B.2 PAYMENT FOR BOND PREMIUMS

Payment for bond premiums in accordance with Clause 52.232-5, Payments under Fixed-Price Construction Contracts, shall not be in addition to the contract price. Include bond payments under 151.01 Mobilization. Payment will be made on actual work performed as described in FP-03 109.01 unless otherwise noted.

SECTION C – GENERAL SPECIFICATIONS

C.1 SCOPE OF WORK

This work consists of asphalt patching on approximately 11.7 miles of Forest Service Roads (FSRs) 37 & 38.

Contractor shall be responsible for providing all labor, tools, material, and equipment necessary to perform all work in strict accordance with the specification and drawings. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment for the items shown.

C.2 LOCATION OF WORK

The project area is located on the Okanogan-Wenatchee National Forest, Okanogan County, Tonasket and Methow Valley Ranger Districts.

To access the project area, from Okanogan, WA, take County Road 9229 for approximately 19 miles to Conconully, WA. From Conconully, travel North on N. Fork Salmon Creek Road to the paved segment of FSR 38, for approximately 6.5 miles. This segment of road is included in the base bid items.

FSR 37 runs generally East-West, and consists of paved segments on both ends and an aggregate surfaced segment in the middle. The East end paved segment is 5.2 miles long, and is included in the base bid items.

From Conconully proceed West on Broadway Street for 0.3 miles. Broadway Street turns into County Road 2017. Continue on for 2.8 miles, turn right onto FSR 37.

The West end paved segment can be reached most easily from the town of Winthrop, WA. Drive North out of Winthrop on County Road 9137, continue for 6.6 miles. Turn right at the junction of FSR 37, this paved segment is 7.5 miles in length. This segment of repairs is listed as an option item.

C.3 PRICE RANGE

The government estimate is between $10,000 and $25,000.

C.4 DESCRIPTION OF WORK

The base bid project consists of asphalt patching on the East segment of FSR 37, 5.2 miles in length, and FSR 38, 6.5 miles in length. The option items include asphalt patching on the West segment of FSR 37, 7.2 miles in length.

Work shall include saw cutting the marked locations, applying tack coat, placing and compacting the pacthing material, and providing necessary traffic control.

Prior to commencement of work, the Government will mark locations of necessary repairs. The quantity of materials necessary will not exceed what is listed in this task order. Any materials shall be obtained from a commercial source. Old asphalt removed during the construction shall be removed from NFS land and disposed of in accordance with local, State, or Federal regulation.

Mobilization is considered the initial moving of equipment and incidentals to the project area on the Ranger District prior to the beginning of on-site work activities and includes subsequent demobilization off National Forest lands.

For assigned activities, the Contractor shall present a schedule of completion including anticipated hours per day, days per week and dates.

Upon receipt of bids, the Government may elect to award option items in lieu of corresponding base items. For example, if item 41701(37) is awarded, item 43004(37) will not be. Only one option item for the FSR 37W segment may be awarded (either hot mix or cold mix).

C.5 PROJECT CONTROL

It is anticipated that this contract will be awarded by June 15, 2016. Work is to be completed by July 31, 2016. The contract time of the project is thirty (30) calendar days. No work will be allowed on weekends or holidays.

Contractor shall submit a proposed work plan, prior to beginning construction, for approval by the Contracting Officer, 30 calendar days have been allowed for the contract.

Contractor is responsible for protecting workers from injury. Refer to FAR 52.236-13, Accident Prevention, for full text.

The Contractor shall confine all operations (including storage of materials) on Government premises to areas authorized or approved by the Contracting Officer. The Government is not responsible for loss of or damage to materials or supplies stored on-site during performance of this contract.

Unless otherwise agreed, to prevent the introduction of seeds of noxious weeds onto National Forest land, Contractor shall ensure all equipment moved onto National Forest land is free of soil, seeds, vegatative matter or other debris that could contain or hold seeds. Contractor shall employ whatever cleaning methods necessary to insure compliance with this provision, and shall notify the Forest Service prior to moving each piece of equipment onto National Forest land. Upon request of Forest Service, arrangements will be made for Forest Service to inspect each piece of equipment prior to being moved onto National Forest land.

All roads shall remain open to public traffic during this project, with traffic delays of up to 60 minutes allowed for contractor’s operations. Contractor shall submit a traffic control plan including a sign plan prior to the start of construction.

C.6 TERMINOLOGY

The term “Engineer,” when used in the contract documents, shall refer to the Contracting Officer’s Representative (COR)

The term “Owner,” when used in the contract documents, shall refer to the Federal Government (U.S. Forest Service)

C.7 EXISTING CONDITIONS

Contractor shall verify all existing dimensions and conditions before proceeding with the work. All dimensions must be verified and/or determined in the field. Protect all improvements including existing culverts and roadway from damage during construction.

C.8 TRAFFIC CONTROL & MAINTENANCE

FSR 37 and FSR 38 are currently open to traffic and shall remain open during the project, traffic delays shall be no longer than one hour. Contractor shall submit a traffic control plan including a sign plan prior to the start of construction.

C.9 ATTACHMENTS TO STATEMENT OF WORK/SPECIFICATIONS

U.S. Department of Transportation, “Standard Specifications for Construction of Roads and Bridges on Federal Highway Projects: FP-03 U.S. Customary Units,” hereafter refered to as FP-03, are included by reference. The requirements contained in Section 101 through 158 are hereby made a part of this solicitation and any resultant contract. Special Project Specifications (SPS) that amend FP-03 can be found in this contract.

WSDOT Standard Specifications for Road, Bridge and Municipal Construction are hereby made a part of this solicitation and any resultant contract.

The attachments to the Statement of Work/Specifications listed in Sections F, G and J are hereby made part of this solicitation and any resultant contract.

C.10 LANDSCAPE PRESERVATION

All heavy equipment shall be cleaned and thoroughly inspected prior to mobilization to the work site.

Once on site all equipment shall be inspected daily and all visible oil, grease, and hydraulic fluid will be removed. Needed repairs will be implemented immediately before resuming work.

All machinery shall be refueled outside of the riparian reserve area. If refueling does occur within the riparian reserve area, spill control measures shall be installed around the machinery prior to refueling operations.

SECTION I – CONTRACT CLAUSES

I.1 52.228-13 ALTERNATIVE PAYMENT PROTECTIONS

(a) The Contractor shall submit one of the following payment protections:

Payment Bond; OR Irrevocable Letter of Credit

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 15 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the

Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

Description

151.01 This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site; obtaining of permits, insurance, and bonds. This work also includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands, according to the requirements within.

Construction Requirements

Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment. Only equipment inspected by the Forest Service will be allowed to operate within the project area. All subsequent move-ins of equipment to the project area will be treated in the same manner as the initial move-in. This requirement does not apply to cars, pickup trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.

Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment, components or the need for specialized inspection tools is not required.

Notify the CO in writing at least 72 hours before moving any construction equipment onto the national forest. Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service. Inspection will be required after every cleaning.

Use methods of cleaning and locations for cleaning approved by the CO.

For work at a commercial washing facility, use an approved facility.

New infestations of noxious weeds of concern to Forest Service and identified by either Contractor or Forest Service, in the Project Area or on the haul route, will be promptly reported to the other party. Contractor and Forest Service will agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to Forest Service is available at each Forest Service office.

Measurement

151.02 Clean equipment prior to moving onto this project. The initial cleaning will not be included in the measurement for payment. Payment for cleaning will only be made if subsequent cleanings are ordered by the CO. Measurement shall be on an “each” basis, meaning one complete cleaning of all equipment required for this contract. Subsequent cleanings necessitated by the Contractor’s actions but not directed by the CO will not be included in the measurement for payment.

Measure mobilization according to Subsection 109.02.

Payment

151.03 The accepted quantity, measured as provided in Subsection 109.02, will be paid at the contract price per unit of measurement for the Section 151 pay item shown in the bid schedule.

Payment will be full compensation for the work prescribed in this Section. See Subsection 109.05.

Progress payments for mobilization lump sum will be paid as follows:

(a) If applicable, bond premiums will be reimbursed according to FAR Clause 52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.

(b) When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.

(c) When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.

(d) Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.

Include all costs associated with the initial cleaning of equipment in the unit bid price for Mobilization. Cleaning for subsequent move-ins will not be paid for unless after a suspension ordered by the CO.

Manage existing and new gates as shown in the Project Drawings or Table 156-1 to control public access during the life of the contract.

Furnish and install traffic control devices before the start of construction Perform no work that interferes or conflicts with traffic or existing access to the roadway surface until a traffic control plan has been approved. Post construction signs and traffic control devices in conformance with MUTCD. All required signs will be in place and approved prior to beginning work on project.

If the Contractor agrees in writing to allow public traffic to use a new road being constructed prior to completion, it will be considered an existing road for traffic control purposes.

156.04 Temporary Traffic Control. Install and maintain temporary traffic control devices adjacent to and within the project as required by the approved traffic control plan and the MUTCD. Install and maintain traffic control devices as follows:

(a) operations.

(b) All detours outside of clearing limits will be approved in writing by the Contracting

Officer as part of the traffic control plan.

(c) Install only those traffic control devices needed for each stage or phase.

(d) Relocate temporary traffic control devices as necessary.

(e) Remove devices that no longer apply to the existing conditions.

(f) Immediately replace any device that is lost, stolen, destroyed, or inoperative.

(g) Keep temporary traffic control devices clean.

(h) Remove all temporary traffic control devices upon contract completion or when approved.

(i) When required, use flaggers certified by the American Traffic Safety Services

Association, the National Safety Council, the International Municipal Signal Association, a state agency, or other acceptable organization. Perform the work described under MUTCD Part 6. Use type III, VII, VIII, or IX retroreflective sheeting on flagger paddles. Do not use flags. Flaggers must wear high visibility safety apparel as required by MUTCD 6E.02.

Submit a job-mix formula and supporting documentation, test results, and calculations for the material to be incorporated into the work. Include copies of laboratory test results and mix design data that demonstrate that the properties of the aggregate, additives, and mixture meet the current requirements and criteria of Federal or state agencies. Ensure that the job-mix formula was performed no more than one year prior to placing the hot asphalt concrete. After reviewing the Contractor’s proposed job-mix formula, the CO will determine the final values for the job-mix formula to be used and notify the Contractor in writing.

404.04 Weather Limitations. Delete the text of this Subsection and substitute the following:

Place asphalt concrete on a dry, unfrozen surface when the ambient air temperature is at least 45 degrees Fahrenheit and rising.

404.06 Placing.

Do not place asphalt until the CO has approved in writing the area where it will be placed.

Delete the last sentence and replace with the following:

Offset the longitudinal joint of one layer at least 6 inches from the joint in the layer immediately below. Make the longitudinal joint in the top layer along the centerline of two-lane roadways or at the lane lines of roadways with more than two lanes. Offset transverse joints in succeeding layers and in adjacent lanes at least 10 feet, where possible.

404.07 Compacting (a).

Delete and replace with the following:

(a) Roadway paving. Thoroughly and uniformly compact the surface a minimum of three passes with rollers that meet one of the following requirements:

(1) Steel-wheeled rollers, other than vibratory type, capable of exerting a force of not less than

1.5 ton/feet of width of the compression roll or rolls.

(2) Vibratory steel-wheel rollers with a minimum mass of 5 ton, equipped with amplitude and frequency controls, and designed to compact asphalt concrete.

(3) Pneumatic-tire rollers with smooth tread tires of equal size that provide a uniform compacting pressure for the full width of the roller and capable of exerting a ground pressure of at least 80 lbf/in2.

Perform initial compaction while the mixture is above 250 °F. Perform finish rolling with steel-wheel rollers and continue until no roller tracks remain.

404.09 Acceptance.

Add the following to the second paragraph:
