(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. Description/Specifications/Statement of Work
1. DESCRIPTION OF WORK:
This project is to perform hoedad planting of conifer tree seedlings and placement of tree seedling protectors on the South Fork Management Unit of the Shasta-Trinity National Forest. Conifer tree seedling are 1-0 & 2-0 bareroot stock and container seedlings. The Detailed Unit Information List lists the expected quantity and stock types to be planted in each unit. The work consists of initial planting on both sites prepared for planting as well as natural stand reestablishment which are refferred to as off-plantations or OP’s. Site preparation and current site conditions are described below in the Supplemental Planting Requirements Section.
Non-plantable spots consist of machine piles created in units that received site preparation and have not yet been burned. Additionally, existing conifer trees and seedlings, hardwood regeneration, rock, and dead brush skeletons will also reduce the number of plantable spots. Landings and temporary roads constructed during the site preparation that access log decks will not be planted, landings and temporary roads that do not access log decks will be planted. The planting units have both conifer and hardwood snags and live trees both within and surro The Contractor shall furnish all labor, equipment, supervision, transportation, supplies, except those designated as Government-furnished, and incidentals, to perform all work necessary on the areas specified.
The Contractor shall furnish all labor, equipment, supervision, transportation, supplies, except those designated as Government-furnished, and incidentals, to perform all work necessary on the areas specified.
2. DESCRIPTION/ACCESS
Project area is located on the Shasta-Trinity National Forest on the South Fork Management Unit. Detailed maps of the Shasta-Trinity National Forests are available from the Supervisor’s Office or the District Offices. The
Government is not obligated to perform any unscheduled road maintenance. The Government will determine the most suitable access route to the project areas. Most work units are accessible by standard or 4-wheel-drive vehicle; however, some walk-ins are required for various reasons of inaccessibility .
Inaccessibility due to snow, fallen trees, slides or wash-outs on roads may or may not be corrected at the option of the Government. If road access is blocked, the Government may: (1) provide an alternate access route; (2) delete the inaccessible portion of the work units; (3) substitute similar work units; or (4) require the Contractor to plant the work units.
Planting will be done depending on weather and soil conditions, start date is expected to begin as early as March
5th, but will be no later than May 5 th , if adequate precipitation is not received by May 5 th , the contract may be terminated. Planting will begin at the lowest elevations and progress towards the higher elevation units. The
Contracting Officer may specify a priority of work by unit, without additional costs. In nearly all cases, work will move to adjacent units.
Access:
The majority of the units are road adjacent and require little walking distance. The main access routes will be plowed if necessary. However, depending on snow levels and road surface type, there are a few units that may still require walking in with the greatest distance being approximately 1/2 mile on road grades. The helicopter units of items 2 and 3 will require walking in on no road grades for up to 1/2 mile.
Maps: The maps are intended to show only the general size, shape, and location of the areas. If the maps conflict with the field marking (flagging or tags), the field markings shall govern. Positions of features are approximate. Unit maps may show spur roads into work units. These spur roads may have been removed, blocked, be impassable or not be approved for any motorized vehicles. Contractors shall not rely on spur roads for motorized access to units. No vehicle shall by-pass any officially blocked road (barrier, locked gates, posted signs, rocks/log dirt, etc.) without approval of the Contracting Officer. The Contractor will be given 2 color sets of the area map. In the event additional maps are needed, the Contractor will be given black and white copies.
Boundaries: The boundaries of all planting units are defined on the ground with either flourescent pink, lime green, or blue and yellow combined. Most units also have orange plastic tags on the boundary trees. Most units have numbers painted in orange on each corner and along the roads.
