(1) does not have a tax delinquency, meaning that it is not subject to any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, and

(2) has not been convicted (or had an officer or agent acting on its behalf convicted) of a felony criminal violation under any Federal law within 24 months preceding the award, unless a suspending and debarring official of the United States Department of Agriculture has considered suspension or debarment of the awardee, or such officer or agent, based on these convictions and/or tax delinquencies and determined that suspension or debarment is not necessary to protect the interests of the Government.

(b) If the awardee fails to comply with these provisions, the Forest Service may terminate this contract for default and may recover any funds the awardee has received in violation of sections 433 or 434.

FSAR 4G52.222-701 - Employment of Eligible Workers (DEC 1999) Section 274A of the Immigration and Nationality Act (8 USC 1324a) makes it unlawful for an employer to hire unauthorized aliens. The contractor is required to:

1. Have all employees complete and sign the I-9 Form to certify that they are eligible for employment;

2. Examine documents presented by the employee and ensure the documents appear to be genuine and related to the individual;

Compliance with Section 274A of the Immigration and Nationality Act (8 U.S.C. 1324a) is a material condition of the contract. If the contractor employs unauthorized workers during contract performance in violation of section 274A, the Government may terminate the contract, in addition to other remedies or penalties prescribed by law.

For further information on the requirements of the Act, contractors should contact the Employer and Labor Relations Officer of their local United States Citizen and Immigration Services office.

Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

FAR 52.232-18 Availability of Funds. (APR 1984) Funds are not presently available for this contract. The Government’s obligation under this contract is contingent upon the availability of appropriated funds from which payment for contract purposes can be made.

No legal liability on the part of the Government for any payment may arise until funds are made available to the Contracting Officer for this contract and until the Contractor receives notice of such availability, to be confirmed in writing by the Contracting Officer.

PROPOSALS (SEP 1999)

(a) - General Instructions. Proposals submitted in response to this solicitation shall be furnished in the following format with the numbers of copies as specified below. This RFP does not commit the Government to pay costs incurred in preparation and submission of initial and subsequent proposals or for other costs incurred prior to award of a formal contract.

(1) The proposal must include a technical proposal and business proposal. Offers that do not include both a technical and business proposal will not be considered further. Each of the parts shall be separate and complete so that evaluation of one may be accomplished independently from evaluation of the other. The technical proposal must not contain reference to cost; however, resource information (such as data concerning labor hours and categories, materials, subcontracts, etc.) must be contained in the technical proposal so that the contractor's understanding of the statement of work may be evaluated.

(2) Offerors are cautioned to submit enough information to enable the evaluation committee to fully ascertain each offeror's capability to perform all of the requirements contemplated by this solicitation. All commitments made in the proposal may become a part of the resultant contract. The data submitted with each proposal should be complete and concise, but not overly elaborate. Excessive reliance on promotional brochures is discouraged.

(3) Offerors may, at their discretion, submit alternate proposals or proposals which deviate from the requirement; provided, that an offeror also submit a proposal for performance of the work as specified in the statement of work. Any "alternate" proposal may be considered if overall performance would be improved or not compromised, and if it is in the best interest of the Government. Alternate proposals, or deviations from any requirement of this RFP, must be clearly identified.

(4) Offerors may, at the discretion of the Government, be asked to provide more information and clarification regarding their proposals. The offeror shall be held responsible for the validity of all information supplied in his/her proposal. Should subsequent investigation disclose that the facts and conditions were not as stated, the proposal may be rejected.

Technical portions of the submittal are limited to 10 single pages or 5 double-sided pages. Material submitted in excess of this limit will not be reviewed.

At a minimum, the technical proposal must clearly address the following factors and sub factors. Each factor/sub factor should be covered in sufficient detail to clearly address required information. The assessment of Past Performance will be subjective, and based mainly on the offeror’s reputation with customers and others. The evaluation may also take into account performance of key personnel regarding predecessor companies or subcontractors, if applicable. NOTE: In the case where an offeror lacks Past Performance experience, the offeror will not be evaluated either favorably or unfavorably in this area but will receive a neutral rating in the area of past performance (FAR 15.305).

Using page 9, the offeror shall request a Past Performance Questionnaire from five (5) recent customers of similar projects completed within the past three (3) years. The projects should have a magnitude and scope similar to those required by the solicitation.

The information regarding these projects and customers shall be entered including the dollar value of the project, type of project, date completed and customer contact information.

Note any problems encountered and efforts made to correct and prevent future occurrences. Narrative should address the following:

Project management includes the full spectrum of activities such as estimating, proposal preparation, subcontract purchasing and management, work scoping and planning, superintendent duties, and safety/quality control. Offerors should provide a detailed description of the organization, techniques, procedures and program for achieving the objectives of the specifications/statement of work. List your firm’s contractual commitments running concurrently with the work required by this solicitation. Describe how you will handle concurrent projects, prioritize work between concurrent projects, and appropriately equip and staff simultaneous projects.

Describe how you will monitor for quality while work is in progress. When will inspection occur relative to the work time frame? When will you provide the inspection results to the COR which allows for the Government to conduct timely quality assurance checks?

NOTE: In accordance with FAR 15.305, in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will not be evaluated either favorably or unfavorably in this area, but instead will receive a neutral rating in the area of past performance.

Experience and Availability of Firm, Key Personnel and Equipment.

o Utilization of Local Work Force

Project Management.

Price. A price evaluation will be performed to determine the reasonableness of the proposed price.

Reasonableness will be determined considering other competitive prices received and comparison to the independent Government estimate (IGE). The Government will look at whether a proposed price is too high and may also consider whether a proposed price is too low, since this might indicate a lack of technical understanding on the offeror's part or a performance risk associated with the proposal that the agency may not be willing to accept.
