The Inspector and Project Engineer will have delegated authority to suspend work for any noncompliance with safety requirements that poses a serious or imminent danger to the health or safety of the public and/or personnel of the Contractor, NRCS, or local Sponsors.

The Supplement to OSHA 1926 and 1910 emphasizes several specific safety items which must be understood by the Contractor prior to bidding this job. Among these items are the requirements for:

1. Written plan for accident prevention and safety (CO must approve prior to beginning work).

2. First aid certificates

3. First aid facilities

4. Safety Meetings, weekly “tool box” and monthly

5. Dust control

Hard hats shall be worn on the job site at all times and equipment shall be outfitted with working backup alarms, seat belts, and approved roll-over protective structures.

All equipment shall be inspected by the NRCS Construction Inspector prior to use on the project.

4. Questions and Answers:

Q: Will work be allowed on Saturday or Sunday?

A: No. Maximum allowable working hours are currently set to eight hours per day, Monday through Friday, excluding federal holidays. If requested, Saturday work or longer working hours may be allowed by the Contracting Officer, on a case by case basis, for extraordinary circumstances (i.e., completing a site or critical portion of work immediately prior to forecasted rains). Additional working hours or days will not be considered to make up delays or complete the work within the specified Contract Time.

Q: Will other prospective bidders, not present at the site showing, be allowed to submit bids for the work?

A: Yes. Attendance at the site showing is non-mandatory.

Q: What constitutes a “rain day”?

A: Adverse weather that precludes work for ½ or more of any regular work day. Rain events prior to starting work, or during any other non-working day (i.e., Sundays, federal holidays, or during the fixed shutdown) shall not be considered as rain days for extension of the Contract Time.

Q: Will gate locks be required or supplied?

A: Yes. Contractor will provide a keyed or combination lock to be used in series with existing locks on gate(s) used for access. Refer to Amendment No. 1.

Amendment 1 to AG-7442-S-12-0022 Page 6 of 7

Q: What about erosion resulting from pump outlets for dewatering?

A: During construction the contractor is responsible for the site and the correction of any damage to the site resulting from its operations, until the COTR certifies the site as complete. Refer to FAR 52.236-9.

Q: Will toes be staked on the proposed dike construction?

A: Yes. To facilitate yardage calculation, toes will be staked for the proposed dike and habitat mounds.

Q: Will topsoil be required to be stripped from under the habitat mound areas before placement of fill?

A: Yes. Placement of fill for the habitat mounds follows under the same specification as that for a dike.

Q: Will topsoil be considered in the payment yardage?

A: Yes. Topsoil placed will be considered in the yardage measured for payment.

Q: Do any of the work areas require tree removal?

A: No. None of the proposed work areas are expected to include tree removal.

Q: Are concrete anchors required at the ends of the pipes?

A: No. The standard drawing used for the water control structure (TX-EN-0458, Sheet 1/3) shows a concrete block but the applicable “Not Required” line is checked.

Q: Will the core trench be required to extend two feet deep as indicated?

A: Yes. Estimated yardage is based on two-foot depth of core trench. Differing moisture conditions in the time since the original design work may allow a shallower core trench, as approved by Engineer/COR, in lieu of the two foot depth indicated. In no event will the core trench be shallower than one foot below existing normal ground.

Q: How smooth should the finished tops of the habitat mounds be?

A: Placement of fill in the habitat mounds is identical to that specified for the dike (not to exceed nine-inch lifts, particle size not to exceed six inches). Compliance with those requirements should result in sufficiently smooth mound surfaces. Completed mounds will be surveyed to determine payment yardage, and smoother surfaces will allow more precise measurements.

Q: Is the concrete base for the riser specified as a “5-sack mix”?

A: Yes. Refer to note on TX-ENG-0458, Sheet 2/3.

Q: Are underground utilities present at the work sites?

A: No readily apparent, conflicting underground utilities were identified during the surveys of the work sites. Contractor is responsible for utilities clearance, and potential damages from failure to obtain clearance, in accordance with the Texas Excavation Safety System (Dig-TESS).

Q: Are there pipe suppliers in the area?

A: Yes. The following metal pipe vendors are available in the area (listed in no particular order):

Mayfield Pipe, 1500 State Highway 60, Bay City, Texas 77414, (979) 245-0068

Seabreeze Culvert, P.O. Box 6, Stowell, Texas 77661, (409) 296 4098

South Texas Corrugated Pipe, 1610 State Highway 60, Bay City, Texas 77414, (979) 245-6666

Q: Will construction staking be provided for both projects?

A: Yes (centerline and toes for dike, perimeter for shallow water habitats and habitat mounds).

Q: Is hydro-mulch an approved covering?

Amendment 1 to AG-7442-S-12-0022 Page 7 of 7

A: No hydro-mulching or planting is required. Vegetation restoration will be addressed by a separate solicitation.

Q: Is there a geotechnical report for these projects?

A: No. Available soil survey information indicates the sites consist of “Pledger” clay (unified classification “CH”, plasticity index greater than 35).

Q: Is there a local manufacturer that sells the water control structure?

A: Yes. See possible sources above.

Q: Will any additional fill material be required from offsite supplier?

A: No offsite fill is required.

Q: Who will take care of permits, if any?

A: Any permits required are the Contractor’s responsibility per FAR 52.236-7. None are anticipated.
