FAR 52.212-1, Instructions to Offerors – Commercial Items, (Jun 2020)

In addition to 52.212-1, Instructions to Offerors – Commercial, the following instructions apply to this acquisition.

The Government intends to issue a Firm Fixed Price purchase order for this requirement.

Invoicing shall be in accordance with the Prompt Payment Act and payment shall be made via Electronic Funds Transfer (EFT).

TECHNICAL PROPOSAL

Offerors may provide up to 10, 8.5 by 11-inch pages (using no less than 10 font size) as their proposal to be evaluated by the Source Evaluation Panel. The technical submission will address the Purchase Description and be responsive to the attached evaluation factors. The 10-page technical submission limitation does not include and is in addition to the price proposal. Technical submission pages in excess of this page limitation will not be considered.

PRICE PROPOSAL

The price quote shall include: unit price, list price, shipping and handling costs, delivery days after contract award, delivery terms, prompt payment discount terms, F.O.B. Point (Destination or Origin), product or catalog number(s); product description; and any other information or factors that may be considered in the award decision.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Technical factors together shall be significantly more important than price. The following technical evaluation criteria will be used by the Government when reviewing the technical portion of the quotation. The criteria below are listed in descending order of relative importance.

Factor 1: Meets the Technical Specifications

The Contractor’s quote shall be in accordance with Attachment 1 - Purchase Description. This shall demonstrate the ability of the offeror to deliver two (2) Biotage Initiator+ Microwave

System with Robot Sixty Automated system or Equal. The proposed system must be compatible with the Biotage line of reaction vials currently used in the facility’s present instrumentation.

Factor 2: Approach to Delivery and Warranty

The Offer shall detail in its quote if it able to meet the delivery, installation and familiarization, along with warranty requirements.

Price Evaluation

NIH will consider and evaluate the following factors when determining an Offeror’s price quote:

• The CO will determine that the total price is reasonable.

• Any assumptions or clarifications to price provided by the Offeror.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the

Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
