M - SECTION M - Evaluation Factors for Award
M.1 AWARD DETERMINATION
Award will be made to the offeror whose acceptable offer provides the best value to the government, considering price and the non-price factors listed below. Non-price evaluation factors, when combined, are approximately equal to cost or price in making the award determination.
The selection official will base the award decision on a tradeoff between price and non-price factors, comparing the relative risk to the government of poor or non-performance posed by each of the offerors, and making a judgment as to whether or not reduced risk of performance is worth the additional cost. In some cases this will result in award to a lower-ranked but lower-priced offer; in other cases the result will be award to a higher-ranked but higher-priced offer.
NOTE: Failure to provide a technical proposal will disqualify you from award of the resulting contract.
M.2 PREPARING THE PROPOSAL
Offeror’s shall submit a minimum of two copies of their technical and cost proposal. Proposals shall, at a minimum, contain the items described in this section. The technical proposal will be used to evaluate and determinate whether the proposal will meet the requirements of the Government. Proposals must specifically address the goals and requirements of the specifications. Therefore, the technical proposal must present sufficient information to reflect a thorough understanding of the requirements and a detailed description of the techniques, procedures, subcontractors, and program for achieving the objectives of the specifications/statement of work. The offeror’s capabilities to accomplish the requirements of this solicitation must be clearly demonstrated. All proposals which merely offer to conduct a program in accordance with the requirements of the Government’s statement of work will be considered nonresponsive and will not be considered further.
M.3 EVALUATION CRITERIA
Acceptability of the Offer An offer is acceptable when it manifests the offeror's assent, without exception, to the terms and conditions of the RFP, including attachments. If an offeror takes an exception to any of the terms and conditions of the RFP, then the Government will consider its offer to be unacceptable.
Capability of the Offeror The Government will assess the capability of each offeror on the basis of the following criteria which are of approximately equal value: (1) Past Performance; (2) Technical Approach; (3) Past Experience.
Technical Proposal – Include the following elements:
1. Past Performance. Past performance is a measure of the degree to which an offeror satisfied its customers in the past and complied with Federal, State and Local laws and regulations.
Provide details on quality of work performed on all similar contracts within the past 5 years.
List and discuss any work not paid at full bid price. Address specific performance issues and how you mitigated the cause of those issues. Provide details regarding timeliness of performance or lack thereof. Discuss business performance statement that describes relationships and cooperation with customers. Identify the projects you have successfully completed that you consider offers evidence that proves your firm has the experience required to complete this project. Include any investigation of alleged or actual violations of labor or immigration laws committed by your firm within the past three years and the disposition of those cases.
2. Technical Approach
Understanding of the Government’s Requirements. The Government will evaluate each offeror’s relative understanding of the Government’s requirements on the basis of its written submittals addressing the following subfactors:
a) Any information that indicates the extent to which the site for this project was visited. Prospective bidders are advised that attendance at the pre-bid tour is Mandatory to be considered for award of this contract. State the name of the Contractor’s representative who attended the pre-bid tour, any revelations about the comparative difficulty of the project, and any problems that are likely to be encountered during the performance of the work.
b) The resources (personnel, equipment and subcontractors) which are planned for use on the project, and how realistic that plan is given concurrent obligations. Provide copies of Contractor or subcontractor certifications and licenses required to perform the work described as found in Section C and the Specifications.
c) Site-specific safety plan: Identify the hazards specific to the site(s) and the types of work being performed and how you plan to mitigate the risks to your workers, Government employees, and the public.
d) Plan of work: Provide a detailed Work Plan describing how you plan to accomplish the work. Include a Work Schedule that shows your ability to accomplish the project work within the required timeframe.
e) Mobilization Plan: Contractor shall provide the Government a Mobilization Plan that will describe how mobilization to the water tank will be accomplished for all work items if no road is available. The Mobilization Plan will only be used as an Evaluation Criteria if Project B Option Pay Item (Alternative 1B) is awarded.
Include detailed description of the types of equipment that will be used for mobilization, names of any subcontractors to be used, and mobilization safety plan.
f)
Quality Control Plan. The proposal shall include the offeror’s Quality Control Plan which identifies specific quality control procedures that will be followed. Discuss techniques that your firm will use to ensure that the quality control procedures are followed by your superintendent, results communicated to your crew and subcontractors, and methods to mitigate any potential problems.
3. Past Experience. Describe experience performing similar requirements during the past 5 years. Include accurate information that will allow the evaluators to contact contract administrators involved with the referenced work. Names, phone numbers, dates, locations, type of work, etc. are critical. Specifically identify a superintendent that you will provide for the performance of this contract as a Key Personnel. Provide detailed information about his/her experience. Describe what work you will directly perform and what work will be performed by a subcontractor. Provide sufficient information so that the evaluators may make contact with anyone who can verify these experiences.
4. Price Proposal. The price proposal should consist of itemized pricing as listed in the Schedule of Items. Award may not necessarily be made to the offeror submitting the lowest offer. Also, the award may not be made for technical capabilities that would appear to exceed those needed for successful performance of the work. The Government reserves the right to make cost/technical trade-offs that are in the best interest of the Government. It is anticipated that the award will be made to the firm with the best value, considering price, technical proposal, and technical capabilities.
M.4 Award Without Discussions
Award may be made without further negotiations. Proposals should be submitted initially on the most favorable terms, from a price and technical standpoint, which the offeror can submit to the Government.
However, the Government may, after evaluation of proposals, conduct further oral or written discussions, pursuant to Federal Acquisition Regulations (FAR) 13.106-2 (b) and FAR 19.808-1.
NOTE: LATE AND/OR INCOMPLETE PROPOSALS WILL BE REJECTED. SEE SECTION L.6 FOR
PROPOSAL SUBMISSION REQUIREMENTS.
M.5 452.236-70 Additive or Deductive Items (Options) (FEB 1988)
The low bidder for purposes of award shall be the conforming responsible bidder offering the low aggregate amount for the first or base bid item, plus or minus (in the order of priority listed in the schedule) those additive or deductive bid items providing the most features of the work within the funds determined by the government to be available before bids are opened. If addition of another bid item in the listed order of priority would make the award exceed such funds for all bidders, it shall be skipped and the next subsequent additive bid item in a lower amount shall be added if award therein can be made within such funds. For example, when the amount available is $100,000 and a bidder's base bid and four successive additives are $85,000, $10,000, $8,000, $6,000, and $4,000, the aggregate amount of the bid for purposes of award would be $99,000 for the base bid plus the first and fourth additives, the second and third additives being skipped because of each of them would cause the aggregate bid to exceed $100,000. In any case all bids shall be evaluated on the basis of the same additive or deductive bid items, determined as above provided. The listed order of priority need be followed only for determining the low bidder. After determination of the low bidder as stated, award in the best interests of the Government may be made on the selected first or base bid item and any combination of additive or deductive items for which funds are determined to be available at the time of the award, provided that award on such combination of bid items does not exceed the amount offered by any other conforming responsible bidder for the same combination of bid items.
