The Base Period of Performance is anticipated to run 7 months from 7/1/2021 through 1/31/2022 and includes 120 Consultation Hours at an estimated cost of . The first Option Period is to include 120 Consultation Hours and the renewal of the 10 licenses for a period of 12 months and a total estimated cost of . The second Option Period is to include 120 Consultation Hours and the renewal of the 10 licenses for a period of 12 months and a total estimated cost of . The total estimated cost for the Base and 2 Option Periods is through January 31, 2024. Funding will be sourced from Operations. The total estimated dollar value for the proposed firm fixed price (FFP) requirement is with a requested delivery within 30 days of award and maintenance with a 7-month base period of performance. This acquisition will be fully funded utilizing FY21 funds.

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN

FULL AND OPEN COMPETITION:

The statutory authority permitting other than full and open competition is Title 10, U.S.C.

2304(c)(1), as implemented by FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements.

The ProModel Licenses are proprietary to ProModel Corporation. The Consultation Hours will be conducted by experts from ProModel Corporation fluent in the ProModel software, and methodology who undergo continuous training in industry best practices.

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE

QUALIFICATION OR THE NATURE OF ACQUISITON REQUIRES USE OF CITED

AUTHORITY:

The Government will attempt to obtain offers from as many vendors as practicable. An Open Market RFQ will be posted to Beta.SAM.gov website and authorized resellers of ProModel software and support will be provided an opportunity to submit quotations for this requirement.

The proposal will be analyzed for price reasonableness in accordance with FAR 15.404-1. It is anticipated that the Government will use various price analysis techniques including, but not limited to: (1) comparison of proposed prices received in response to the solicitation; (2) comparison with competitive price lists; (3) comparison with Independent Government Cost Estimates; and (4) comparison of proposed prices obtained through market research for the same or similar items in order to obtain a fair and reasonable price.

6. DESCRIPTION OF THE MARKET RESEARCH CONDUCTED AMONG

SCHEDULE HOLDERS AND THE RESULTS OR A STATEMENT OF THE REASON

MARKET RESEARCH WAS NOT CONDUCTED:

In accordance with FAR 10.002(b)(2)(vii), the Program Office conducted market research through several sources of internet searches for modeling software that is commercially available and provides the same features as the ProModel software; however, market research determined no sources could provide the adequate support required and ProModel is the only software available that meets all the customer’s requirements. The customer will continue conducting market research annually to determine whether new products emerge that can better suit the government’s requirements.

Further market research was conducted to reveal the lack of availability of resellers via the GSA E-Buy portal because of the OEM’s expiration of their GSA contract. A solicitation will be posted in accordance with FAR 5.201(b) as an Open Market, Brand-name, Unrestricted RFQ to the SAM.gov website and multiple resellers (small & large) are expected to quote.

8. STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO

REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE ANY

SUBSEQUENT ACQUSITION FOR THE SUPPLIES OR SERVICES REQUIRED:

At this time, ProModel software & support are the only products that will support the DLA's requirements and meets the Government's needs. However, DLA has and continues to exercise competition as often as possible and is required to conduct ongoing reviews to keep abreast of new technology, both in industry and in the Government as a continuing effort within DLA.

DLA uses a variety of vendors, manufacturers, and contracts to fulfill its requirements and will continue its practice of surveying the market to ensure full and open competition. DLA is continually searching of technology and platforms capable of furthering the DLA mission. With that philosophy the Program will continue to review industry publications and network sources for innovative products / services that meet DLA requirements. If another potential source emerges, DLA will assess whether competition for future requirements is feasible.
