About this file
This document is a Build America, Buy America Act (BABAA) Compliance Statement issued by the Connecticut Department of Energy and Environmental Protection as part of the Standard RFP for PSA Procurements. The statement serves as a certification requirement for contractors and subcontractors involved in federally-funded infrastructure projects administered by DEEP. The compliance statement requires contractors to certify that all iron, steel, manufactured products, and construction materials used in projects comply with BABAA requirements under Section 70914 of Public Law 117-58. Contractors must attest that all iron and steel are produced in the United States through all manufacturing processes from initial melting through coating application, and that all manufactured products contain at least 55% domestic component costs unless alternative standards apply. Additionally, all construction materials must be manufactured entirely in the United States.
The certification must be signed by an authorized official of the contractor or subcontractor and includes language affirming compliance with 31 U.S.C. Chapter 38 regarding Administrative Remedies for False Claims and Statements. The signatory acknowledges that false statements in the certification may result in legal consequences. This compliance statement is particularly relevant to the 2027 Federal Clean Vessel Act Grants program administered by DEEP's Boating Division, which provides federally-funded grants covering up to 75% of approved projects for boat sewage disposal facilities in Connecticut. All bidders and contractors on federally-funded DEEP projects must complete and submit this BABAA compliance certification as part of their proposal submissions.
