About this file
This document is a Scope of Work attachment for a contract between the California Department of Consumer Affairs, Bureau of Automotive Repair (BAR), and Airgas USA, LLC. The contract covers gas blending and cylinder rental services for BAR's facilities in Rancho Cordova and the Los Angeles metropolitan area, specifically supporting the California Emission I/M (Inspection and Maintenance) Program.
The contract requires Airgas to provide specialized gas blends with precise purity specifications for propane, carbon monoxide, carbon dioxide, nitric oxide, and nitrogen, with specific isotope content requirements. Airgas will deliver and pick up gas cylinders free of transportation costs, provide certificates of analysis with each shipment, and adhere to strict labeling and quality standards. Pricing is all-inclusive, covering gas, shipping, handling, hazmat, and sales tax, with monthly invoicing. The contract allows BAR to conduct quarterly site inspections and requires Airgas to replace or reverse charges for any gas cylinders not meeting specifications within seven business days. The document notes that the cylinder quantities are estimates, and BAR does not guarantee minimum service levels.

Footnotes:
1. The 13C isotope content of carbonaceous materials (hydrocarbons, CO, CO2) varies widely in nature due to the mechanisms by which they are formed. In addition, CO and CO2 materials are commercially available in which the 13C isotope has been intentionally stripped. IT IS ESSENTIAL that gas blends meeting this specification use carbonaceous raw materials that conform to the 13C isotope content specified in the table above.
1. Because of interference from high concentrations of CO2, the NDIR analyzers in I/M programs used to measure carbon monoxide make use of infrared absorption features that are sensitive to 13CO enhancement or depletion. Use of CO that has a 13C isotope signature in the range given in the table assures that carbon monoxide analysis errors due to isotope enhancement or depletion will not exceed ± 0.5% (one-half of the allowed accuracy budget of 1%).
1. Because of the intense signal from high concentrations of CO2, the NDIR analyzers in I/M programs used to measure carbon dioxide make use of infrared absorption features that are highly sensitive to 13CO2 enhancement or depletion. Use of CO2 that has a 13C isotope signature in the range given in the table assures that carbon dioxide analysis errors due to isotope enhancement or depletion will not exceed ± 0.5% (one-half of the allowed accuracy budget of 1%).
1. "D13C” is the standard nomenclature for measurement of stable isotope ratios. The "D” value, which is usually negative, indicates the relative degree of 13C depletion compared to an international standard (VPDB). Recent experimentation has shown that the primary reference standards used by CA BAR to qualify audit gases contain CO and CO2 with 13C isotope ratios in the specified range.
1. The 13C isotope ratios specified for CO and CO2 in the table are typical of carbon sources from geological petroleum deposits. Gas manufacturers may submit samples of the CO and CO2 they intend to use as raw materials for audit gases to any number of outside labs who measure stable isotope ratios for a reasonable cost. Alternatively, gas manufacturers need only assure that the CO and CO2 raw materials they plan to use originate from a geological petroleum source.
10. Should the Contractor incorrectly label a gas cylinder, BAR shall contact the Contractor by email or phone, and the Contractor shall provide BAR with the correct label within seven (7) business days of notification.
11. A technical representative for the Contractor shall be available, at no expense to BAR, within twenty-four (24) hours, (not more than one (1) business day), of notification to address suspected gas quality problems. If the gas blend(s) are found to be inferior, the Contractor shall reverse the charges for the inferior gases and provide replacement gases to BAR within three (3) weeks of the initial notification.
12. The Contractor shall immediately notify BAR by email or US mail whenever the name, phone, or email address changes for the Contractor’s Project Coordinator (as listed above).
13. BAR will place an order by email specifying the item number, quantity, and shipping location.
14. The Contractor shall include a copy of the Contractor’s Certificate of Analysis with each gas cylinder shipped to BAR.
15. The Contractor shall include a detailed shipping manifest with each shipment of cylinders sent to BAR. The shipping manifest shall include the following:
A. A unique manifest number for each shipment;
B. A description of each item shipped;
C. The amount of each item shipped;
D. The Item # of each item shipped, which shall correspond to the Contract Line Item # given for each gas blend included in Attachment A, Contract Pricing; and E. The shipment date.
16. The Contractor shall ship the requested items according to the timelines specified below:
A. Disposable calibration gases: within fifteen (15) business days after receipt or order.
B. NOX gases: within thirty-five (35) business days after receipt of order.
C. All remaining gases: within thirty-five (35) business days after receipt of order.
17. The Contractor shall ship all gas cylinders with an expiration date no sooner than one (1) year from the shipment date.
18. The Contractor shall charge BAR for all gas blend and cylinder rental costs at the rates included in Attachment A, Contract Pricing.
19. The Contractor’s cost in Attachment A, Contract Pricing are considered all-inclusive rates. These rates shall include all costs associated with gas, shipping, handling, pick-up, delivery, hazmat, and sales tax. The Contractor shall not charge BAR for any costs outside of the all-inclusive costs listed in Attachment A, Contract Pricing with the exception of rental fees. Rental Fees shall be charged separately and in accordance with the pricing listed in Attachment A, Contract Pricing.
20. The Contractor shall not charge BAR rental fees for any gases that do not meet BAR’s specifications within seven (7) business days of delivery and shall pick-up the rejected cylinders at no additional charge.
21. The Contractor understands that the gas cylinder quantities referenced in Attachment A, Contract Pricing represent an estimate of BAR’s needs. BAR does not guarantee any minimum level of service to the Contractor. The Contractor shall only charge BAR for actual expenses incurred.
22. The Contractor shall invoice BAR monthly for gas cylinders and rental fees. The Contractor shall include the following information on every invoice sent to BAR:
A. A description of each invoiced item;
B. The amount of each invoiced item;
C. The Item # of each invoiced item, which shall correspond to the Contract Line Item # given for each gas blend included in Attachment A, Contract Pricing;
D. The shipment date of each invoiced item; and E. The unique shipping manifest number, which shall correspond to the shipping manifest for each item.
23. The Contractor shall pick-up used gas bottles supplied from that Contractor within seven (7) days of notification from BAR. BAR will contact the Contractor by phone with follow-up email to notify the Contractor that bottles need to be picked up.
24. The Contractor shall calculate rental fees for all cylinders, including any cylinders incorporated from a prior agreement, at the rate specified in this Attachment A, Contract Pricing.
