CERTIFICATION OF COMPLIANCE WITH NDAA 889 – PROHIBITED TELECOM
Per the FY19 National Defense Authorization Act (NDAA) Section 889, the Government has determined telecommunication equipment and services from the following companies and their subsidiaries and affiliates to be prohibited:
• Huawei Technologies Company
• ZTE Corporation
• Hytera Communications Corporation
• Hangzhou Hikvision Digital Technology Company
• Dahua Technology Company
Part A of Section 889 specifies that the Government may not obtain these prohibited telecom items.
Part B of Section 889 specifies that the Government may not contract with any entity who uses these prohibited telecom items “regardless of whether that use is in performance of a Federal contract.”
To ensure that your company is in compliance with this requirement, please complete the following:
FAR 52.204-24 Representation Regarding Certain Telecommunications and Video Surveillance Services or Equipment (Oct 2020)
(1) It will, will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation.
(2) It does, does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.
FAR 52.204-26 Covered Telecommunications Equipment or Services-Representation (Oct 2020)
(1) The Offeror represents that it does, does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument.
