in use by the Navy and Marine Corps aviation community.
Hexagon US Federal is the only source able to provide the required proprietary software license support and upgrades.
JCMIS has been in use by NAVAIR for over 30 years as the single enterprise repository for component historical maintenance information for Navy and Marine Corps aircraft components.
JCMIS continues to be the Naval Aviation Maintenance Program (NAMP) directed program of record for aircraft component data reconstruction and data archiving. Hexagon US Federal has provided all support and technical expertise throughout this timeframe. JCMIS contains critical historical component information for all Navy and Marine Corps dynamic aviation components that are maintained and repaired by the fleet and other designated repair/rework facilities.
5. Determination by the Ordering Activity Contracting Officer that the Order
Represents the Best Value Consistent with FAR 8.404(d):
This order will be issued in accordance with FAR 8.4, Federal Supply Schedules. GSA has already determined the prices of supplies and fixed-price services, and rates for services offered at hourly rates, under schedule contracts to be fair and reasonable. The contracting office shall evaluate all responses received using the evaluation criteria provided to the scheduled contractors. Although, GSA has already negotiated fair and reasonable pricing, this determination does not relieve the ordering activity contracting officer from the responsibility of making a determination of fair and reasonable pricing for individual orders, BPAs, and orders under BPAs, using the proposal analysis techniques at 15.404-1. Also, additional discounts will be sought.
6. A Description or the Market Research Conducted Among Schedule Holders and the
Results or a Statement of the Reason Market Research Was Not Conducted:
Market research confirmed that Hexagon US Federal is the OEM and other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs without requiring substantial additional costs, development/transition time and significant changes to existing fleet policies. In addition, data extraction, transformation, and load source code for other supporting Naval data systems would need to be rewritten to work with another database vendor's software language. The additional costs and time requirements for such a migration are seen as unnecessary and prohibitive. The requiring activity has confirmed that JCMIS maintenance support can only be purchased and maintained through
Hexagon US Federal. A notice will be posted via GSA e-Buy website in accordance with procedures outlined in FAR 8.404.
7. Any Other Facts Supporting the Justification:
JCMIS is designated within the COMNAVAIRFORINST 4790.2 (Series) instruction (the NAMP) as the single authorized enterprise data repository for Navy and Marine Corps aviation component maintenance data and the sole program for enterprise data reconstruction efforts. The JCMIS database is the sole enterprise source for over 30+ years of critical historical data for all Navy and
Marine Corps aviation components.
8. A Statement of the Actions, if any, the Agency May take to Remove or Overcome any Barriers that Preclude the agency from Meeting the requirements of FAR 8.405-1 ad
FAR 8.405-2 before any Subsequent Acquisition for the Supplies or Services is Made:
As described above, the Government analyzed whether alternate brand/sources could be used. However, the analysis established that no other products could meet and or be modified to meet the agency’s needs. Future requirements will be evaluated to determine whether an alternate brand/source can be used to increase competition and not limit procurement sources. As information technology continues to evolve, other brands may become available for future acquisitions. Therefore, evaluations and technical improvements may make other products suitable for future procurements.
