About this file

This document is Attachment (c) 52.212-2 to a Request for Quotes (RFQ) for an Electronic Patient Care Reporting Web-Based System for the Department of the Navy Naval Supply Systems Command.

The solicitation is a Total Small Business Set-Aside with a NAICS code of 518210 and a $40,000,000 size standard. It requires a firm fixed-price contract for a 12-month base period with four 12-month option periods to provide the web-based system and related services. Offers will be evaluated based on price, technical factors, and past performance, with price and non-price factors approximately equal. The Government will award the contract to the responsible offeror whose conforming offer is most advantageous. Offerors without a past performance record may not be evaluated favorably or unfavorably on that factor. The Government may deem an offer unacceptable if option prices are significantly unbalanced.

Title: JRM F&ES Electronic Patient Care Reporting Web-Based System

52.212-2 Evaluation—Commercial Products and Commercial Services (Nov 2021)

(a) Quotations will be evaluated in accordance with FAR 13.106-2 Evaluation of quotations or offers; the tradeoff process as described in FAR 15.101-1 will be utilized.

The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1 – Price Factor 2 – Technical Factor 3 – Past Performance

All evaluation factors other than price are approximately equal. All evaluation factors other than price, when combined, are approximately equal to price.

In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available, the quoter may not be evaluated favorably or unfavorably on past performance.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
