About this file
This is a Security Brief appendix document issued by New York's Empire State Development (ESD) that establishes mandatory information security and compliance standards for all contractors, vendors, and third-party partners engaged in projects with a data or IT component. The document outlines baseline security requirements applicable to all ESD engagements, with additional IT deliverables to be identified within 30 days of contract signing and documented as project milestones. Contractors must demonstrate compliance with ISO Standards 27001, 27005, and 27035 concerning the protection of ESD's network, data, and information systems, and may utilize comparable security standards if approved by ESD's Chief Information Security Officer. The brief requires vendors to maintain documented monitoring processes for third-party compliance, provide identity access management with authentication and transaction auditing capabilities, and certify that all supply chain vendors comply with the referenced ISO standards relative to their project roles.
Additional compliance requirements include adherence to GDPR standards for data collection and protection when systems collect or store information from entities or citizens within GDPR governance scope, compliance with all applicable state and federal cybersecurity and information security policies and laws, documentation of all third-party access to ESD data or information systems, and management of information communications to maintain ESD data security. The brief specifies that use of artificial intelligence must comply with all applicable state and federal laws and relevant ESD policies. This document is associated with an Environmental Cost Analysis RFP in New York that includes contracting goals of 6.00% for Service-Disabled Veteran-Owned Businesses, 15.00% for Minority Business Enterprises, and 15.00% for Women Business Enterprises.
