About this file

This is Amendment 1 to a Request for Proposal issued by the State Fiscal Accountability Authority on behalf of the South Carolina Department of Corrections for the Inmate Package Program. The solicitation (Number 5400028635) seeks vendors to provide package items for incarcerated individuals across the state correctional system. The pre-proposal conference is scheduled for October 22, 2025, at 10:00 a.m. EST on a virtual platform, with questions from offerors due by the same date at 4:00 p.m. EST. Proposals must be submitted online by November 13, 2025, at 11:00 a.m. EST through the state procurement website. The award will be posted on December 10, 2025. The initial contract term is two years (beginning April 26, 2026) with renewal options available. Responses must be separated into technical and cost/price proposals, with pricing submitted in both PDF and Excel formats as specified in the original RFP.

Pricing for the base two-year term must be held firm with no adjustments permitted during the initial contract period; vendors are responsible for conducting market research and cost projections prior to submission. Price adjustments after the initial term require requests submitted at least 90 days prior to contract expiration and must be accompanied by documentation justifying the increase, with adjustments limited to CPI "Other Goods and Services" calculations. The incumbent vendor previously held this contract and currently manages the program data file; the amendment clarifies that Protective Custody inmates will be excluded from the eligible inmate data file, with special custody cases handled on a case-by-case basis. Inmate pay is set at $3.50 per hour and will remain consistent throughout the base term and extensions. The state will not cover tariff costs under any circumstances, and vendor commissions will apply to any approved price increases.

Questions

1. The excel file labeled Attachment A, when opened states Attachment B at the top. Can the DOC please clarify what this form should be named and update accordingly?

State’s Response- This was a typo and the corrected version has been released with this amendment.

2. Per page 24 of the RFP, it states that 1 Technical and 1 Business proposal should be uploaded. However, on page 45 of the RFP, it states that an excel file of the pricing must be completed and returned with the vendors response. In addition to the clarification on the name of the price proposal can the DOC please confirm that up to 3 files:

1) Bidding Schedule/Price Proposal as a PDF to include the market basket as 1 complete PDF version

2) Market Basket Excel Version

3) Redacted Complete PDF (if applicable) State’s Response: All required forms provided within the solicitation must be completed and returned with your response. Your response shall be separated into two parts, Technical and Cost/Price proposals. Yor redacted copy can be separated or included as part of the technical file. You cannot redact pricing.

3. As the incumbent partner for the SCDC package program, the current data file does not currently include Protective Custody (PC). Will SCDC be adding PC to the existing inmate data file and provide restrictions for this class of inmate?

State’s Response: No. Request Protective Custody be removed under 3.8. Eligible Inmates. Statewide PC is only at McCormick, and they are authorized packages. SP, which is short term PC, will be handled on a case-by-case basis at all the other institutions.

4. Section 3.10 page 17 of the bid: Holding prices for the two (2) year base term will require vendors to submit pricing higher than the current retail price for items to try and anticipate future cost increases. Additionally, with the current uncertainty of inflation and tariffs, it is extremely difficult to provide pricing for a year plus out since the contract will begin 4/26. Would SCDC allow for a menu pricing review after the first year of the contract which has been done in the past?

State’s Response: The state will not pay or cover the cost of tariffs under any circumstance. The pricing shall be held firms for the first term of the contract as stated in the RFP. It is the Offeror’s responsibility to perform market research and consider the standard marking index and its cost projections over the anticipated, initial 24-month contract term prior to submitting their pricing for this RFP. Price adjustments are prohibited during the initial term.

5. Page 42: Price Adjustment – Limited – After Initial Term Only: “Any request for a price increase must be received by the Procurement Officer at least ninety (90) days prior to the expiration of the applicable term and must be accompanied by sufficient documentation to justify the increase.” Providing increases ninety (90) days prior to the contract renewal would require the vendor to assume increases for the next fifteen (15) months to cover the next year’s prices. Would SCDC consider a twice-a-year price review to provide current pricing regarding cost conditions?

State’s Response: No, the State’s terms and conditions shall remain as provided in the RFP.

6. Page 42: Price Adjustments – Limited by CPI “Other Goods and Services”: Cost increases for individual products that are sold through this solicitation are almost always well over the adjusted CPI “Other Goods and Services”. For 2025, through August 2025, CPI U is only +2.9% for “All Items”. An example is ramen; in 2025, ramen soup had multiple cost increases equaling over 25%. This would leave the awarded vendor over twenty points behind the cost increase received for one of the most popular items on the menu. Per the language in the section above (Price Adjustment – Limited – After Initial Term Only), the awarded vendor must provide sufficient documentation for the increase request. SCDC could allow increases on items that would cover the vendor’s cost increase from the item manufacturer. Allowing for the manufacturer’s cost increase would still not cover the additional minimum 35% commission that SCDC would take from any price increase. Would providing the cost increase percentage, on a manufacturer’s letterhead, allow the awarded vendor to cover their actual cost increase on individual items and forgo the CPI flat rate?

State’s Response: Price increases are per the stated clause and are reviewed at the time of request. No guarantees can be made. Offering of a substitute item for approval may be appropriate in the event the granted increase doesn’t cover the cost. (Price Adjustment – Limited – After Initial Term Only)

7. Section 3.17 Reimbursement and Commission: for item number four (4) has inmate pay at $3.50/hour. Will this hourly rate be consistent throughout the base term and extensions?

State’s Response: Yes

8. If no to the above, please provide any anticipated increases.

State’s Response: Not applicable

9. Does the procurement site send automatic alerts when an addendum is released?

State’s Response: Yes image2.png image1.png
