STATEMENT OF WORK
FOR
RESPONDER LODGING CAPSULES
1.0 BACKGROUND
The Department of Homeland Security (DHS) Federal Emergency Management Agency’s (FEMA) mission is helping people before, during, and after disasters. One of FEMAs’ responsibilities is to ensure the effectiveness of emergency response personnel in responding to emergencies and disasters. Types of disasters and emergencies that could happen in the Continental United States (CONUS), as well as outside the Continental United States (OCONUS) locations include, but are not limited to, hurricanes, floods, earthquakes, cyclones, tornadoes, blizzards, acts of terrorism, tsunamis, and avalanches.
2.0 PURPOSE
Provide turn-key Lodging Capsule units to house FEMA and FEMA-approved responders.
Lodging Capsules will be sleeping units containing beds, showers, restrooms and sink with support services including wash and fold laundry, janitorial, equipment, staff, onsite medical and morale welfare recreation and catering services.
3.0 SCOPE
3.1 Unit Configurations and Requirements
a. Contractor shall furnish 250 private cabin sleeping units containing beds, showers, toilets and sinks upon award to FEMA.
b. Each Lodging Capsule unit must contain private one-person rooms with locking exterior door, bed, storage for clothing, adequate lighting and a minimum of one (1) standard duplex power outlet in each sleeping area.
c. The Contractor shall have configuration flexibility as to the number of sites that can be supported. Configuration examples include, but are not limited, to one 250-person site or two 125-person sites. Maximum number is 2 sites operating simultaneously.
d. Units must be equipped with en suite shower, sink, and toilet accommodations.
e. Sinks with mirrors and one (1) duplex power outlet for hairdryers and shaving equipment shall be provided. The Contractor shall ensure showers comply at a minimum with OSHA 29 CFR and 1910 and 29 Code of Federal Regulations (CFR) 1926, as well as Uniform Federal Accessibility Standards (UFAS). Units shall have hot and cold water and shall be serviced with an American Society of Mechanical Engineers (ASME) rated propane or electric water heater and an anti-scald valve for user safety. Heated water shall be provided at a minimum of 120 degrees Fahrenheit. All showers and sink facilities shall be sanitized once weekly with a disinfecting solution.
f. New mattresses shall be used and must be Standard Twin 36” W x 75” L x 6”H, or larger, with inner-springs or coils. Foam mattresses may be substituted if approved in advance by the onsite Contracting Officer Representative (COR) and the Contracting Officer. Sheets and blankets shall be provided according to mattress size.
g. The Contractor shall meet American with Disabilities Act (ADA) requirements and ensure that
5 percent of the units at each site are ADA compliant.

h. Units shall have under the bed storage space, a closet and desk space. All living quarters shall be equipped with windows the total of which shall not be less than one-tenth of the floor area.
At least one-half of each window shall be so constructed that it can be opened for purposes of ventilation in accordance with OSHA 1910.142(b)(7).
3.2 Primary Wrap Around Services
a. Locations shall be completely self-sufficient to include all toiletries, shower curtains, toilet paper, bedding, towels, fuel, water, and power. Locations shall operate 24 hours a day, seven days a week.
b. Locations shall have wash and fold laundry for responder clothing and janitorial services provided. Pillows, blanket, sheets and pillowcases shall be provided with each bed. Bedding shall be replaced with a clean set every three calendar days. The Contractor shall support turnover of sleeping units by providing fresh linens to all incoming responders. Clean bedding shall be available for exchange, at the request of the responder 24 hours a day, seven days a week.
c. The Contractor shall provide bedding, shower toiletries, shower curtains, toilet paper and hand washing liquid.
d. The Contractor shall provide daily logs to the FEMA COR by 1800. Daily logs shall include:
Daily occupancy counts;
Summary of any technical direction taken by the Contractor;
Summary of daily menu;
Number of meals served per day;
Any billeting issues, reports of any medical issues, communicable disease incidents or food poisoning cases, most current water testing samples (when tested);
Summary of significant changes related to laundry, shower facilities or janitorial issues, update on any contracted solid waste removals (e.g., trash and/or wastewater pickup, etc.)
and/or any identified environmental compliance issues (e.g., any oil spills/clean ups, etc.);
and
The Contractor shall state in report, “no waste transport or environmental compliance issues today” if there is nothing to report.
Any discrepancies in reporting of daily logs shall be corrected by the Contractor at the direction of the COR.
e. The Contractor shall be responsible for ensuring interior temperature between 68-72 degrees Fahrenheit.
f. The Contractor shall provide potable (drinking) water, water purification and manifold distribution systems, toilets, onsite manifold distribution of black and grey water and associated onsite sanitation systems, complete laundry service, trash removal and dumpster service, industrial generators, light towers, fencing and barricades to include maintenance and fuel.
g. The Contractor shall be responsible for any repairs needed. The Contractor has a two-hour inspection and repair window for small repairs and a 10-hour window for major repairs. A small repair is something that can be easily fixed without retrieving any additional parts and do not result in any safety concerns. Major repairs are defined as needing additional parts and/or may involve a third party to resolve. The FEMA COR will have the final say on what is small versus major. If it cannot be repaired, the Contractor shall be responsible for exchanging sleeping and/or other provided accommodations.
3.3 Transportation
For the purposes of this Statement of Work (SOW), Contractor provided transportation is defined as all necessary contractor provided/contracted resources required to transport Contractor personnel, equipment and supplies to a suitable predesignated site. The Contractor and/or driver shall be responsible for all of their own fuel, meals and wrap around services.
a. The Contractor shall provide all transportation and shuttling of trailers to the site locations as identified by FEMA. In the event of a notice disaster (e.g., hurricane), the Contractor may be asked to stage the units at a designated staging area or at their own location, whichever is closer to the potentially impacted area. Once the storm passes, the components shall be dispatched to the locations for setup. The Contractor may be asked to operate in multiple geographical locations simultaneously. Geographic locations may be spread across multiple states. The location will be identified at task order award.
b. Power units (tractor) shall stay with the trailer until the final location is reached.
3.4 Mobilization and Demobilization
a. Site services shall be inclusive of mobilizations, site preparation, installation, management and operations, and demobilization.
b. The Contractor shall be responsible for set up and removal of each site.
3.5 Secondary Wrap Around Services
The Contractor shall provide a dining facility sufficient to support occupancy levels at each lodging Capsule site location.
a. Meal Services and Dining Facility
The Contractor shall provide a dining facility at each Lodging Capsule destination, other than pre-staged locations. which shall meet or exceed OSHA 29 CFR 1910, 29 CFR 1926, and 2006 International Fire Code – Chapter 26 and National Fire Protection Association (NFPA) 101 – Life Safety Code – Chapter 12 – New Assembly occupancy. Hours of operation shall be 0500-2100, seven days a week.
The Contractor shall provide food preparation services capable of providing meals per feeding sufficient to meet Lodging Capsules occupancy levels. All meals shall be prepared in accordance with the Army 14-Day Menu program (or equivalent like the National Interagency Fire Center (NIFC) Mobile Food Services contract http://www.fs.fed.us/fire/contracting/index.htm) and shall be enhanced based on individual chef specialties and skills. The Contractor shall provide three meals per day (breakfast, lunch, and dinner). Breakfast shall be served 0530 am - 0830 am.
Contractor shall provide up to 125 bagged lunches for takeaway by 0530. Lunch meals shall be prepared as “take-away” bagged meals or hot boxed meals. Dinners shall be hot meals served from 1730-2030, seven days a week. The Contractor shall accommodate special meal needs such as vegetarian, vegan, kosher, halal or other special dietary menu needs. Vegetarian meals shall, at a minimum, be prepared for the left-over vegetarian classification level and shall consist of the same quantities and items as regular meals with the exception that no meat, fish, or poultry shall be included. Non-meat protein substitutes shall be in vegetarian sack lunches in lieu of meat, fish or poultry.
Food supplies shall be staged in appropriate storage equipment, dry vans or refrigerated/freezer trailers until prepared. Meal counts for each meal shall be provided to the FEMA National COR/Task Order COR on a daily basis. The Contractor shall provide a dining facility adequate to feed the Lodging Capsules population within a two-hour window or within a schedule as agreed to by the Contracting Officer via the National COR/Task Order COR. The dining facility shall have adequate seating capacity to accommodate a minimum of 1/3 of the Lodging Capsules occupancy level per location.
The Contractor shall ensure that all personnel entering or working in food preparation and/or serving areas shall follow local and State Health Codes and Regulations (i.e., wearing hairnets or disposable hats, washing hands, etc.). The Contractor shall ensure that food is prepared, stored, served and disposed of in accordance with all local, State, and Federal requirements and is subject to inspections from applicable public health personnel. Single-use, food-grade gloves shall be worn when serving meals.
The Contractor shall ensure that each Mobile Food Service Unit Manager and Supervisory Cook has a current Certificate of Completion for food service management, handling, and sanitation training.
Snacks: Hot coffee, tea, bottled water and assorted snacks shall be made available twenty-four hours per day.
b. Meal Payment
The Contractor is also authorized to provide meals to authorized holders of Lodging Capsule Non- Occupant Visitor identification cards. These meals must be provided on a self-pay basis and the Contractor shall accept payment directly from the authorized Lodging Capsule visitors. No costs associated with providing this service shall be passed on to FEMA.
c. Sanitation Inspections
In addition to evaluations by the National COR/FEMA Safety, Health and Medical Readiness (SHMR) HMR representatives shall have access to the kitchen and dining area(s) to check for compliance with sanitation standards as required by local, State, and Federal regulations. This access shall be provided prior to the commencement of operations and randomly throughout the operations of the facilities.
The cleanliness of each space and related equipment shall be measured by means of the Food Service Sanitation Ordinance and Code, Part V of the Food Service Sanitation Manual, U.S. Public Health Service Publication 934 (1965) and all other applicable Federal, State, and local standards and requirements. When a food establishment exceeds critical violation limits, the establishment may be shut down until required sanitation standards are restored. The Contractor shall be responsible for any and all costs associated with closure due to the Contractor’s failure to maintain acceptable sanitation standards. The Contractor must have a plan in place to immediately mitigate deficiencies (e.g. remove food) upon notification of violation of regulations and complete remedy the situation within 24 hours.
d. Hand-Washing Stations
The Contractor is responsible to ensure that the hand wash stations remain stocked with water (hot and/or cold), hand soap and paper towels throughout the dining period. Hand sanitizing stations may be used in addition to hand-washing stations. Service shall be included in the wrap around services optional task price.
e. Morale Welfare and Recreation (MWR)
The Contractor may be required to provide a MWR facility, separate from the sleeping area. When required, it must be established within 72 hours after the setup. This facility must be able to maintain a 10 percent capacity rate based on increase and decrease in population. This area shall have lights, power, HVAC and flooring. This area shall also have tables and chairs for reading and doing personal paperwork. The area shall have television and movie capabilities and seating for inhabitants to relax. The Contractor shall provide:
TVs with DVD players, movie streaming capability—there is no set number or size, but there must be enough so that personnel can watch TV.
Internet Access—can be wired or wireless—though wireless can service more users, the signal must be strong enough to keep a good connection.
Standard charging stations for equipment like cell phones and laptops shall be provided throughout the MWR to accommodate at least 10 percent of occupancy.
Numerous magazines, newspapers, books, and games (Adult Content Prohibited).
Refrigerators and microwaves commensurate with CONUS and OCONUS capacity.
Provide exercise equipment to include treadmill and elliptical machines.
Provide gathering of tables and chairs for occupants to socialize.
4.0 PERFORMANCE REQUIREMENTS
4.1 Activation/Period of Performance
The Contractor shall mobilize and establish operations along the following timeline:
a) The Contractor shall be staged at their own location or at a FEMA designated location within 168 hours of task order award.
b) Lodging Capsule units shall be operational within the following timelines, plus transportation time from staging location to operational location:
1. 50 Units within 48 hours
2. 100 Units within 72 hours
3. 250 Units within 168 hours
The Period of Performance for this contract will be a 60 Day base period with one 30 day option period.
4.2 Hours of Operation
a. All lodging locations shall operate 24 hours a day, seven days a week.
4.3 Communication
a. The Contractor shall ensure that communications are established and maintained between personnel and the Government throughout the duration of support services.
4.4 Staffing and Equipment
Management for all beds on site. This management shall include coordination with staff and senior leaders requesting the sites documented procedures, daily accountability, monitoring, direction, and synchronized actions needed for operating, sustaining, and managing an existing base camp. Provide lighting and signage as required.
DAILY LOGS
The Contractor shall maintain daily camp logs. Copies of the logs shall be made available to the CO/COR and FEMA CONUS RSC Coordinator. Daily logs shall include, but not be limited to:
� Daily occupancy counts;
� Summary of any technical direction provided by the National COR/Task Order COR and contractor action taken;
� Occupant list including name, agency, date and room number
� Any billeting issues;
� Maintenance reports to include, room numbers, type of issue and repair times
� Summary of any significant issues
a. The Contractor shall staff the sites with billeting specialists to establish, operate, and manage the site 24 hours a day. The Contractor must also include two key personnel: 1) Onsite Manager and 2) Repairman. The Onsite Manager shall be responsible for the performance of work. The name of this person, and an alternate(s), who shall act for the Contractor on all contract matters relating to the operation of this contract. The Onsite Manager shall also be responsible for the management (generation, transport and disposal) of any onsite generated solid waste (e.g., municipal trash, grey water from showers, waste oil, etc.). The Onsite Manager shall provide a documented waste disposal documents to the COR for FEMA’s historical records. The Repairman shall maintain and repair machines, mechanical equipment and buildings, fix or replace faulty electrical switches, outlets and circuit breakers, inspect and diagnose problems and figure out the best way to correct them, and perform routine preventive maintenance to ensure that machines and equipment continue to run smoothly.
b. Key Personnel may travel between sites, as well as any additional staff needed to manage and operate each location.
4.5 Key Personnel Requirements
a. Certain skilled experienced professional and/or technical personnel are essential for successful
Contractor accomplishment of the work to be performed under the contract. These are defined as "Key Personnel" and are those persons whose resumes were submitted for evaluation of the proposal. The Contractor agrees that such personnel shall not be removed from the contract or replaced without compliance with paragraphs (b) and (c) hereof.
b. If one or more of the key personnel for whatever reason becomes, or is expected to become, unavailable for work under the contract for a continuous period exceeding ten calendar days, or is expected to devote substantially less effort to the work than indicated in the proposal or initially anticipated, the Contractor shall immediately notify the CO and shall, subject to the concurrence of the CO or his/her authorized representative, promptly replace such personnel with personnel of at least substantially equal ability and qualifications.
c. All requests for approval of substitutions hereunder must be in writing and provide a detailed explanation of the circumstances necessitating the proposed substitutions. They must contain a complete resume for the proposed substitute, and any other information requested or needed by the CO to approve or disapprove the proposed substitution. The CO or his/her authorized representative will evaluate such requests and promptly notify the Contractor in writing of his approval or disapproval thereof.
d. If the CO determines that suitable and timely replacement of key personnel who have been reassigned, terminated or have otherwise become unavailable for the contract is not reasonably forthcoming, or that the resultant reduction of productive effort would be so substantial as to impair the successful completion of the contract or the services ordered, the contract may be terminated at the discretion of the CO for default or for the convenience of the Government, as appropriate, if he/she finds the Contractor at fault for the condition. The contract price may be equitably adjusted downward to compensate the Government for any resultant delay, loss, or damage, and liquidated damages may be imposed.
The following individuals are defined as Key Management Personnel:

It is not required that the Contractor provide personnel with these exact titles, rather the collection of Contractor personnel shall meet the functional requirements consistent with the SOW.
4.6 Conduct
a. Contractor employees shall not access any area that is not pertinent or necessary to the fulfillment of their duties in accomplishing this contract. Contractor employees shall adhere to all instructions and warnings, communicated or posted, regarding their work area and the facilities that occupy this area.
4.7 Inspections
a. Contractor performance shall be inspected by the COR 100% for contract compliance.

5.0 GOVERNMENT FURNISHED PROPERTY/EQUIPMENT/SERVICES
a. As necessary for all facilities, the Government will furnish land and be responsible for the site lease. The site conditions may vary significantly.
b. Security will be provided by the Government. The Government reserves the right to provide any other equipment or services to support operations.
6.0 CONTRACTOR FURNISHED EQUIPMENT AND SUPPLIES
To the maximum extent practical, the Contractor shall furnish all other supplies, equipment and personnel to accomplish the requirements listed in the SOW. The Contractor shall comply with environmental purchasing regulations and Presidential Executive Order 13423 when acquiring products and services in performance of the contract. Specifically, the Contractor shall acquire bio-based, environmentally preferable, energy-efficient, water-efficient, and recycled-content products, and use paper of at least 30 percent post-consumer fiber content.
7.0 SAFETY STANDARDS
The lodging Capsules , laundry, shower, common and meal areas units shall be kept in compliance with applicable OSHA rules in 29 CFR Part 1926 & 29 CFR 1910, specifically 29 CFR 1910.142 Environmental Protection Agency (EPA) regulations outlined in 40 CFR and all other local, state and Federal regulatory standards and conditions for safety, health, and environmental management.
7.1 Code Adherence/Compliance Report
a. The Contractor is responsible for adherence to applicable Federal, state, territorial, commonwealth and local regulations and laws. This includes, but is not limited to, all local, state, territorial and commonwealth Occupational Safety Health and Environmental Management Department regulations, the 2006 International Building Code, 2006 International Fire Code – Chapter 24 and NFPA 101 – Life Safety Code for the occupancies being constructed.
b. FEMA will support the Contractor’s efforts to expedite the permit process responsible for obtaining all required permits prior to acceptance. The Contractor shall notify the Contracting Officer and COR immediately if the circumstances raise any concerns about the Contractor’s ability to obtain the necessary permits. In addition, throughout all phases of the responder support lifecycle, the Contractor shall comply with all applicable local, State, territorial, commonwealth, and Federal rules and regulations associated with the operation of support systems and operate within the conditions of any permits obtained or applied for. This includes, but is not limited to, the operation of potable water systems, wastewater treatment systems, collection, storage, and disposal of hazardous and regulated waste, and collection and disposal of solid waste.
c. The Contractor shall be responsible for meeting manufacturer recommend installation specifications. The Contractor shall perform a local code review of the jurisdictional area where the Lodging Capsule is located and implement any requirements determined to be more stringent than the National Codes indicated in this SOW. A written compliance report shall be provided to the Government upon completion of this code review within seven days of the award.
d. Access and Functional Needs: The Contractor shall be responsible for accommodating individuals with functional needs. This includes, at a minimum, the application of Uniform Federal Accessibility Standards (UFAS) along with any other Federal, state, territorial, commonwealth or local regulations. The facilities within the Lodging Capsule units that must meet these standards include, but are not limited to, billeting areas, administrative areas, restrooms, shower facilities and hand-washing stations. 5 percent of the facility must meet the UFSA standard.
e. Automatic External Defibrillators: Automatic External Defibrillators (AEDs) shall be placed in all areas of assembly (i.e., dining facility, MWR, billeting, etc.). AEDs shall be in proximity to the main entrance door and be marked with a large predominant sign.
f. Restroom Facilities: The Contractor shall provide en suite restroom facilities with flushing toilets to each single bedroom or one shared toilet between two bedrooms to ensure compliance with all applicable OSHA 29 CFR 1910 and 29 CFR 1926 standards and requirements and all other Federal, state, and local requirements. These units shall be designed and certified for use by the Portable Sanitation Association International. All wastewater shall be collected with vacuum trucks and transported offsite and disposed at permitted treatment facilities. When available, public utilities shall be utilized.
g. Shower Facilities: The Contractor shall provide en suite shower facilities and curtains, one per single bedroom or one shared shower between two bedrooms to ensure compliance at a minimum with OSHA 29 CFR 1910 and 29 CFR 1926 as well as UFAS standards. Units shall have hot and cold water and shall be serviced with an ASME rated propane water heater and an anti-scaled valve for user safety. Heated water shall be provided at a minimum of 120 degrees Fahrenheit 24/7. Shower cleaning solution shall be provided for daily disinfecting of shower areas by the tenants if they so choose.
h. Handwashing Facilities: The Contractor shall provide en suite sinks, one per single bedroom or one shared sink between two bedrooms in accordance with 29 CFR 1910 or 29 CFR 1926 requirements. Sinks with mirrors and outlets for hairdryers and shaving equipment shall be provided. The Contractor shall also furnish sufficient hand-washing stations at each entrance to the dining area (if one is requested for activation) for personnel to use prior to entering, ensuring compliance at a minimum with OSHA 29 CFR 1910 and 29 CFR 1926. Personnel shall not have to wait in line for more than five minutes to use a hand-washing station.
i. Linen Services: The Contractor shall provide laundry services and shall ensure that clean, fresh linens and towels are available daily upon request by each occupant. This includes all towels for showers, bedding and any linens for the dining facility. These basic services shall be provided to all occupants and shall be included in the daily contract price.
j. Laundry Services: A drop and fold service for occupants’ personal laundry shall be available for daily drop-off and pick-up. Laundry shall be done separately and individually for sanitation concerns. Drop off and pick up service for occupants shall be provided twice a week with a maximum 48-hour turn-around time. Service shall be included in wrap around services base price. Laundry units do not have to be on site. The Contractor is also authorized to provide self-pay drop off and pick-up laundry service to authorized holders of Non-Occupant Visitor Identification cards. This service must be provided on a self-pay basis and the Contractor shall accept payment directly from the authorized visitors. No costs associated with providing this service shall be passed on to FEMA.
k. Fencing and Barricades: The Contractor shall provide fencing and barricades around the perimeter of terrestrial lodging area as set forth in the contract. The Contractor shall also provide fencing and barricades around areas which are “off limits” to occupants. Fencing and barricades are required within 48 hours for “phased” setup timeframes, and 72 hours for the rest of the initial setup timeframe. This is to ensure the health and safety of occupants. Fences, barriers, and implemented separation mechanisms shall comply with Federal, state, commonwealth, territorial, and other local regulations as applicable. Building codes, and regulations, as well as any applicable FEMA security requirements as defined by the Joint Field Office (JFO) Security Officer. All fences or barriers shall comply as a minimum with the requirements set forth in UFAS or the Americans with Disabilities Act or other Federal, state, commonwealth, territorial and or the local requirements. For non-territorial solutions such as barges or ships, the Contractor shall provide fencing and barricades to secure the entrance of the Lodging Capsule site.
l. The contractor shall be responsible for providing lighting solutions for the sites outdoors areas and will maintain all light towers or other equipment used to provided lighted areas after dark.
m. FEMA COR, Logistics and Safety must have access to all camp areas 24/7 for no-notice inspection purposes with no limitations.
7.2 Equipment Inventory List
The Contractor shall have the capability to provide assets that can be expanded and reduced based on mission needs of the population. The Contractor shall provide an Equipment Inventory Report weekly to the Contracting Officer and COR. The Equipment Inventory Report shall include all equipment used to erect and operate the Lodging Capsule site. The report shall state if the equipment is owned/leased. The Contractor shall have sufficient equipment available for rapid deployment and preventative maintenance programs to ensure optimum equipment readiness levels always.
a. Power and HVAC Units: The Contractor shall provide power and HVAC as required to power the requirements of the Lodging Capsules. Available site utilities shall be specified in each task order. Temporary power and HVAC, when needed, shall be provided via mobile diesel generators and heating and cooling units sized to support the facility as required. Units shall be self-contained, and mobile and over the road transportable. Units shall be sound attenuated with noise levels rated at no higher than 69 dBA and a reasonable distance from the billeting to allow for proper sleep of occupants. Panels and transformers shall be placed as required by the site configuration. Distribution shall be provided with cam lock connectors and sized to applications. GFCI outlet boxes shall be placed throughout the facility as design requires.
Wherever cabling crosses roadways or pedestrian areas, cable ramps shall be used for safety and protection. All electrical equipment shall be Underwriters Laboratories (UL) Listed and rated for National Electrical Manufacturers Association (NEMA) 3R and 4 applications.
Electrical systems shall be installed to National Electrical Codes (NEC) standard by licensed electrical personnel. When required, HVAC shall be provided for all structures in sufficient capacities to meet different environmental conditions. All mobile HVAC units shall be operated on a digital thermostat control.
b. Environmental Control: The Contractor shall ensure that all facilities within the Lodging Capsule site are equipped with reverse cycle (Heat and A/C) Environmental Control Units (ECUs) or comparable environmental control system capable of maintaining the ambient temperature inside the facilities between 68-72 degrees Fahrenheit. Camp shall have adequate drainage in accordance with OSHA 1910.142(a)(1) and shall be of adequate size in accordance with OSHA 1910.142(a)(2).
c. Ablution: The Contractor shall provide a potable water supply, en suite restroom with flushing toilet, shower, and sink, laundry services, and wastewater collection systems at each Lodging Capsule location. All water supply equipment shall be rated for potable water supply in accordance with ANSI/NSF 42, 53, & 61 standards and applicable EPA and state and local regulations for potable water. Water systems shall be operated in accordance with all Federal, state and local standards and requirements. Water Quality samples shall be obtained as required by the EPA and analyzed at a state certified lab for compliance with Safe Drinking Water Act requirements. All water resting reports shall be provided or emailed to the COR and Contracting Officer within 48 hours of request and within 48 hours after testing.
d. Wastewater: The Contractor shall ensure that wastewater from showers, laundry, hand-washing stations, restroom/toilet facilities and any other source shall be collected into pump stations and pumped to storage tanks. All on-site wastewater shall be collected. Vacuum trucks shall maintain a service schedule to remove the wastewater from the tanks and transport offsite to dispose of at a permitted treatment facility. The collection and use of graywater for an-site purposes may be permitted if authorized by local authorities and implemented via a contract modification. Use of Containerized On-Site Wastewater Systems may be used if authorized by the Contracting Officer through the National COR. When available, public utilities shall be utilized.
e. Solid Waste Collection and Disposal (Dumpsters): The Contractor shall provide all necessary solid waste collection and disposal for the Lodging Capsule sites in accordance with EPA 40 CFR 243 and any additional state, and local regulations at least once per day. Lodging Capsule Contractors shall establish recycling programs in accordance with Presidential Executive Order 13423 and have a goal to recycle 35% of waste generated from Lodging Capsule operations. Collections shall be maintained in a clean and sanitary condition free from rubbish, debris, wastepaper, garbage, or other refuse. Items recycled must include at a minimum the following:
Toner cartridges Batteries Scrap metal Fluorescent light bulbs Paper (white paper, mixed paper, newspaper) Cardboard Aluminum Wood pallets Plastic Glass
f. Janitorial Services: The Contractor shall provide janitorial services for all components of the
Lodging Capsules. Clean provide shall be GREEN low Volatile Organic Compound (VOC) emitting and meet the requirements found on the General Services Administration (GSA) approved list. Safety Data Sheets (SDS) shall be provided to the safety official. All sleeping areas shall be cleaned once per week or more frequently if needed. Contractor shall make beds during weekly cleaning and each time a unit is turned over from previous occupant. The Contractor shall provide the cleaning products and supplies needed to maintain the sanitary environment.
g. Site Restoration: The Contractor shall demobilize the Lodging Capsule units, clean the site, grade soil (if required), remove/dispose of all garbage and used materials and return the site to its original condition, minus reasonable wear and tear, within seven days of the demobilization notice. The Contractor shall meet any special conditions established in the Environmental Health Perspective (EHP) review process for the return of the site to its original conditions.
h. Demobilization or Site Relocation: The Contractor shall have the capability to demobilize or relocate the site outside of harm’s way for immediate redeployment when a threatening situation puts the Lodging Capsule units or responders at risk. The Contractor shall be capable of demobilization or moving assets within 24 hours after receiving Contracting Officer’s notification. All associated costs for time and travel from the disaster incident after demobilization of Lodging Capsules must be incorporated into the overall demobilization costs.

9.0 SECURITY
9.1 Background Investigations
All contractor personnel who require access to DHS or FEMA information systems, routine access to DHS or FEMA facilities, or access to sensitive information, including but not limited to Personally Identifiable Information (PII), shall be subject to a full background investigation commensurate with the level of the risk associated with the job function or work being performed.
FEMA’s Personnel Security Division (PSD) will determine the risk designation for each contractor position by comparing the functions and duties of the position against those of a same or similar federal position, applying the same standard for evaluating the associated potential for impact on the integrity and efficiency of federal service.
Low Risk without Information System Access Contractor personnel occupying positions or performing functions with a Low Risk designation and who do not require access to DHS or FEMA information systems may undergo a Tier 1 investigation with a credit check and must receive a favorable adjudication thereof from FEMA PSD prior to performing work under this contract. (Also reference Facility Access).
Low Risk with Information System Access Contractor personnel occupying positions or performing functions with a Low Risk designation and who require access to DHS or FEMA information systems shall undergo a Tier 2 Suitability Background Investigation (T2) and must receive a favorable adjudication thereof from FEMA PSD prior to performing work under this contract.
Moderate Risk Contractor personnel occupying positions or performing functions with a Moderate Risk designation shall undergo a Tier 2 Suitability Background Investigation (T2) and must receive a favorable adjudication thereof from FEMA PSD prior to performing work under this contract.
High Risk Contractor personnel occupying positions or performing functions with a High Risk designation shall undergo a Tier 4 Suitability Background Investigation (T4) and must receive a favorable adjudication thereof from FEMA PSD prior to performing work under this contract.
Background Investigation Process To initiate the request to process contractor personnel, the Contractor shall provide the FEMA Contracting Officer’s Representative (COR) with all required information and comply with all necessary instructions to complete Section II of the FEMA Form 121-3-1-6, “Contract Fitness/Security Screening Request.” The FEMA COR shall ensure that all other applicable sections of the FEMA Form 121-3-1-6 are complete prior to submitting the form to FEMA PSD for processing. The Contractor shall also provide the FEMA COR with completed OF 306, “Declaration for Federal Employment,” forms for all contractor personnel.
Contractor personnel who already have a favorably adjudicated background investigation, may be eligible to perform work under this contract without further processing by FEMA PSD if:
the investigation was completed within the last five years, it meets or exceeds the minimum requirement for the position they will occupy or functions they will perform on this contract, the contractor personnel have not had a break in employment since the prior favorable adjudication, and, FEMA PSD has verified the investigation and confirmed that no new derogatory information has been disclosed which may require a reinvestigation.
FEMA PSD will notify the COR of the names of the contractor personnel eligible to work based on prior, favorable adjudication. The COR will, in turn, notify the Contractor of the names of the favorably adjudicated contractor personnel, at which time the favorably adjudicated contractor personnel will be eligible to begin work under this contract.
For those contractor personnel who do not have an acceptable, prior, favorable adjudication or who otherwise require reinvestigation, FEMA PSD will issue an electronic notification via email directly to the contractor applicant/personnel that contains the following documents, which are incorporated into this contract by reference, along with a link to the Office of Personnel Management’s (OPM) Electronic Questionnaires for Investigation Processing (e-QIP) system and instructions for submitting the necessary information:
Standard Form 85P, “Questionnaire for Public Trust Positions” Optional Form 306, “Declaration for Federal Employment” SF 87, “Fingerprint Card” (2 copies) DHS Form 11000-6, “Non-Disclosure Agreement” DHS Form 11000-9, “Disclosure and Authorization Pertaining to Consumer Reports Pursuant to the Fair Credit Reporting Act”
FEMA PSD will only accept complete packages consisting of all of the above document and Standard Form 85P, which must be completed electronically through the Office of Personnel Management’s e-QIP system. The Contractor is responsible for ensuring that all contractor personnel timely and properly submit all required background information.
Once contractor personnel have properly submitted the complete package of all required background information, FEMA’s Personnel Security Division, at its sole discretion, may grant contractor personnel temporary eligibility to perform work under this contract prior to completion of the full background investigation if the Personnel Security Division’s initial review of the contractor personnel’s background information reveals no issues of concern. In such cases, FEMA’s Personnel Security Division will provide notice of such temporary eligibility to the COR who will then notify the Prime Contractor, at which time the identified contractor personnel will be temporarily eligible to begin work under this contract. Neither the Prime Contractor nor the contractor personnel have any right to such a grant of temporary eligibility. The grant of such temporary eligibility shall not be considered as assurance that the contactor personnel will remain eligible to perform work under this contract upon completion of and final adjudication of the full background investigation.
Upon favorable adjudication of the full background investigation, FEMA’s Personnel Security Division will update the contractor personnel’s security file and take no further action. In any instance where the final adjudication results in an unfavorable determination FEMA’s Personnel Security Division will notify the contractor personnel directly, in writing, of the decision and will provide the COR with the name(s) of the contractor personnel whose adjudication was unfavorable.
The COR will then forward that information to the Contractor. Contractor personnel who receive an unfavorable adjudication shall be ineligible to perform work under this contract. Unfavorable adjudications are final and not subject to review or appeal.
Continued Eligibility and Reinvestigation Eligibility determinations based on a Low Risk T1, Moderate Risk T2S or High Risk T4 are valid for five years from the date that the investigation was completed and closed. Contractor personnel required to undergo a background investigation to perform work under this contract shall be ineligible to perform work under this contract upon the expiration the background investigation unless and until the contractor personnel have undergone a reinvestigation and FEMA’s Personnel Security Division has renewed their eligibility to perform work under this contract.
Exclusion by Contracting Officer The Contracting Officer, independent of FEMA’s Personnel Security Division, may direct the Contractor be excluded from working on this contract. Any contractor found or deemed to be unfit or whose continued employment on the contract is deemed contrary to the public interest or inconsistent with the best interest of the agency may be removed.
9.2 Facility Access
The Contractor shall comply with FEMA Directive 121-1 “FEMA Personal Identity Verification Guidance,” FEMA Directive 121-3 “Facility Access,” and FEMA Manual 121-3-1 “FEMA Credentialing Access Manual,” to arrange for contractor personnel’s access to FEMA facilities, which includes, but is not limited to, arrangements to obtain any necessary identity badges for contractor personnel.
Contractor personnel working within any FEMA facility who do not require access to DHS or FEMA IT systems and do not qualify for a PIV Card may be issued a Facility Access Card (FAC).
FACs cannot exceed 180 days; all contractors requiring access greater than 180 days will need to qualify for and receive a PIV card before being allowed facility access beyond 180 days.
Contractor personnel shall not receive a FAC until they have submitted a SF 87, “Fingerprint Card,” and receive approval from FEMA PSD. Contractor personnel using a FAC for access to FEMA facilities must be escorted in Critical Infrastructure areas (i.e., server rooms, weapons rooms, mechanical rooms, etc.) at all times.
FEMA may deny facility access to any contractor personnel whom FEMA’s Office of the Chief Security Officer has determined to be a potential security threat.
The Contractor shall notify the FEMA COR of all terminations/resignations within five calendar days of occurrence. The Contractor must account for all forms of Government-provided identification issued to contractor employees under a contract (i.e., the PIV cards or other similar badges) must return such identification to FEMA as soon as any of the following occurs:
When no longer needed for contract performance.
Upon completion of a contractor employee’s employment.
Upon contract completion or termination.
If an identification card or building pass is not available to be returned, the Contractor shall submit a report to the FEMA COR, referencing the pass or card number, name of the individual to whom it was issued, and the last known location and disposition of the pass or card.
The Contractor or contractor personnel’s failure to return all DHS- or FEMA-issued identification cards and building passes upon expiration, upon the contractor personnel’s removal from the contract, or upon demand by DHS or FEMA may subject the contractor personnel and the Contractor to civil and criminal liability.
SECURITY: All personnel require access to information up to the sensitive but unclassified, for official use only (FOUO) levels. Contractor must ensure contractor employees receive a favorably adjudicated public trust suitability prior to entry on duty (EOD). All individuals will be U.S.
citizens. The contractor shall follow the standards established within DHS and FEMA policy.
Unauthorized Disclosure of Classified or Unclassified Information:
Contractors and Subcontractors who are working on this contract shall receive Unauthorized Disclosure of Classified or Unclassified Information training.

Certificate of training is required for all cleared contractor employees who are working with classified or unclassified information. All certificates must be sent to the assigned FEMA
Contracting Officer Representative, before the Contractor or Subcontractor is granted access to classified or unclassified information but no later than 30 calendar days after awarded contract. All cleared contractor personnel are required to recertify Insider Threat training annually thereafter. New employees entering the contract must receive the briefing within ten (10) business days of joining the contract.
For Official Use Only (FOUO) Information:
In accordance with DHS Management Directive 11042.1 contractors, consultants and others to whom access is granted will abide by 11042.1; DHS policy regarding the identification and safeguarding of sensitive but unclassified information originated within DHS. It also applies to other sensitive but unclassified information received by DHS from other government and non-governmental activities.
The contractor shall:
1. Be aware of and comply with the safeguarding requirements for “For Official Use Only” (FOUO) information as outlined in this directive.
2. Participate in formal classroom or computer-based training sessions presented to communicate the requirements for safeguarding FOUO and other sensitive but unclassified information.
3. Be aware that divulging information without proper authority could result in administrative or disciplinary action.
Contractors and Consultants shall execute a DHS Form 11000-6, Sensitive but Unclassified Information Non Disclosure Agreement (NDA), as a condition of access to such information.
