NOTE: Aggregate to be spread on multiple roads on the district which are listed in Sec. 350 and shown on the attached maps. Aggregate may not be delivered to all roads listed. Price quoted reflects the cost per ton for aggregate delivered on any road listed for that District in the project list (Sec 350). Quantities listed are expected minimums to be awarded. Actual quantities awarded may be greater or lesser than quantites listed.

FAR 52.211-16 Variation in Quantity

(a) A variation in the quantity of any item called for by this contract will not be accepted unless the variation has been caused by conditions of loading, shipping, or packing, or allowances in manufacturing processes, and then only to the extent, if any, specified in paragraph (b) below.

(b) The permissible variation shall be limited to: 2 percent increase or decrease. This increase or decrease shall apply to the total quantity of each item without regard to destination.

FAR 52.217-6 Option for Increased Quantity

The Government may increase the quantity of supplies called for in the Schedule at the unit price specified. The Contracting Officer may exercise the option by written notice to the Contractor within 60 days. Delivery of the added items shall continue at the same rate as the like items called for under the contract, unless the parties otherwise agree.

BASIS OF AWARD: Multiple awards may be made from this solicitation. Offerers may submit prices on one or more of the items listed in the Schedule of Items. The Government will evaluate quotes in response to this solicitation and make award(s) to the offeror(s) whose offer conforms to this request and that provides the best value to the Government considering price, past performance, delivery and quality.

The Government reserves the right to make an award on the basis of initial offers received.

CONTRACT TIME: Contract time shall be 180 calendar days per item. If a single contractor receives award of more than one item, contract time shall run concurrently.

PRE-QUOTE TOURS: No formal tour will be conducted. For questions, offerors can contact Scott Young at 573-341-7429 (All Districts); COR Jerry Wilson (Potosi, Fredricktown, Salem, Houston and Rolla Districts) at 573-729-6656; or COR Michael Pomeroy (Winona, Doniphan and Poplar Bluff Districts) at 573-785-1475; or Richard Penna (Ava, Cassville and Willow Springs Districts) at 417-683-4428.

SPECIFICATIONS

DIVISION 100 - GENERAL SPECIFICATIONS

110 - Scope of Contract: Furnish, haul, and truck spread crushed aggregate base on the roads listed in Section 350. The quantities of services specified in the Schedule are estimates only.

120 - Description and Location: The roads to receive aggregate surfacing are located on various districts of the Mark Twain National Forest as delineated on the attached maps and listed in Section 350 of these Specifications. The Contracting Officer’s Representative (COR) will coordinate aggregate placement.

130 – Staking of Aggregate Placement: The exact location for placing the aggregate on the road will be flagged by the Government prior to beginning of work. Only designated portions of the road lengths will receive aggregate.

The COR has complete authority to order deliveries and have deliveries stopped when weather or road conditions are unsuitable for the hauling of aggregate. If operations are stopped for any reason, the Contractor will be notified by the COR twenty-four (24) hours prior to resuming operations.

140 - Equipment: All equipment used in the work shall be of the proper type, of a sufficient size, and in good operating condition. The Contracting Officer may order removal and replacement of any unsatisfactory equipment at the Contractor's expense. All equipment must meet all Federal and State licensing and safety requirements.

150 - Safety: The Contractor shall exercise due caution and care when working to prevent undue conflict with public users of roads. Roads shall remain passable to traffic during the Contractor's operations.

160 - Damage to Property: The Contractor shall be responsible for any damage caused by his/her personnel or equipment to any existing structures such as culverts, signs, cattleguards, and riprap protecting culvert inlets and/or outlets. Damaged items shall be repaired or replaced by the Contractor at no additional cost to the Government.

170 - Pollution and Erosion Control: During all operations under this contract, the Contractor shall take reasonable measures to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes, from the Contractor's operations, including camps, parking areas, and equipment maintenance areas, shall be stored, collected, and disposed of in a sanitary and nuisance-free manner. Refuse shall be disposed in State-approved landfills or as approved by the Contracting Officer.

DIVISION 200 – TECHNICAL SPECIFICATIONS

210 –Aggregate: Furnish crushed hard, durable particles or fragments of stone or gravel meeting the size and quality requirements for crushed aggregate material normally used locally in the construction and maintenance of highways by Federal or State agencies. Furnish crushed aggregate free of organic matter and lumps or balls of clay. The COR has the right to reject aggregate based on the visual inspection of the gradation and quality.

220 – Truck Spreading: The Contractor shall spread the aggregate in a uniform layer so the road remains open to traffic. If the Contractor piles any aggregate in the road it shall be immediately spread by hand or mechanical means to clear the roadway for traffic. Hauling shall be suspended until the problem is corrected.

DIVISION 300 - INSPECTION AND ACCEPTANCE

310 - Inspection of Work: Inspection of the completed road will be performed by the COR or his Inspector within three (3) working days following notification of completion of the maintenance work. Timely inspection and acceptance of completed roads will require close coordination between the Contractor and the COR.

A procedure and schedule for final inspection will be agreed upon by the Contractor and the Government at the pre-work conference.

320 - Acceptance: Acceptance will be determined by inspection of work performed and will be based on adherence to the specifications within the contract.

330 - Method of Measurement for Payment: Crushed aggregate shall be the tons of material placed and accepted. Weight receipts will be required on crushed aggregate.

340 - Basis of Payment: The accepted quantities will be paid for at the contract unit price for each item shown in the Schedule of Items.

350 – Project (Road) List: Aggregate may not be delivered to all roads listed. Price quoted reflects the cost per ton for aggregate delivered on any road listed for that District.
