About this file

This justification document proposes awarding a sole source contract to the incumbent vendor for continued provision of comprehensive occupational medical examination services. The National Park Service requires these services to medically qualify applicants and employees for arduous duty positions like law enforcement, scuba diving, and structural firefighting. The incumbent, Comprehensive Health Services, currently provides these examinations under an expired task order and is uniquely qualified due to specialized physician expertise, compliant medical records systems, experience qualifying thousands of personnel, and the absence of any other known qualified vendors. The proposed one-year base contract from December 2020 through December 2021 would include an option to extend an additional year, conditioned on the incumbent receiving system authorization. The justification was published to allow public comment on the sole source award as required by regulation.

Over $150,000 (FAR 6.302-1)

PR No. 40511964

1. Identification of the agency and the contracting activity:

Requesting Office: National Park Service (NPS), Law Enforcement, Security, and Emergency Services Division (LESES), Washington, D.C.

Contracting Activity: National Park Service, Washington Contracting Office (WCO), Lakewood Colorado.

LESES is seeking the procurement of a comprehensive occupational medical examination program for all NPS applicants and current employees in arduous duty positions. Required by the

(MSP), law enforcement, scuba divers, and structural firefighters are required to receive medical examinations and screenings

These services are currently being provided under TO# 140P2120F0070 by Comprehensive Health Services (herein known as Comprehensive); however, the TO expires 31 December 2020, and no further TOs can be awarded. A break or delay in these services will halt cause a compromise to public safety.

Therefore, WCO is proposing a contract to Comprehensive on an Other than Full and Open Competition basis.

3. A description of the supplies or services required to meet the a needs, including the estimated value:

The proposed acquisition is for a Firm Fixed-Price contract for one 12-month base period and one 12-month option period, to allow for the continuation of medical examination and screenings for arduous duty categories (law enforcement, scuba divers and structural firefighters). The contractor is responsible for providing a comprehensive medical examination program for applicants and current employees. The general medical and occupational history review and examinations provide the basis for the medical determinations/status of applicants and employees to perform the essential functions of arduous duty positions and disclose any health issues that may prevent the effective performance of official duties.

This proposed contract will have an effective period of 14 December 2020, through 13 December 2021 (base period), and 14 December 2021, through 13 December 2022 (Option period). 5. A demonstration that the proposed c unique qualifications or the nature of the acquisition requires use of the authority cited:

BLM awarded a Department-wide IDIQ to Comprehensive for the same medical examination services in March 2020; however, the contract is currently undergoing an Information Systems Assessment and Authorization review by DOI Information Systems Privacy and Security Personnel. This review will result in an Authority to Operate (ATO) via FedRamp.

-impact system with the highest levels of privacy and security safeguards; therefore, their system must be rigorously tested prior to becoming operational. Due to this as well as the unexpected impacts of COVID-19, the review and resulting ATO has been pushed to the right repetitively over the last several months. ATO is currently not projected for completion until Spring 2021 (tentatively).

Comprehensive has been the awardee for these services under the MSP for the last six medical examinations and screenings. The data captured from these medical examinations and screenings, completed by the contractor, is uploaded to the database and this information is used to determine eligibility.

It is in the best interest of the Government to award the requisite medical screening and exam services required to Comprehensive as they are uniquely qualified to provide these services to the Government based upon the following:

- Comprehensive has occupational specialty physicians specifically trained allowing them to render appropriate, independent qualification determinations expeditiously. The physicians have spent time observing essential functions of these arduous duty categories and made thousands of medical qualification determinations.

This is specialized experience crucial to the

Comprehensive utilizes their system to ensure employees remain qualified by proactively contacting, scheduling, and qualifying those in need of arduous duty categories are medically qualified in accordance with Reference Manual

(RM)-57A.

- There are no known companies other than Comprehensive that can provide these services, as demonstrated by the market research performed and a review of acquisition history. The acquisition history for NPS IDIQ# P15PC00011 and BLM IDIQ# L14PC00068 demonstrated that Comprehensive is the only entity that can provide all services for this requirement at the needed geographic reach.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR Subpart

5.2 and, if not, which exception under FAR 5.202 applies:

This requirement will be synopsized via Contract Opportunities as required by FAR subpart 5.2.

In addition, this justification will be made publicly available after contract award in accordance with FAR 6.305(a).
