General Information

The Ansonia facility is a complex of buildings consisting of research laboratories, office, and quarter’s facilities.

The buildings date from 1955 to 1958, when they were originally a Department of Defense facility. The U. S.

Forest Service acquired this facility in 1981. Over the years, the facilities have undergone many changes.

All buildings are one story structures on concrete slabs. The main complex of buildings has EIFS stucco on the exterior (2001). Gable roof was constructed in 1995 after the start of the quarantine facility in 1992.

In 1992 we renovated a former Army barracks to a primary quarantine facility (Building #2). Most of the work was done with in-house maintenance staff, however the duct work and HVAC system were constructed and installed by contract. This is the system we need to replace with a new state-of-the-art system. Negative pressure is also a function of the system.

The HVAC system is a 4 zone system. Unit 3 was replaced in 2014 and Units 1 and 4 were replaced in 2015. This contract is the final phase of the HVAC system work for this primary quarantine facility.

Unit 1: AAON Model No. RN008 Unit 3: AAON Model No. 3358 Unit 4: AAON Model No. RQ004

The control panel in the lobby area lets the Quarantine Officer know when the system is running or malfunctioning. This panel will have to tie into the new HVAC units as well as other controls in the individual rooms.

The current cooling system capacity is 225,000 MBH and heating system capacity is 225,000 BTU LP gas.

Electrical rating is 3 phase 208/230 VA.C. Currently the HVAC unit is AAON, Inc. equipment. A unit consists of mailto:mtevans@fs.fed.us dual compressors (rpm 3450), a condenser (rpm 1075), an evaporator (rpm 1725), and a combination air (rpm 3450).

HVAC #2 is the large lab with walk-in environmental chambers and small reach-in environmental chambers (known as insect genetics lab). This area is hard to cool because of all the heat-producing equipment. The new HVAC unit must have a higher cooling capacity.

The primary quarantine has unique recommendations for any work being performed on the facility.

Scope

Replace the current HVAC system Unit #2 using the existing ductwork and tie in to existing controls. Part of the work is to tie into existing LP gas piping and electrical wiring circuits. The unit is ground based.

A concrete pad is already in place to house HVAC Unit # 2. Existing ductwork will need to be extended out to the concrete pad.

Due to the unique facility and function the unit will have to be replaced and new LP unit installed and start up the same day. This is also the primary reason existing ductwork will need to be utilized as no additional cuts can be made into the existing interior or exterior walls.

Testing of the system shall be conducted to ensure the new unit is working properly with the current controls before certifying completion of this project.

A standard operating procedure (SOP) will be given to the contractor so that a complete understanding of the facility is understood before the start of the project.

Technical Requirements

Proper procedures shall be followed to ensure integrity of the quarantine facility is primary. As specified in the scope of work. The interior quarantine area is negative pressure and more negative pressure the further into the quarantine facility.

Manufacturer’s specifications on the new unit shall be included in the bid package to ensure function and performance in compliance with primary quarantine standards. Manufacturer’s data sheets indicating model number, pressure/temperature ratings, capacity, methods and materials of construction, installation instructions, and recommended maintenance. General catalog sheets showing a series of the same device is not acceptable unless the specific model is clearly marked.

Manufacturer’s instructions shall be followed. A complete testing of the new unit system shall be performed before certifying completion of this project.

The Contractor shall provide operational manual (instructions) to the Ansonia Quarantine Officer and Facility Operations Specialist.

Training

The awardee shall provide the Government adequate training to understand the new HVAC unit and how it works with the existing controls. The training will be conducted during normal business hours after system start-up and acceptance by the Government.

Site Inspection

It is the responsibility of the contractor to inspect the current HVAC system, and other site aspects that may affect the proper pursuit of this project. Because of the unique nature of this facility it is very important to ensure all new HVAC equipment will adequately function to the standards of the facility.

Occupancy and Site Access

It is necessary for the contractor to work with the Quarantine Facility Officer and Facility Operations Specialist (FOS) on a timetable and work schedule agreeable to the contractor and employees working at the Quarantine Facility. An agreement with the research managers and FOS is the primary requirement to ensure correct protocol and timeliness is followed.

Sanitation Facilities

The Government will allow use of sanitation facilities during the period of the contract during normal office hours. It is the contractor’s responsibility to use these facilities responsibly, and ensure that public areas and restrooms are kept clean.

Refuse/Waste Disposal

Old HVAC unit, material and debris shall be removed at the completion of the job, and the work areas left in neat and clean condition.

Warranty

Quotes shall include all standard warranty information. In addition, contractors shall include pricing for an option for an extended warranty, which can be exercised at the Government’s discretion.

(3) Constitute or imply acceptance; or

(4) Affect the continuing rights of the Government after acceptance of the completed work under paragraph (i) of this section.

(e) The Contractor shall promptly furnish, at no increase in contract price, all facilities, labor, and material reasonably needed for performing such safe and convenient inspections and tests as may be required by the Contracting Officer. Special, full size, and performance tests shall be performed as described in the contract.

(f) The Contractor shall, without charge, replace or correct work found by the Government not to conform to contract requirements, unless in the public interest the Government consents to accept the work with an appropriate adjustment in contract price. However, if the work is found to meet contract requirements, the Contracting Officer shall make an equitable adjustment for the additional services involved in the examination and reconstruction, including, if completion of the work was thereby delayed, an extension of time.

(i) Unless otherwise specified in the contract, the Government shall accept, as promptly as practicable after completion and inspection, all work required by the contract or that portion of the work the Contracting Officer determines can be accepted separately. Acceptance shall be final and conclusive except for latent defects, fraud, gross mistakes amounting to fraud, or the Government’s rights under any warranty or guarantee.

The Government shall perform inspections in a manner that will not unduly delay the work.

(b) The Contractor is responsible for damage to property caused by defective workmanship. The Contractor shall promptly segregate and remove from the premises any unsatisfactory facilities, materials, and equipment used in contract performance, and promptly replace them with satisfactory items. If the Contractor fails to proceed at once in a workmanlike manner with performance of the work or with the correction of defective workmanship, the Government may --

(1) By contract or otherwise, replace the facilities, materials, and equipment or correct the workmanship and charge the cost to the Contractor; and

The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

52.225-9 -- Buy American–Construction Materials (May 2014)

(a) Definitions. As used in this clause--

“Commercially available off-the-shelf (COTS) item”—

(1) Means any item of supply (including construction material) that is—

(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

“Component” means an article, material, or supply incorporated directly into a construction material.

“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

“Cost of components” means--

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

“Domestic construction material” means—

(1) An unmanufactured construction material mined or produced in the United States;

(2) A construction material manufactured in the United States, if—

(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or

(ii) The construction material is a COTS item.

“Foreign construction material” means a construction material other than a domestic construction material.

“United States” means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements the 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows: none

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1)

(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including--

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

Foreign and Domestic Construction Materials Price Comparison

Construction material description Unit of measure Quantity Price (dollars) * Item 1 Foreign construction material Domestic construction material Item 2 Foreign construction material Domestic construction material

[List name, address, telephone number, and contact for suppliers surveyed. Attach copy of response; if oral, attach summary.]

[Include other applicable supporting information.]

[*Include all delivery costs to the construction site and any applicable duty (whether or not a duty-free entry certificate is issued).]

(End of Clause)

When the work is substantially complete, the Contracting Officer may retain from previously withheld funds and future progress payments that amount the Contracting Officer considers adequate for protection of the Government and shall release to the Contractor all the remaining withheld funds. Also, on completion and acceptance of each separate building, public work, or other division of the contract, for which the price is stated separately in the contract, payment shall be made for the completed work without retention of a percentage.

(f) Title, liability, and reservation of rights. All material and work covered by progress payments made shall, at the time of payment, become the sole property of the Government, but this shall not be construed as --

(1) Relieving the Contractor from the sole responsibility for all material and work upon which payments have been made or the restoration of any damaged work; or

(2) Waiving the right of the Government to require the fulfillment of all of the terms of the contract.

(g) Reimbursement for bond premiums. In making these progress payments, the Government shall, upon request, reimburse the Contractor for the amount of premiums paid for performance and payment bonds (including coinsurance and reinsurance agreements, when applicable) after the Contractor has furnished evidence of full payment to the surety. The retainage provisions in paragraph (e) of this clause shall not apply to that portion of progress payments attributable to bond premiums.

(h) Final payment. The Government shall pay the amount due the Contractor under this contract after --

(1) Completion and acceptance of all work;

(2) Presentation of a properly executed voucher; and

(3) Presentation of release of all claims against the Government arising by virtue of this contract, other than claims, in stated amounts, that the Contractor has specifically excepted from the operation of the release. A release may also be required of the assignee if the Contractor’s claim to amounts payable under this contract has been assigned under the Assignment of Claims Act of 1940 (31 U.S.C. 3727 and 41 U.S.C. 6305).

(i) Limitation because of undefinitized work. Notwithstanding any provision of this contract, progress payments shall not exceed 80 percent on work accomplished on undefinitized contract actions. A “contract action” is any action resulting in a contract, as defined in FAR Subpart 2.1, including contract modifications for additional supplies or services, but not including contract modifications that are within the scope and under the terms of the contract, such as contract modifications issued pursuant to the Changes clause, or funding and other administrative changes.

(j) Interest computation on unearned amounts. In accordance with 31 U.S.C. 3903(c)(1), the amount payable under subparagraph (d)(2) of this clause shall be --

(1) Computed at the rate of average bond equivalent rates of 91-day Treasury bills auctioned at the most recent auction of such bills prior to the date the Contractor receives the unearned amount; and

(2) Deducted from the next available payment to the Contractor.
