Foreclosure Legal Services – Kentucky

QUOTE SCHEDULE

QUOTE SCHEDULE OF SERVICES

SERVICES REQUIRED: The contractor shall:

Provide legal services for foreclosures with or without deficiency judgments, judgments, bankruptcies, and/or actions to recover possession related to Section 502 direct (Single Family Housing) debts to the United States of America, acting through the United States Department of Agriculture, Rural Housing Service (USDA). This work is to be performed throughout the State of Kentucky and as described in Section C, Performance Work Statement of this solicitation and as ordered by specific BPA calls issued under this Blanket Purchase Agreement (BPA).

STANDARD FORECLOSURE ATTORNEY FEES

The following table reflects the customary legal services pertinent to mortgage defaults for legal work related to its foreclosures for the State of Kentucky. The fee applies for the life of the default and covers all services necessary to complete a routine foreclosure action in the jurisdiction. In the event that a default is cured, such as by a completed loan modification or reinstatement, and the loan subsequently becomes delinquent again, a new fee applies without the need for excess fee approval when the servicer must initiate new foreclosure proceedings. The amount claimed for attorney fees cannot exceed the fees charged for work actually performed.

The Schedule of Attorney Fees does not reflect additional expenses incurred due to foreclosure and/or mediation because of the wide differences in costs and lengths of time of foreclosure completion, depending on the jurisdictions in which the foreclosure actions are occurring. USDA, Rural Development will review, and if applicable, authorize fees in excess of the contractor's quoted Schedule of Attorney Fees, in unusually complex cases. Any additional excess fees/expenses to be incurred due to required legal actions are claimable with a documented cost breakdown and a written justification that must be provided to USDA, Rural Development for approval prior to incurring the additional fee/expense.

Vendors are encouraged to submit competitive industry pricing. The Government uses "allowable foreclosure attorney fees" published by Fannie Mae as an indicator of price reasonableness In addition, the Government uses foreclosure timeframes published by HUD as an indicator of “reasonable diligence."

The Government reserves the right to find a vendor unacceptable if their prices are found to be unreasonable.
