About this file

This document is a Data Use Agreement (DUA) template for a Maryland state government agency, designed to establish guidelines for handling Personally Identifiable Information (PII) between the state and a third-party processor. The agreement sets forth comprehensive protocols for data protection, including definitions of PII, permitted uses and disclosures, processor duties, security breach detection and notification procedures, and requirements for data destruction. The document is structured with multiple appendices to track PII types, personnel with data access, and a certification process for data destruction.

The agreement emphasizes strict confidentiality measures, requiring the processor to implement reasonable security procedures, limit PII access, encrypt communications, train personnel on privacy practices, and promptly report any unauthorized data use or breaches. Key provisions include notification requirements within one business day of a security breach, mandatory reporting to the Maryland Office of the Attorney General, and obligations to protect individual data subjects' information. The template is designed to be flexible, allowing for modifications as PII types or processing needs change, and includes provisions for termination and ongoing data protection responsibilities even after contract completion.
