About this file

This is a Service Transition Protocol document issued by the Missouri Department of Social Services for Foster Care Case Management (State 0000000597SL), establishing procedures for transferring cases between Family Centered Case Management (FCCM) contractor providers and state agency Child and Family Services (CD Services). The protocol addresses three transfer scenarios: when a child has been reunified with their parent or guardian for ninety calendar days, when an active case transfers from a contractor to the state agency, or when a case transfers from the state agency to a contractor. The document specifies that services ordered by the court or included in case plans endorsed by Family Support Teams must continue uninterrupted during transfers. Key requirements include uploading all court orders to the state automated system, providing email notification when children are returned home, submitting transfer requests after the ninety-day reunification period, scheduling transfer staffings to document all services being provided, and completing required monthly visits and court reports within specified timeframes.

The protocol establishes distinct procedural requirements for each transfer direction. When contractors request to return cases to the state agency, the Office of Services must review the request and deny it if a scheduled court hearing is within thirty to sixty days or if the child is not stable in the home; conversely, the contractor may request release of jurisdiction if the child is stable. When cases transfer from the state agency to a contractor, a transfer meeting must be scheduled within three business days, during which the contractor documents all services and court-ordered requirements. The document requires that if a contractor cannot maintain the current treatment or service plan due to lack of appropriate contracts or service providers, the contractor must consult supervisory staff and potentially schedule a Family Support Team meeting to address concerns. Notably, the Department of Life Services cannot intervene for court-ordered services or those previously provided by the state agency. The transferring worker or supervisor must attend all court hearings, Family Support Team meetings, and other staffings within thirty calendar days of the case transfer and submit required court reports within prescribed timeframes.

STATE 0000000597SL

Attachment 9 Service Transition Protocol

Transitioning Services between FCCM providers and CD

Services should not be interrupted when case management is transferring from one case management entity to another. Case transfers can occur when:

· The child has been reunified with their parent or guardian for ninety (90) calendars days.

· An active case is transferred from a contractor to the state agency.

· An active case is transferred from the state agency to a contractor.

NOTE: When a child has been adopted or legal guardianship has been awarded, services which will be provided through subsidy will continue to be authorized through the current process.

The following procedures must be in place to ensure continuity of services which are ordered by the court or are part of the case plan endorsed by the FST when a case is transferred from a contractor to the state agency:

· The contractor must upload copies of all court orders to the state automated uploading system.

· The contractor must notify the state agency OS via email when a child is physically returned home.

· Once the child(ren) is home for ninety (90) days and the contracted provider wishes to return an active case to the state agency, the contractor will need to submit a request for transfer to the state agency OS. The OS will contact the contracted provider to discuss their request and rational for returning the case to the state agency. If there is a scheduled court hearing within 30 to 60 days, the request will be denied pending the outcome of the next court hearing. If the contractor feels the child(ren) is stable in the home a request for release of jurisdiction should be made. If the contractor feels the child is not stable in the home, the request for transfer back to the state agency will be denied.

· When contracted cases are approved to transfer back to the state agency, the case will be scheduled for a transfer staffing to discuss all services being provided to the family. The state agency should take note of the services provided and those which are court ordered.

The following procedures must be put in place to ensure continuity of services when a case is transferred from the state agency to a contractor:

· Once CD OS is notified that an identified case for transfer is ready to be transferred to the contractor, the transfer meeting is to be scheduled within three (3) business days between the contractor and the state agency

· During the transfer meeting, the contractor should take note of the services provided and those which are court ordered.

· If the service provider does not have a contract with the contractor or the contractor does not contract for the service provided by the state agency, the contractor’s family case manager will meet with their supervisor or designee to discuss the treatment/service plans.

If there is a concern with the ability of contractor to maintain the current treatment/service plan, the contractor should schedule a FST to discuss such. Note: DLS will not be able to intervene for those services which are court ordered or those which were provided by the state agency.

For all case transfers the transferring worker will complete the required monthly visit with the child in their placement for the month of case transfer. This visit will be documented in FACES prior to the transfer.

The transferring worker or supervisor is required to attend any court hearing, FST, or other staffing within 30 calendar days of the case transfer. The transferring worker or supervisor should prepare and submit the court report within the prescribed timeframes prior to the hearing.
