DELETE THE FOLLOWING IN SECTION M – EVALUATION FACTORS FOR AWARD:

FAR 52.212-2 Evaluation—Commercial Items. (JAN 1999)

(a) The Government will award a contract(s) resulting from this solicitation to the responsible offeror(s) whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor 1: Technical Capability Factor 2: Past Performance Factor 3: Price

Factor 1 – Technical Capability and Factor 2 - Past Performance are of equal importance, when combined, Technical Capability and Past Performance are more important than price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

DELETE THE FOLLOWING IN SECTION M – EVALUATION FACTORS FOR AWARD:

M.3.5 FACTOR 3 - Price:

Refer to Section L for proposal preparation instructions. Provide your most competitive price. Note: unit price prevails; all pricing should be in the format of dollars and cents.

Provide an outline of how prices in the schedule of items (Section B) were established; overhead and profit included in labor rate; and formula of how Offeror intends to apply profit and overhead rates.

Cost/price is of less importance than technical and past performance evaluation criteria; however, the importance of cost may become greater as the difference between technical proposals decrease. Where technical proposals are determined to be substantially equal, cost may control award.

M.3.6 Evaluation Criteria PRICE:

The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

This criterion will include consideration of cost information provided to support item prices entered in Section B, Schedule of Items. It is the Government's intent to assess the price/cost breakdown to determine (1) reasonableness, (2) and offeror's understanding of the work.

REPLACE WITH THE FOLLOWING IN SECTION M – EVALUATION FACTORS FOR AWARD:

(b) Company’s past performance experience with the use of sustainable products in construction; and

(c) Identification of past sustainable product project management experience contracts performed using sustainable products and dollar amount.

M.3.6 EVALUATION CRITERIA SUSTAINABLE PROCUREMENT PROGRAM:

The Government will evaluate offers identifying the company’s sustainable procurement program based on the response to the items identified above.
