CONTRACT CONSTRUCTION SPECIFICATIONS

Amendment 1 to AG-7442-S-12-0031 Page 5 of 8

The specifications are found in the last thirty one pages of the solicitation packet.

The only one type of specifications in this contract: (1) Construction Specifications. The construction specifications are composed of two parts. The first part is called the closed specification and is the standard NRCS construction specification that begins with the SCOPE and ends with MEASUREMENT AND PAYMENT or PAYMENT. The second part is called the open specification and consists of the ITEMS OF WORK AND CONSTRUCTION DETAILS that are written specifically for this job.

Not all of the Construction Specifications have a corresponding Bid Item. Some of the bid items have subsidiary items of work, which means those items are required to be accomplished but the payment for those items are included under another Construction Specification.

QUESTIONS AND ANSWERS:

Q1: Clearing is set up in specifications as Method 4, and payment is to be made at the lump sum amount. The bid sheet shows to be paid on an acre basis. Explain: Also what will be done with any brush piles?

A1: Although the specifications shows a lump sum basis, the bid will indicate a per acre amount, but the total should be the same as a lump sum amount. The acreage amount will not be subject to change. Any additional acreage necessary to stockpile topsoil, should be minimal and will be cleared at the contractor’s expense.

I don’t anticipate that any large brush piles will be necessary. We will avoid any unnecessary removal of large trees. I would anticipate that burn bans will be in place during the construction period. Any brush piles will remain on-site. Any materials that are not woody vegetation can be spread out over a larger area, so that no large piles will be present in the flood prone area.

Q2: There are 21,600 cubic yards of excavation shown on the bid sheet. Does this include the volume of topsoil that will be salvaged and placed on the spoil areas.

Amendment 1 to AG-7442-S-12-0031 Page 7 of 8

A2: No separate calculations have been made for topsoil and are not included in the amount shown.

Any payment for stockpiling and placing of topsoil materials shall be a part of the payment of the excavated yardage shown. No separate calculation or payment of topsoil will be made.

Q3: What is the P.I. of the soil?

A3: This area is in the flood plain of the Trinity River. This is what is commonly referred to as “made land” which is a combination of silt and clays which are deposited during large flood events.

The NRCS Web

Soil Survey shows this area to be mapped as Trinity, frequently flooded. This area has a high risk of flooding and shows a PI range from 35 to 60. For additional information and a current map of the area, you can go to the following website.

http://websoilsurvey.nrcs.usda.gov/app/WebSoilSurvey.aspx

Q4: There was a question about the necessity of Survey notes and are they to be kept.

A4: In the event of a discrepancy involving locations of practices, the contractor will be asked to produce this set of Survey notes so that these discrepancies can be resolved.

Q5: What will be the requirement of finish grade of spoil areas?

A5: Normal finishing shall be accomplished in order that the area can be maintained by usual farm equipment and can be inspected with normal vehicular traffic.

Q6: What are the requirements on the seeding of Bermuda?

A6: Areas will be seeded by any means necessary to apply the seed evenly and openly. Broadcast seeding is permissible. No culti-packing is required.

Q7: Can the Quality Control person be the same as the operator of the equipment or the superintendant on site?

A7: Problems can be encountered when the QC person is the same as the superintendant on site. It is recommended that these be two separate individual persons. The Operator/superintendant can be the Alternate QC person as long as there is another individual that can be contacted in the event of discrepancies.

Q8: Are daily QC reports required?

A8: They are not specifically required on this contract since the inspection is intermittent. It is always in the best interest of the contractor to keep a daily narrative of what work is accomplished and any problems that may develop in the event of future problems that may be encountered.

Q9: Are certified payrolls required?

http://websoilsurvey.nrcs.usda.gov/app/WebSoilSurvey.aspx

Amendment 1 to AG-7442-S-12-0031 Page 8 of 8

A9: The timing of these payrolls is not that critical, but invoices will not be processed without certified payrolls.

Q10: A question came up regarding the access road and its maintenance during the contract period.

A10: The roadway may be smoothed to facilitate access to the worksite. Any widening of the roadway in excess of equipment widths needs prior approval by the COR in consultation with the landowner.
