Hiawatha National Forest Roadside Mowing Description/Specifications/Work Statement

Scope It is the intent of this contract to secure services for roadside mowing on various forest system roads within the Hiawatha National Forest with equipment capable of performing this type of work. All work under this contract will be located on the West Side of the Forest in the Munising and Rapid River/Manistique Ranger Districts. The Contractor shall furnish all labor, equipment, supervision, transportation, supplies, safety equipment, insurance and incidentals, and comply with these specifications and drawings. Once work starts, the Contractor will work continuously until contract money is exhausted unless otherwise directed by the Engineer.

Location and Description The roads are located on the West side of the Hiawatha National Forest in Delta, Schoolcraft, and Alger counties of Michigan. The Contractor will be notified of roads requiring work with a minimum of 10 days advance notice. This project will have four different types of roadside mowing and brushing. The types will be referred to by the FS Road maintenance levels. The types are level 2, 3, 4 and 5. The greatest percentage of work will be along the maintenance Level 2 roads. These roads are single lane low speed roads with primarily a native surface traveled way. These roads were originally cleared to a minimum width of 18 to 24 feet. At present these roads may have vegetation growing into the traveled way leaving cleared width as narrow as 8 feet. As shown on the drawings the brushing and mowing zone is measured from the original edge of the road traveled way. The levels 3, 4 and 5 are primarily 2 lane roads that require primarily mowing with very little brushing. The higher the number of the maintenance level usually indicates wider clearing widths, higher travel speed and larger volume of traffic.

Pre-work Meeting Prior to starting work, the Engineer will coordinate a pre-work meeting with the Contractor identifying which roads to mow, coordination, what equipment will be used, etc. At this meeting, the Contractor will supply 3 copies each of the following submittals printed on Contractor’s company letterhead. Work will not start until all submittals are received and approved.

1. Safety plan including but not limited to emergency numbers (fire, hospital, 911, point of contacts for workers, company phone number, etc.).

2. All pertinent phone/page/cell numbers for workers on project, superintendents, foremen, office, etc.

3. Certification of heavy equipment operator’s experience in operation of that piece of equipment (such as how long they have operated the equipment, type of terrain, etc.)

4. Schedule of work (how many workers, equipment, hours working per day, etc.)

5. Equipment data including but not limited to make, model, year, HP, capacities in cutting, widths of cutting, etc.

6. Sample of Contractor’s Daily log which will be used to daily report personnel on job, hours worked, equipment used, problems occurred, quantity of work accomplished, etc.

7. Certification of sawyers experience in the operation of a chain saw to fall, limb and buck up living and fallen trees (such as how long they have operated a saw, type of terrain, etc.). Sawyer is not required to work from a bucket truck or climb trees to prune or limb.

8. Weekly cost tabulations of what the Government will be charged for the current week and a total tabulation of charges for the life of the contract up to the end of the current week. This submittal is not required before work can commence. However, if this submittal is not provided weekly to the Engineer/COR, then the Contractor will be shut down, at no cost to the Government, until this submittal is complete.

Roadside Treatment

(a) Roadside treatment shall be performed to meet the cross section drawing included with these specifications. All vegetation, grasses, brush and woody material having a diameter of 4 inches or less at breast height and located within the designated cutting area shall be cut and masticated with a rotary mower designed to cut and masticate. Cutting height shall not exceed 6-inches above the ground surface or obstructions such as rocks or existing stumps.

(b) Signs, markers, and other road appurtenances shall not be damaged or defaced during operations. Any damage to these items will be replaced by the Contractor at no cost to the Government. If other items are to remain, they shall be marked on the ground or specified in a work order.

(c) Maintenance level 2 roads may have downed trees or larger limbs across the traveled way. These trees are to be cut, limbed and bucked up into lengths that facilitate scattering . The stems (trunks) and limbs are to be removed from the traveled way and scattered within the original clearing limits. Stems are to be cut off 3 feet beyond the edges of the traveled way or beyond the backside of the ditches. The sawed up Logs, stems, limbs and slash are to be kept out of or removed from ditches and the end of culverts and scattered. The downed trees and limbs are the property of the Forest Service.

(d) Any damages to tree trunks caused by the operation shall be treated with a commercial nursery sealer by the Contractor at no cost to the Government.

Debris disposal Debris resulting from all operations that is larger than 1 inch in diameter or 3 feet in length that falls in the traveled portion of the roadway, the mowing/brushing zone or in culvert inlets and outlets, shall be disposed of outside of the clearing limits (beyond the existing tree line).

Pollution abatement Lunch bags, paper, fuel and equipment waste, etc., shall be placed in containers and removed from the work area, or disposed of as approved by the Contracting Officer.

Equipment All equipment shall be the proper type and size to perform the tasks so indicated. Equipment shall be in good mechanical condition.

The mower shall be a side-mounted or articulated boom arm rotary type with a protective shroud or deck to direct cutting downward and limit the amount of cuttings expelled from the underside. The mower shall have the capability of cutting a 5-foot width swath per pass. The tractor shall be equipped with a rotating amber light visible for 360 degrees, roll over protection structure, a safety screen, impact resistant glass, or an enclosed cab, and a spark arrestor. Tractor shall have a slow moving vehicle sign visible to rear.

Safety Prior to the beginning of operations on a particular road, a reflective black on orange warning sign shall be in place to notify individuals of operations. Advance warning signs shall be placed at road intersections on each end of the road. Signs shall not exceed a spacing of 6 miles. Sign No. W21-4 “road work ahead”, or W21-3 “road machinery ahead”, can be used. For dead end Maintenance Level 2 roads a single sign is to be placed at the road intersection where the mowing/brushing begins.

All signs shall be removed immediately following operations. All warning signs shall be provided by the Contractor and shall be in accordance with the current edition of the “Manual on Uniform Control Devices”. The roads shall be available for use by regular traffic with a minimum of delay.

The operator shall operate the machinery in a safe manner. Any debris requiring removal from the road shall be removed immediately so traffic safety is not adversely affected. The rotary amber light shall be operating whenever the mower is occupying the roadbed or mowing area.

The contractor and his employees are to comply with the U.S. Department of Labors Occupational Safety and Health Standards for Chain saw operations. The regulations are found in (Standards – 29 CFR); Part Number: 1910; Part Title: Occupational and Health Standards; Subpart: R, Subpart Title: Special Industries, Standard Number: 1910.266, Title: Logging Operations. Applicable paragraphs are 1910.266(a), 1910.266(b)(1), 1910.266(c), 1910.266(d)(1) sub paragraphs (i) through (vii) , 1910.2669d)(2), 1910.266(d)(2)(ii) and all of 1910.266(e)(2).

Measurement and payment Payment will be as determined by the Bid Schedule. Partial payments can be requested for work accepted by the Engineer on a biweekly basis. Vehicle hourly price will include everything required to keep that piece of equipment operating (mobilization, operator, equipment, supervision, transportation, supplies, and incidentals). Clock time will begin when equipment begins brushing or mowing and end when equipment stops brushing or mowing. Equipment will only be paid for time worked, not time on job. Production rates will be expected to roughly match Means book rates. Contractor will submit daily their Daily Report which will certify personnel on job, hours worked, equipment used, problems occurred, quantity of work accomplished, etc.

Contracting Officer Representative The designated Contracting Officer Representative (COR) will be:

Warren Dutter 906-474-6442 ext. 120 Email: wdutter@fs.fed.us 8181 Hwy 2 Rapid River, MI 49878

The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.

On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal of a contract claim.

Invoicing Invoicing is tied to successful inspection of work. The Contractor may only invoice after the COR has inspected the line item(s) work and the work is determined to have met the AQL. This applies to both interim and final payments. All invoices are processed and paid through the Invoice Processing Platform (IPP). Please register on www.ipp.gov.

Evaluation Factors for Award

The Forest Service’s source evaluation will be based on best-value principles. Accordingly, award will be made to the responsible Offeror whose proposal provides the greatest overall value to the Government, price and other factors considered. This best-value determination will be accomplished by comparing the value of the differences in the technical factors for competing offers, based on their strengths, weaknesses, and risks, with differences in their price to the Government. In making this comparison, the Government is more concerned with obtaining superior technical capabilities than with making an award at the lowest overall cost to the Government. However, the Government will not make an award at a significantly higher overall price to achieve slightly superior technical capabilities. As technical scores become closer, price will become more important. Technical Factors are significantly more important than price. Only Offerors that demonstrate acceptable submission to the Government of all items in Section L of this solicitation (or amendments thereof) will be considered for award.

Payment by Electronic Funds Transfer-- System for Award Management (Jul. 2013)

(a) Method of payment.

(1) All payments by the Government under this contract, shall be made by electronic funds transfer (EFT), except as provided in paragraph (a)(2) of this clause. As used in this clause, the term “EFT” refers to the funds transfer and may also include the payment information transfer.

(2) In the event the Government is unable to release one or more payments by EFT, the Contractor agrees to either--

(i) Accept payment by check or some other mutually agreeable method of payment; or

(ii) Request the Government to extend the payment due date until such time as the Government can make payment by EFT (but see paragraph (d) of this clause).

(b) Contractor's EFT information. The Government shall make payment to the Contractor using the EFT information contained in the System for Award Management (SAM) database. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the SAM database.

(c) Mechanisms for EFT payment. The Government may make payment by EFT through either the Automated Clearing House (ACH) network, subject to the rules of the National Automated Clearing House Association, or the Fedwire Transfer System. The rules governing Federal payments through the ACH are contained in 31 CFR part 210.

(d) Suspension of payment. If the Contractor's EFT information in the SAM database is incorrect, then the Government need not make payment to the Contractor under this contract until correct EFT information is entered into the SAM database; and any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.

(e) Liability for uncompleted or erroneous transfers.

(1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for--

(i) Making a correct payment;

(ii) Paying any prompt payment penalty due; and

(iii) Recovering any erroneously directed funds.

(2) If an uncompleted or erroneous transfer occurs because the Contractor's EFT information was incorrect, or was revised within 30 days of Government release of the EFT payment transaction instruction to the Federal Reserve System, and--

(i) If the funds are no longer under the control of the payment office, the Government is deemed to have made payment and the Contractor is responsible for recovery of any erroneously directed funds; or

(ii) If the funds remain under the control of the payment office, the Government shall not make payment, and the provisions of paragraph (d) of this clause shall apply.

(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.

(g) EFT and assignment of claims. If the Contractor assigns the proceeds of this contract as provided for in the assignment of claims terms of this contract, the Contractor shall require as a condition of any such assignment, that the assignee shall register separately in the SAM database and shall be paid by EFT in accordance with the terms of this clause. Notwithstanding any other requirement of this contract, payment to an ultimate recipient other than the Contractor, or a financial institution properly recognized under an assignment of claims pursuant to Subpart 32.8, is not permitted. In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.

(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information made by the Contractor's financial agent.

(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address contained in the SAM database.

Payment by Electronic Funds Transfer--Other Than System for Award Management (Jul 2013)

(a) Method of payment.

(1) All payments by the Government under this contract shall be made by electronic funds transfer (EFT), except as provided in paragraph (a)(2) of this clause. As used in this clause, the term “EFT” refers to the funds transfer and may also include the payment information transfer.

(2) In the event the Government is unable to release one or more payments by EFT, the Contractor agrees to either--

(i) Accept payment by check or some other mutually agreeable method of payment; or

(ii) Request the Government to extend payment due dates until such time as the Government makes payment by EFT (but see paragraph (d) of this clause).

(b) Mandatory submission of Contractor's EFT information.

(1) The Contractor is required to provide the Government with the information required to make payment by EFT (see paragraph (j) of this clause). The Contractor shall provide this information directly to the office designated in this contract to receive that information (hereafter: ``designated office'') by ____________________ [the Contracting Officer shall insert date, days after award, days before first request, the date specified for receipt of offers if the provision at 52.232-38 is utilized, or ``concurrent with first request'' as prescribed by the head of the agency; if not prescribed, insert ``no later than 15 days prior to submission of the first request for payment'']. If not otherwise specified in this contract, the payment office is the designated office for receipt of the Contractor's EFT information. If more than one designated office is named for the contract, the Contractor shall provide a separate notice to each office. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the designated office(s).

(2) If the Contractor provides EFT information applicable to multiple contracts, the Contractor shall specifically state the applicability of this EFT information in terms acceptable to the designated office. However, EFT information supplied to a designated office shall be applicable only to contracts that identify that designated office as the office to receive EFT information for that contract.

(1) The Government is not required to make any payment under this contract until after receipt, by the designated office, of the correct EFT payment information from the Contractor. Until receipt of the correct EFT information, any invoice or contract financing request shall be deemed not to be a proper invoice for the purpose of prompt payment under this contract. The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.

(2) If the EFT information changes after submission of correct EFT information, the Government shall begin using the changed EFT information no later than 30 days after its receipt by the designated office to the extent payment is made by EFT. However, the Contractor may request that no further payments be made until the updated EFT information is implemented by the payment office. If such suspension would result in a late payment under the prompt payment terms of this contract, the Contractor's request for suspension shall extend the due date for payment by the number of days of the suspension.

(e) Liability for uncompleted or erroneous transfers.

(1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for--

(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information provided by the Contractor's financial agent.
