C - SECTION C - Description/Specifications/Statement of Work
Summit and Miller Canyon OHV Staging Area
C.1 - Scope of Contract This contract consists of the supply and installation of two precast 2-unit concrete vault toilet at Summit and Miller Canyon OHV Staging Areas. Work shall include excavation, backfill, and placement of the precast concrete vault toilets. Contract work also includes the installation of trash receptacles, picnic tables and boulders as illustrated on the Contract Drawings.
The principal features of work to be performed under these specifications include, but are not limited to the following:
Summit OHV Staging Area Supply and install a precast 2-unit concrete vault toilet.
Supply and install boulders to delineate picnic and restroom area as shown on the
Contract Drawings.
Supply and install three smooth top concrete picnic tables.
Supply and install one 2-unit BearSaver trash receptacle. Work is also to include the construction of concrete footings for the bear proof trash receptacle.
Miller Canyon Staging Area Supply and install a precast 2-unit concrete vault toilet.
Installation of entrance sign for Miller Canyon: sign will be furnished by the
Government.
Relocation of existing kiosk from the user created staging area to the new OHV staging area. Work is also to include the construction of footings for kiosk installation purposes.
Supply and install two 2-unit BearSaver trash receptacle. Work is also to include the construction of a concrete pad for the bear proof trash receptacle.
The Contractor shall provide all labor, materials, and equipment to complete the contract as shown on the drawings and included in the specifications. The contractor is responsible for securing all permits, fees and requirements from state and local county offices.
C.2 - Project Location Work areas are located off Highway 138 in San Bernardino County, California at the following locations:
Summit OHV Staging Area From San Bernardino, travel north on Interstate 215 (I-215). Continue driving on I-215 until you reach Interstate 15 (I-15). Merge onto I-15 going northbound until you reach Highway 138 (CA-
138) or take exit 131. Continue driving on CA-138 eastbound for approximately 4.4 miles and turn right onto Forest Service Road 3N22, Elliot Ranch Road.
Miller Canyon OHV Staging Area From San Bernardino, travel north on Interstate 215 (I-215). Continue driving on I-215 until you reach Interstate 15 (I-15). Merge onto I-15 going northbound until you reach Highway 138 (CA-
138) or take exit 131. Continue driving on CA-138 eastbound for approximately 15.4 miles and turn left on Forest Service Road 2N37, Miller Canyon Road.
C.3 – Time of Performance
30 Calendar Days
Estimated Start date: Spring, 2017
Contractor must begin work within 7 days of the effective date of the Notice to Proceed.
C.4 – Pre-Bid Tour A Pre-bid tour is encouraged for the contractor to do on their own time. Date and Time TBD.
C.5 – Price Range The price range of this project is between $100,000 and $250,000.
C.6 - Restrictions on Work
1. In accordance with the fire plan, included in attachments.
2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.
3. No work on holidays without prior written approval of the Contracting Officer.
C.7 - Worker's Compensation Insurance The Contractor shall provide evidence of Worker's Compensation Insurance or a written explanation as to why the Contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.
C.8 – Special Conditions Affecting Work
a. Work Hours. Work hours are from 8:00am to 5:00pm Monday through Friday.
Weekend or holiday work is not allowed at any time during construction without written approval from the Contracting Officer.
b. Safety, Emergency Communications and Evacuation. Contractor shall be responsible for the safety of the Contractor’s employees, Subcontractor’s employees, Government employees associated with the project, and any visitors to the site both Government and private. The Contractor shall submit a project safety plan to the Contracting Officer for review prior to commencement of work. The project safety plan shall comply with the appropriate California OSHA and Federal OSHA rules and regulations and must include a medical evacuation and emergency communications plan.
c. Highway Permits. Contractor shall be responsible for securing any overload or over width limit permits required for the transport of materials or equipment to the project site.
The Contractor shall be responsible for conducting a thorough reconnaissance of all routes leading to the site.
d. Security. The Contractor shall be responsible for his own equipment and materials supplied to the site. All equipment not equipped with a key lock system shall be secured in such a manner as to make it inoperable to the average person at the end of each working day. All hand tools and other equipment shall be secured at the end of each working day. On Fridays all construction debris, trash, and refuse shall be properly stored in dumpsters or trash bins or removed from the site. The Contractor shall not hold the Government liable for any theft or vandalism inflicted on his equipment and materials.
e. Fire Prevention. The Contractor shall comply with the Fire Plan included in the Contract.
f. Protection of Resources. Contractor shall thoroughly clean all equipment prior to delivery to the project site to remove weeds, mud, grease and oil buildup from the tires, wheels, tracks, engines and engine compartments, and other surfaces. Spills of petroleum products and other hazardous substances shall be reported, contained, and removed in accordance with all applicable Local, State and Federal laws and regulations. Inspection of equipment is required prior to off-loading.
g. Site Inspection: Prospective bidders are strongly encouraged to inspect the project site prior to the bid reply date. In no event shall the failure to inspect site conditions constitute grounds for a claim after contract award. (See Section L, FAR 52.236-27, SITE VISIT).
h. Questions: Prospective bidders desiring an explanation of the solicitation, drawings, specifications, etc. must submit requests in writing to the Contracting Officer. Cut-off date for any RFI’s will be 1 week prior to the closing date of the solicitation. Oral explanations or instructions given before the award of a contract will not be binding.
i. Business Operations: Contractor’s work shall not interfere with business operations of Forest Service roads.
C.9 – Project Site Cleanup Project site cleanup includes the daily removal and proper disposal of all trash, debris, and residue off of National Forest Land. All spills of petroleum products including leak spots from parked vehicles shall be removed and properly disposed of according to all Local, State, and Federal regulations and laws governing such disposal. The Contractor is required to dispose of all construction debris and removed equipment off of Forest Service lands in accordance with Federal, State, and local requirements. The Contractor is required to furnish dumpsters or other trash receptacles and to empty such containers either as they become full or weekly, whichever is more frequent. The Contractor shall not place materials of any kind into private or Government trash bins or dumpsters.
C.10 – Contractor Qualifications and Licenses Contractor and/or subcontractor must posses a valid license to perform the applicable contract work issued by the State of California. Contractor must possess a current and valid Class B, “General Building Contractor” license issued by the State of California to perform the applicable contract work. Proof of certification shall be provided to Government attached to the bid proposal reply.
C.11 – Prevailing Wage This contract is subject to Davis-Bacon Act prevailing wage requirements. See FAR Clause 52.222-6 and the attached Department of Labor wage determination number CA170037.
C.12 – Buy America Act This contract is subject to the Buy American Act. See FAR Clause 52.225-9.
C.13 – Warranty Contractor shall warranty all equipment, material, design, and/or workmanship for a period of not less than 1 year from the final date of acceptance. See FAR Clause 52.246-21. All manufacturers’ equipment warranty information shall be submitted to the Contracting Officer prior to project completion. See Specifications for additional Warranty requirements specific to this project.

E.2 FAR 52.246-1 Contractor Inspection Requirements. (APR 1984)
The Contractor is responsible for performing or having performed all inspections and tests necessary to substantiate that the supplies or services furnished under this contract conform to contract requirements, including any applicable technical requirements for specified manufacturers' parts. This clause takes precedence over any Government inspection and testing required in the contract's specifications, except for specialized inspections or tests specified to be performed solely by the Government.

52.242-14 Suspension of Work. (APR 1984)
F.2 FAR 52.211-10 Commencement, Prosecution, and Completion of Work. (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 7 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 30 days from the effective date on the Notice to Proceed. The time stated for completion shall include final cleanup of the premises.
F.3 AGAR 452.236-75 Maximum Workweek - Construction Schedule. (NOV 1996)
Within 10 calendar days after receipt of a written request from the Contracting Officer, the Contractor must submit the following in writing for approval:
(a) A schedule as required by FAR clause 52.236-15, Schedules for Construction Contracts, and
(b) The hours (including the daily starting and stopping times) and days of the week the Contractor proposes to carry out the work.
The maximum workweek that will be approved is Monday through Friday from 8:00am to 5:00pm.
Weekend or holiday work is not allowed at any time during construction without written approval from the Contracting Officer.
G - SECTION G - Contract Administration Data
G.1 FAR 52.236-26 Preconstruction Conference. (FEB 1995)
If the Contracting Officer decides to conduct a preconstruction conference, the successful offeror will be notified and will be required to attend. The Contracting Officer's notification will include specific details regarding the date, time, and location of the conference, any need for attendance by subcontractors, and information regarding the items to be discussed.
G.2 Payment for Materials Off Site
In accordance with Clause 52.232-5, progress payments may include payment for materials stored off site.
Contractor shall provide a copy of the paid invoice; provide evidence that the material will be included in the finished project; and identify the location where the materials are stored, so that the government may make visual inspection if the Contracting Officer deems it necessary. The Contractor shall be liable for loss, damage, or destruction of the materials until such time as the materials are physically in the possession and control of the government. The Contractor will not be held liable to the extent that the Contracting Officer determines that the loss, damage, or destruction occurred through the fault or negligence of the government or its agents.
G.3 Incidental Items
The intent of the contract is to provide for the completion of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment of items shown.
H - SECTION H - Special Contract Requirements
H.1 AGAR 452.236-73 Archaeological or Historic Sites. (FEB 1988)
If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.
H.2 AGAR 452.236-74 Control of Erosion, Sedimentation, and Pollution. (NOV 1996)
(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).
(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.
(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

I.2 FAR 52.219-6 Notice of Total Small Business Set-Aside. (NOV 2011)
(a) Definition. “Small business concern,” as used in this clause, means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the size standards in this solicitation.
(b) Applicability. This clause applies only to–
(1) Contracts that have been totally set aside or reserved for small business concerns; and
(2) Orders set aside for small business concerns under multiple-award contracts as described in 8.405-5 and 16.505(b)(2)(i)(F).
I General. (1) Offers are solicited only from small business concerns. Offers received from concerns that are not small business concerns shall be considered nonresponsive and will be rejected.
(2) Any award resulting from this solicitation will be made to a small business concern.
(d) Agreement. A small business concern submitting an offer in its own name shall furnish, in performing the contract, only end items manufactured or produced by small business concerns in the United States or its outlying areas. If this procurement is processed under simplified acquisition procedures and the total amount of this contract does not exceed $25,000, a small business concern may furnish the product of any domestic firm. This paragraph does not apply to construction or service contracts.
I.3 FAR 52.222-5 Construction Wage Rate Requirements-Secondary Site of the Work. (MAY 2014)
(a)(1) The offeror shall notify the Government if the offeror intends to perform work at any secondary site of the work, as defined in paragraph (a)(1)(ii) of the FAR clause at 52.222-6, Construction Wage Rate Requirements, of this solicitation.
(2) If the offeror is unsure if a planned work site satisfies the criteria for a secondary site of the work, the offeror shall request a determination from the Contracting Officer.
(b)(1) If the wage determination provided by the Government for work at the primary site of the work is not applicable to the secondary site of the work, the offeror shall request a wage determination from the Contracting Officer.
(2) The due date for receipt of offers will not be extended as a result of an offeror’s request for a wage determination for a secondary site of the work.
I.4 FAR 52.225-9 Buy American – Construction Materials. (MAY 2014)
(a) Definitions. As used in this clause-
Commercially available off-the-shelf (COTS) item- (1) Means any item of supply (including construction material) that is-
(I) A commercial item (as defined in paragraph (1) of the definition at
FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.
Cost of components means-
(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph
(1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
Domestic construction material means-
(1) An unmanufactured construction material mined or produced in the United States;
(2) A construction material manufactured in the United States, if-
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
Foreign construction material means a construction material other than a domestic construction material.
United States means the 50 States, the District of Columbia, and outlying areas.
(b) Domestic preference. (1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.
(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:
(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that-
(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or
(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.
I Request for determination of inapplicability of the Buy American statute. (1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-
(A) A description of the foreign and domestic construction materials;
(B) Unit of measure;
I Quantity;
(D) Price;
I Time of delivery or availability;
(F) Location of the construction project;
(G) Name and address of the proposed supplier; and
(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.
(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph
(d) of this clause.
(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).
(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.
(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.
(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute or Balance of Payments Program.
(d) Data. To permit evaluation of requests under paragraph I of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

I.5 FAR 52.228-13 Alternative Payment Protections. (JUL 2000)
(a) The Contractor shall submit one of the following payment protections:
Payment Bond, or Irrevocable Letter of Credit.
(b) The amount of the payment protection shall be 100 percent of the contract price.
I The submission of the payment protection is required within 7 days of contract award.
(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.
I Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.
(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.
I.6 FAR 52.232-40 Providing Accelerated Payments to Small Business Subcontractors. (DEC 2013)
(a) Upon receipt of accelerated payments from the Government, the Contractor shall make accelerated payments to its small business subcontractors under this contract, to the maximum extent practicable and prior to when such payment is otherwise required under the applicable contract or subcontract, after receipt of a proper invoice and all other required documentation from the small business subcontractor.
(b) The acceleration of payments under this clause does not provide any new rights under the Prompt Payment Act.
I Include the substance of this clause, including this paragraph I, in all subcontracts with small business concerns, including subcontracts with small business concerns for the acquisition of commercial items.
I.7 FAR 52.244-6 Subcontracts for Commercial Items. (JAN 2017)
(a) Definitions. As used in this clause-
Commercial item and commercially available off-the-shelf item have the meanings contained in Federal Acquisition Regulation 2.101, Definitions.
Subcontract includes a transfer of commercial items between divisions, subsidiaries, or affiliates of the Contractor or subcontractor at any tier.
(b) To the maximum extent practicable, the Contractor shall incorporate, and require its subcontractors at all tiers to incorporate, commercial items or nondevelopmental items as components of items to be supplied under this contract.
I(1) The Contractor shall insert the following clauses in subcontracts for commercial items:
