SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C-1 DESCRIPTION OF WORK

Work entails road blading, constructing/reconstructing drainage dips and check dams, installation of straw wattles, removal and replacement of two corrugated metal pipes, construction of two low water crossings, installation of a gabion structure, and the placement of riprap and aggregate.

C-2 PROJECT LOCATION: Dawers & Sioux Counties, Nebraska

SECTION 101 - DEFINITION OF BID ITEMS

AND

MEASUREMENT AND PAYMENT

DELETE ENTIRE SECTION AND REPLACE WITH THE FOLLOWING:

PART 1 - GENERAL

SUMMARY

0. The intent of this section is to explain, in general; what is and what is not included in a bid item; the limits or cut-off points where one bid item ends and another begins; and method of measurements and basis of payment for work items listed in the Bid Item Schedule.

Work:

Furnishing all labor, materials, equipment, and other incidentals necessary to successfully complete the project or any portion of it, and carrying out all duties and obligations imposed by the contract on the Contractor.

Payment:

For each individual item listed here and in the Schedule of Items, payment shall be full compensation for all work related to the particular item in accordance with these specifications, as shown on the drawings, and as staked in the field.

Measurement and payment for contract work shall be made only for and under those pay items included in the Schedule of Items. All other work and materials shall be considered incidental or as included in the payment for items shown.

DETERMINATION OF QUANTITIES

0. The contractor shall perform, or cause to be performed, all measurement of quantities of materials incorporated into the work processes that are to be measured under the provisions of the contract.

Quantity Measurements:

The Contractor shall make all measurements for computation of quantities for all work items except those specified for payment by Designed Quantity (DQ) or Lump Sum Quantity (LSQ).

The contractor shall compute the quantities for periodic progress payments; the Contracting Officer shall compute the quantities for the final payment based on measurements taken by the Contractor.

All Contractor measurements are subject to verification.

The Contractor shall submit all field notes, calculation sheets, and other data used to determine quantities.

The Contractor shall certify in writing as to the accuracy of the measurements and computations submitted.

The following measurements and calculations are used to determine contract quantities.

For individual construction items, longitudinal and lateral measurements for area computations shall be made horizontally or corrected to horizontal measurement unless otherwise specified. Measurements for straw wattles shall be along slope lines.

The average end area method shall be used to compute volumes of excavation or embankment. However, if in the judgment of the Contracting Officer (CO), the average end area method is impractical, measurement shall be made by volume in hauling vehicles or by other three dimensional methods.

Structures shall be measured according to neat lines shown on the drawings or as altered by the CO, in writing, to fit field conditions.

For items that are measured by the linear foot, such as pipe culverts, fencing, guardrail, and underdrains, measurements shall be made parallel to the base or foundation upon which the structures are placed. Pipes shall be measured along center of invert.

For aggregates weighed for payment, the tonnage shall not be adjusted for moisture content, unless otherwise provided for.

For standard manufactured items--such as fence, wire, plates, rolled shapes, pipe conduits--identified by gauge, weight, section dimensions, and so forth, such identifications shall be considered the nominal weights or dimensions. Unless controlled by tolerances in cited specifications, manufacturer's tolerances shall be accepted.

UNITS OF MEASUREMENT

0. Payment shall be by units defined and determined according to U.S. Standard measure and by the following:

Cubic Yard: A measurement computed by one of the following methods:

Excavation, Embankment, or Borrow. The measurement computed by the average end area method from measurements made longitudinally along a centerline or reference line.

Material in Place or Stockpile. The measurement computed using the dimensions of the in-place material.

Material in the Delivery Vehicle. The measurement computed using measurements of material in the hauling vehicles at the point of delivery. Vehicles shall be loaded to at least their water level capacity. Leveling of the loads may be required when vehicles arrive at the delivery point.

Each: One complete unit, which may consist of one or more parts.

Linear Foot: Linear feet measured horizontally.

DEFINITION OF BID ITEMS

0. Definition Bid Item No. 01 Description: Mobilization. All preparatory work and operations necessary for the movement of personnel, equipment, supplies, and incidentals to the project sites; all construction signing; any other work and operations that must be incurred prior to the beginning of work and demobilization at the completion of work.

Measurements and Payment: LSQ, LS Definition of Bid Item No. 02 Description: Soil Erosion: Installation of straw erosion control logs along Road #702. Work includes:

Place 200 straw erosion control logs at designated locations and install anchors per manufacturer’s recommendations. Locations shall be uphill and/or downhill from the roadway and at leadoff ditches locations as staked.

Measurement and Payment: AQ, EA Definition of Bid Item No. 03 Description: Soil Erosion: Installation of straw erosion control logs along Road #945. Work includes:

Place 300 straw erosion control logs at designated locations and install anchors per manufacturer’s recommendations. Locations shall be uphill and/or downhill from the roadway and at leadoff ditches locations as staked.

Measurement and Payment: AQ, EA Definition of Bid Item No. 04 Description: Road Reconstruction on Road #702. Work includes:

Reconstruct designated section of the existing roadway (1.55 miles). Blading activities shall provide for positive drainage into the drainage dips and leadoff ditches; remove rutting; and shaping the roadway to allow for vehicular passage as Shown on the Drawings.

Construct/reconstruct drainage dips and leadoff ditches at designated locations.

Repair a washout as located on the ground as Shown on the Drawings.

Remove the existing CMP at the washout location as Shown on the Drawings.

Install six (6) gabions at the washout area as Shown on the Drawings.

Remove woody debris at the entrance and exit areas of the CMP at the creek crossing at Station 41+83. Remove all brush/trees and reshape entrance area and exit area of CMP to match the surrounding contours.

Work may include removing down trees from the road way. These trees shall be pushed off the road downhill.

Measurements and Payment: LSQ, LS Definition of Bid Item No. 05 Description: Road Reconstruction on Road #706. Work includes:

Remove two (2) existing CMPs at designated locations. Replace with two (2) specified arch CMPs at the same locations.

Construct two (2) low water crossings at designated locations as Shown on the Drawings. Low water crossings to include riprap and road base aggregate placement.

Measurement and Payment: LSQ, LS Definition of Bid Item No. 06 Description: Road Reconstruction on Road #945. Work includes:

Reconstruct the designated section of existing roadway (0.5 miles). Remove the rutting and shape the roadway grade as Shown on the Drawings.

Construct/reconstruct drainage dips and check dams as Shown on the Drawings at designated locations.

Work may include removing down trees from the roadway. These trees shall be pushed off the road downhill.

Measurement and Payment: AQ, Mile Definition of Optional Bid Item No. 07 Description: Road Reconstruction on Road #702. Work includes:

Reconstruct designated sections of the existing roadway (0.61 miles) as Shown on the Drawings. Blading activities shall provide for positive drainage into the drainage dips and leadoff ditches; remove rutting; and shaping the roadway to allow for vehicular passage as Shown on the Drawings.

Measurement and Payment: AQ, Mile

PART 2 - METHOD OF MEASUREMENT

GENERAL

0. One of the following methods of measurement for determining final payment is designated on the Schedule of Items for each pay item:

ACTUAL QUANTITIES (AQ)

These estimated quantities which are determined from actual measurements of completed work.

LUMP SUM QUANTITIES (LSQ)

These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job. They shall not be measured.

PART 3 - METHOD OF PAYMENT

GENERAL

0. One of the following methods of payment for determining final payment is designated on the Schedule of Items for each pay item:

EACH (EA):

This method denotes payment for each individual item described.

LUMP SUM (LS):

This method denotes payment for a unit of work.

MILE (Mile):

This method denotes payment for each mile of roadway work completed.

SUPPLEMENTAL SPECTIFICATIONS

SECTION 103 - SUMMARY OF WORK

DELETE THE ENTIRE SECTION AND REPLACE WITH THE FOLLOWING:

PART 1 - GENERAL

SUMMARY

0. Work to be performed for roadway rehabilitation work on three (3) roads on the Pine Ridge Ranger District. Work will be at designated locations along each road.

Road #702 (Coffee Mill Butte): Work shall include construction/reconstruction of drainage structures, lead-off ditches, and check dams; removal of an existing 15 inch dia. by 12 ft. long corrugated metal pipe (CMP); installation of six (6) gabions structures; installation of straw wattles; and reconstruction of 1.55 miles of designated road travel way.

Road #945 (Eagle Eye): Work to include construction of drainage structures and check dams; installation of straw wattles; and reconstruction of 0.5 miles of designated road travel way.

Road #706 (East Ash): There are two (2) project locations. Work includes removing the two (2) existing 18 inch dia. by 24 ft. long steel CMP’s and replacing them with two (2)-42 inch by 29 inch by 24 ft. long arch CMP’s; constructing two (2) low water crossings; and placing riprap and road base aggregate at both locations as Shown on the Drawings. Low water crossings shall be constructed as Shown on the Drawings.

Option Bid Item #7 – Road #702 (Coffee Mill Butte): Work shall include the reconstruction of designated 0.61 miles of Road #702. Work items are roadbed, drainage dip, and leadoff ditch reconstruction.

The Government shall stake all work to be completed on this project. A project log shall be submitted to the Contractor at a pre-work meeting.

LOCATION

0. This project is located at three (3) locations on the Pine Ridge Ranger District. One (1) is on the Oglala National Grasslands (Eagle Eye Road #945) and two (2) are located on the Pine Ridge Unit (East Ash Road #706 and Coffee Mill Butte Road #702). All work shall be performed along the specified sections of road as Shown on the Drawings.

SPEC WRITER: RETAIN PARAGRAPH BELOW IF PROJECT IS ON A VACANT SITE OR IN AN UNOCCUPIED BUILDING BEING RENOVATED AND THERE ARE NO OWNER-OCCUPANCY REQUIREMENTS. REVISE TO SUIT PROJECT.

General: All specified work sections of these roads shall be closed for construction operations during the construction period. Contractor shall install the appropriate signs and barricades according to MUTCD standards. The Government shall release press statements stating these roads as closed during the construction period.

Confine storage of materials to areas as approved by the Contracting Officer (CO).

Preservation of Natural Features: Confines all operations to work limits of the project. Prevent damage to natural surroundings. Restore damaged areas, repairing or replacing damaged trees not designated for removal, at no additional expense to the Government.

Do not remove, injure, or destroy trees or shrubs outside of the clearing limits without prior approval.

Do not fasten ropes, cables, or guys to existing trees.

Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage.

Existing Utilities: Notify CO and utility companies of proposed locations and times for excavation.

Contractor shall be responsible for contacting Diggers Hotline. There is a buried fiber optics line in the #702 roadway in the designated work area.

SPEC WRITER INSERT ADDITIONAL PARAGRAPHS TO SPECIFY MINOR RESTRICTIONS ON CONTRACTOR'S USE OF PREMISES OR TO SPECIFY MINOR LIMITATIONS BECAUSE OF OWNER OCCUPANCY.

FIRE RESTRICTIONS

0. Depending on conditions, normal fire restrictions may apply to activities associated with this project. Contractor will be required to have all appropriate fire safety equipment on hand at all times.

FIELD VERIFICATION

0. A pre-bid field visit is suggested. The Contractor shall field verify all new and existing dimensions affecting the work of this contract before ordering products.

PERMITS

0. Any permits required by local, State, or Federal laws or regulations shall be obtained by the Contractor.

SECTION 105 - SUBMITTAL PROCEDURES

PART 1- GENERAL

SUMMARY

This Section includes administrative and procedural requirements for submitting Shop Drawings, Product Data, Samples, and other miscellaneous submittals.

SUBMITTAL PROCEDURES

0. Processing Time: Allow enough time for submittal review, including time for re-submittals, as follows. Time for review shall commence on Contracting Officer’s (CO) receipt of submittal.

Initial Review: Allow 5 days for initial review of each submittal. Allow additional time if processing must be delayed to permit coordination with subsequent submittals. CO will advise Contractor when a submittal being processed must be delayed for coordination.

Allow 5 days for processing each re-submittal.

No extension of the Contract Time will be authorized because of failure to transmit submittals enough in advance of the Work to permit processing.

Deviations: Highlight, encircle, or otherwise identify deviations from the Contract Documents on submittals.

Additional Copies: Unless additional copies are required for final submittal, and unless CO observes noncompliance with provisions of the Contract Documents, initial submittal may serve as final submittal.

Use for Construction: Use only final submittals with mark indicating action taken by CO in connection with construction.

PART 2 – PRODUCTS

SUBMITTALS

0. General: Prepare and submit Submittals required for the Soil Erosion Control and anchor materials, Riprap material, Gabion materials, and the Minor Crushed Aggregate material.

Number of Copies: Submit three copies of each submittal, unless otherwise indicated. CO will return two copies. Mark up and retain one returned copy as a Project Record Document.

Product Data: Collect information into a single submittal for each element of construction and type of product or equipment.

Mark each copy of each submittal to show which products and options are applicable.

Include the following information, as applicable:

Manufacturer's written recommendations.

Manufacturer's product specifications.

Manufacturer's installation instructions.

Manufacturer's catalog cuts.

Compliance with recognized testing agency standards.

PART 3 – EXECUTION

GENERAL

0. Review each submittal and check for compliance with the Contract Documents. Note corrections and field dimensions. Mark with approval stamp before submitting to CO.

Submittals not required by the Contract Documents will not be reviewed and may be discarded.

DIVISION 150 – PROJECT REQUIREMENTS

SECTION 156 – PUBLIC TRAFFIC

DESCRIPTION

156.01 This work consists of controlling and protecting public traffic within the project area.

MATERIAL

156.02 All road closure signs and barriers shall conform to MUTCD standards.

GENERAL

156.03 The Contractor shall close the existing specified roads while construction work is being conducted. Coordinate with the Government on placement of MUTCD approved traffic control devices. All required signage will be in-place and approved prior to the beginning of project work.

The Government shall have press releases prior to the start of project work stating the specified roads are closed to vehicular traffic.

TEMPORARY TRAFFIC CONTROL

156.04Install and maintain temporary traffic control devices within the project area as follows:
1.Furnish and install traffic control devises before the start of construction operations.
2.Relocate temporary traffic control devises as necessary.
3.Remove devices that no longer apply to the existing conditions.
4.Immediately replace any device that is stolen or inoperative.
5.Keep traffic control devises clean.
6.Remove all traffic control devices at the completion of the contract.

ACCEPTANCE

156.05 Public traffic work will be evaluated by visual inspections during contract time frame.

MEASUREMENT and PAYMENT

156.06 Measurement and payment are indirect costs to mobilization and will be paid as such.

1 CONSTRUCTION REQUIREMENTS

A. GENERAL

15. Remove all rocks, brush, down timbers in-line with the installation of the straw wattles.

Install all materials per manufacturer’s recommendations.

Place all materials in a smooth and relatively wrinkle free condition. Fold or cut materials to conform to curves or other non-liner alignment as staked (such as leadoff ditches).

Normal fire restrictions shall apply to activities associated with this project.

PART 2 – ACCEPTANCE

0. Geotechnical installation shall be evaluated during visual inspections.

DIVISION 200 - EARTHWORK

SECTION 204 - EXCAVATION & EMBANKMENT

DELETE THE ENTIRE SECTION AND REPLACE WITH THE FOLLOWING:

PART 1 - GENERAL

0. SUMMARY

This work shall consist of constructing/reconstructing drainage dips and leadoff ditches.

Excavation for drainage dips and check dams shall consist of the excavating material from the roadbed or backslope adjacent to the roadbed. If material is removed from the roadbed, do not create a low spot in roadway that does not drain to drainage dip or check dam.

Excavation for leadoff ditches shall be rolled over to the downhill side of the ditch creating a berm.

Borrow excavation shall consist of the excavation and utilization of material from the site.

MEASUREMENT

Quantities of excavation shall be incidental to associated work as described in the Bid Schedule:

Drainage dip construction/reconstruction Leadoff ditch construction/reconstruction.

Check dam construction/reconstruction.

Borrow material used in construction/reconstruction of the drainage dips.

PAYMENT

The accepted work shall be incidental to the contract unit price for each associated pay item shown in the BID SCHEDULE.

PART 2 – PRODUCTS

PART 3 – EXECUTION

0. CLEARING & GRUBBING

Any tree or other woody debris that has fallen across the roadway prior to work shall be pushed off the roadway so that it does not interfere with any work activities.

UTILIZATION OF EXCAVATED MATERIALS

All suitable, excavated material shall be used in the reconstruction of drainage dips and check dams.

Excess Excavation:

Excess excavation shall be disposed of on-site by spreading the material on the road way.

Excavation of Unsuitable Material:

Unsuitable material shall consist of material with vegetative materials such as brush, grasses, pine needles, and/or woody materials within the excavation. This material shall be disposed of on-site as directed.

Frozen material shall not be used.

LEADOFF DITCH EXCAVATION

Leadoff ditch excavation shall include either of construction of a lead-off ditch associated with or without the drainage dip. Lead-off ditch shall be a maximum 25 ft. long.

FINISHING SLOPES

The back slope of a leadoff ditch shall be rounded off as much as possible.

DRAINAGE DIPS and CHECK DAMS A drainage dip or check dam shall be constructed as staked and Shown on the Drawings. Material used in the construction of the drainage dip and check dam shall be existing material from the travel way or the adjacent embankment.

Material used for drainage dips and check dam construction shall contain no frozen material, roots, sod, or other vegetative material.

Add: Gabion basket material shall be fabricated mesh for galvanized or aluminized coated baskets. The mesh may be either twisted wire mesh or welded wire mesh. Other material to be used shall be approved by the Contracting Officer.

The rock used shall be a minimum of 4 inch dimension and a maximum of 8 inch in dimension or as approved by the Contracting Officer. The material shall come from a commercial source.

The #4 rebar shall be free of rust at time of installation.

F-2 FAR 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 75 calendar days after the date the contractor receives the notice to proceed. The time stated for completion shall include final cleanup of the premises.

SECTION G--CONTRACT ADMINISTRATION DATA

G.1 DESIGNATION OF CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer will designate a Contracting Officer's Representative (COR) at the time of contract award.

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

The Contracting Officer should be informed as soon as possible of any actions or inactions by the Contractor or the Government which will change the required delivery or completion times stated in the contract, and the contract will be modified accordingly. (This does not apply to individual task assignments which were issued by the COR provided they do not affect the delivery schedule or performance period stated in the contract).

On all matters that pertain to the contract terms the Contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the Contracting Officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

G.2 AGAR 452.215-73 POST AWARD CONFERENCE (NOV 1996)

A post award conference with the successful offeror is required. It will be scheduled and held within 10 days after the date of contract award. The conference will be held at Forest Service Office, Chadron, NE.

SECTION H--SPECIAL CONTRACT REQUIREMENTS

H-1 FAR 52.236-4 Physical Data (APR 1984)

Data and information furnished or referred to below is for the Contractor's information. The Government shall not be responsible for any interpretation of or conclusion drawn from the data or information by the Contractor.

(a) The indications of physical conditions on the drawings and in the specifications are the result of site investigations by actual conditions.

(b) Weather conditions are seasonal for Chadron Nebraska area. Average summer temperature of 72 degrees F and average winter temperature of 23 degrees F. The temperature may get above 100 degrees F at times during the summer and below 0 degrees F during the winter.

(c) Transportation facilities consists of public highways and secondary county roads. Weight limitations on primary and secondary roads apply during spring thaw.

H-2 AGAR 452.228-71 INSURANCE COVERAGE (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

H-3 Conformity with Drawings and Specifications

Unless working tolerances are specified, all work performed and materials furnished shall be in reasonably close conformity with lines, grades, cross sections, dimensions, and material requirements shown on the drawings, indicated in the specifications, or designated on the ground. "Reasonably close conformity" is in compliance with reasonable and customary manufacturing and construction tolerances.

A. Definition. "Work" includes, but is not limited to, materials, workmanship, and manufacture and fabrication of components.

B. The Contractor shall maintain an adequate inspection system and perform such inspections as will ensure that the work performed under the contract conforms to contract requirements. The Contractor shall maintain complete inspection records and make them available to the Government. All work shall be conducted under the general direction of the Contracting Officer and is subject to Government inspection and test at all places and at all reasonable times before acceptance to ensure strict compliance with the terms of the contract.

C.Government inspections and tests are for the sole benefit of the Government and do not--
1.Relieve the Contractor of responsibility for providing adequate quality control measures;
2.Relieve the Contractor of responsibility for damage to or loss of the material before acceptance;
3.Constitute or imply acceptance; or
4.Affect the continuing rights of the Government after acceptance of the completed work under paragraph (I) below.

D. The presence or absence of a Government inspector does not relieve the Contractor from any contract requirement, nor is the inspector authorized to change any term or condition of the specification without the Contracting Officer's written authorization.

E. The Contractor shall promptly furnish, without additional charge, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. The Government may charge to the Contractor any additional cost of inspection or test when work is not ready at the time specified by the Contractor for inspection or test, or when prior rejection makes reinspection or retest necessary. The Government shall perform all inspections and tests in a manner that will not unnecessarily delay the work. Special, full size, and performance tests shall be performed as described in the contract.

F. The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. The Contractor shall promptly segregate and remove rejected material from the premises.

G. If the Contractor does not promptly replace or correct rejected work, the Government may (1) by contract or otherwise, replace or correct the work and charge the cost to the Contractor or (2) terminate for default the Contractor's right to proceed.

H. If, before acceptance of the entire work, the Government decides to examine already completed work by removing it or tearing it out, the Contractor, on request, shall promptly furnish all necessary facilities, labor, and material. If the work is found to be defective or nonconforming in any material respect due to the fault of the Contractor or its subcontractors, the Contractor shall defray the expenses of the examination and of satisfactory reconstruction. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

I. Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government's rights under any warranty or guarantee.

H-4 Safety

Identify inherently hazardous conditions that could lead to serious injury or loss of life.

Identify and describe inherently hazardous conditions.

Recognize hazards when contracting for inherently hazardous working conditions.

When inherently hazardous conditions exist, the contract should require a written, job-specific safety plan for information and discussion at the post award meeting.

Plan to reduce safety hazards and the costs of litigation.

Make sure that inherently hazardous conditions are documented and are written up in a job-specific Job Hazard Analysis (JHA) for Forest Service employees involved. This will help identify hazards involved in the job.

For each contract evaluate working conditions to determine if specific inherently hazardous conditions will be encountered as part of the needed construction work. If these conditions do exist, they need to be listed in the contract.

H-5 Suspensions for Other Than Government’s Convenience The Contracting Officer may issue orders to suspend the work wholly or in part for such period of time as deemed necessary because of: (1) Weather or ground conditions when further prosecution of the work might cause environmental or resource damage to the project, access roads to the project, or adjacent property. Such action would include but not be limited to instances such as siltation of streams, damage to access roads, rutting of project roads which causes otherwise suitable soils to become muddy or unsuitable; or (2) Failure of the Contractor to comply with Specifications such as but not limited to placement of frozen material in fills, placing of asphalts at temperatures lower than those specified, performing work prior to prerequisite approvals, operating equipment not meeting fire requirements, or when conditions exist which do not meet safety requirements. Whether or not a suspend work notice is issued, the Contractor shall be responsible for correcting any damage caused by his/her operation, whether inside or outside project limits, at no cost to the Government. Such suspensions shall not be considered as suspensions for the Convenience of the Government under FAR 52.242-14, Suspension of Work, and shall not qualify for equitable adjustment.

H-6 CONTRACTOR PERFORMANCE ASSESSMENT SYSTEM (CPARS) PROGRAM

This contract will be subject to reporting in the Contractor Performance Assessment System (CPARS) program. Contractors are encouraged to take training and register in this program. Information can be found at:

H- 7 Contract Administration

(a) CONTRACTING OFFICER means a person with the authority to enter into, administer and/or terminate contracts and make related determinations and findings. The Contracting Officer signs all contractual documents, approves and signs all modifications to contracts, processes and approves payment requests, reviews and makes final decisions on contractual discrepancies, and administers the contract. The Contracting Officer is the only authorized individual to make changes to a contract.

(b) CONTRACTING OFFICER'S REPRESENTATIVE. The Contracting Officer will designate a representative, hereinafter referred to as the Contracting Officer's Representative (COR) or, alternatively, as the Engineer, who will provide on-the-ground administration for the Government. The COR will be designated in writing and a copy of the designation will be furnished to the Contractor before or at the pre-work conference. The Contractor is cautioned to read the COR designation because certain authority under the contract is reserved solely for the Contracting Officer. The term "Contracting Officer" as used throughout the contract shall be interpreted to include the Contracting Officer's designated representative(s) acting within the limits of their delegation of authority.

(c) CONTRACTOR'S REPRESENTATIVE. Any representative of the Contractor shall be designated in writing. The designation shall clearly indicate the name and limitations of authority, if any, of the representative.
