SECTION C - Description/Specifications/Statement of Work

C-1 - PROJECT DESCRIPTION AND LOCATION

(a) - Scope of Contract. This project involves renovating the Red Cliff Campground and associated picnic site on the Bozeman Ranger District, Gallatin National Forest. Work includes road realignments and surfacing, reconfiguration of camp spurs, campsite rehabilitation with new and salvaged furniture, installation of a new water system, well development, concrete pumphouse installation and plumbing, concrete vault toilet installation, and other miscellaneous demolition and construction work. Work includes furnishing all labor, materials, equipment, supervision, transportation, and incidentals necessary to perform work as shown and specified herein.

(b) - Project Location. Red Cliff Campground is located on the east side of Highway 191 approximately 6 miles south of Big Sky, Montana.

(c) – Prebid Tour. There will be a pre-bid tour meeting at the Red Cliff picnic area on July 28, 2011 at 10:00 AM. Potential bidders are encouraged to participate in the pre-bid tour or to visit the project site on their own. Red Cliff Campground is located approximately 48 miles south of Bozeman, MT on US 191. Parties with questions may contact Dale White, telephone (406) 587-6752.

C-2 - GENERAL SPECIFICATIONS

(a) - Existing Utilities. Within the campground and picnic site, known underground utilities include water, electrical, and telephone lines. It is unknown what other underground utilities may be located within the Highway 191 corridor.

It is solely the responsibility of the Contractor to locate and avoid damage to existing utilities.

The Contractor shall contact Montana One Call at (800) 424-5555 and pay any fees required for locating and marking utility-owned and government-owned underground electrical lines, telephone lines, plastic water lines with tracer conductors, and fiber optic lines, and any other underground utilities in the construction area a minimum of 2 business days prior to any excavation, trenching, or other ground disturbing activity at the site.

NOTE: ELM Locating & Utility Services of Missoula, MT is the current contractor for Montana One Call. They can be contacted for additional fees for private locates at (406) 728-9343.

(b) - Pollution and Erosion Control. During all operations under this contract, the Contractor shall exercise reasonable measures to prevent or minimize soil erosion and pollution of water and other resources. All refuse, including garbage, rubbish, and solid or liquid wastes, from the Contractor's operations, including camps, parking areas, and equipment maintenance areas shall be stored, collected, and disposed of in a sanitary and nuisance-free manner. Refuse shall be disposed of in State-approved dumps as approved by the CO.

During all of the work, the Contractor shall make every reasonable effort to direct surface runoff water to stabilized waterways and to keep the drainage systems functioning effectively to minimize soil erosion and water pollution.

(c) - Existing Facilities. In addition to the requirements of the Use of Premises Clause, AGAR 452.236-70, all existing facilities structures damaged by the Contractor shall be replaced or repaired by the Contractor at no additional cost to the Government. This includes any facilities inside or outside the project limits, including along any access routes.

Do not cut, trim, or damage vegetation except with specific Contracting Officers (CO) approval.

Limit all construction activities and ground disturbance, including storage and stockpiling, to areas designated by the CO.

(d) - Noxious Weed Control. In order to prevent the potential spread of noxious weeds the

Contractor shall clean equipment in accordance with Section 151.

(e) – Submittals. Submit two copies to the CO for approval on all construction materials and items required herein. Literature shall be marked or otherwise designated to indicate the exact model, size, etc., the Contractor proposes to use. Information shall be adequate to determine compliance with the specifications without additional research by the CO. One copy of approved submittals will be returned to Contractor. Submit all items with such promptness as to cause no delay in the work. Approvals must be obtained before starting work which involves the item. The Contractor shall allow 5 calendar days for processing of submittals by the Government.

(f) – Timing of Work and Public use of facilities. Construction shall proceed and be completed in accordance with time limitations listed in SECTION F--DELIVERIES OR PERFORMANCE.

The Contractor will be allowed to close the North Loop to public access during the work period listed for that area. Close the North Loop using approved barricades located where directed by the C.O. The Contractor is encouraged to schedule work in the North Loop so as to minimize closure of that area. Notify the C.O. at least two weeks in advance of enacting the North Loop closure.

The entire campground will be closed to public use during the period September 6, 2011 through May 24, 2012. During this period the Contractor will have access to the entire campground to proceed with the work.

(g) – Public Safety and Traffic Control. Safety and traffic control on the project site shall be the sole responsibility of the Contractor. The Contractor shall maintain warning signs and barricades to safeguard the public. Adequate signs, barricades, cones, and other methods or devices shall be utilized in accordance with the MUTCD.

(h) – Permits. The Contractor shall perform all necessary coordination with the utility company, secure all necessary permits, and pay all associated fees for electrical work per Section 16440.

(i) - Construction Staking. The Contractor will be responsible for staking of the new segments of the North Loop Road. All other staking will be performed by the Government. The Contractor will make every reasonable attempt to protect the staking during their activities and shall replace any damaged stakes at their expense.

(j)– Storage and Stockpiling of Equipment and Materials. Storage and stockpiling shall take place only within areas approved by the CO.

(k)– Maintenance of Clean Worksite Conditions. Maintain the project work area in a clean and orderly condition throughout the progress of work under this contract.

(l)– Work Done by Others. It is not anticipated that work will be done by other contractors on the site during the same time period as this contract.

Should work by other contractors occur, the Contractor shall make reasonable accommodation for this other work. The Government will notify the Contractor in advance when this work is planned to occur.

(m)– Use of Government Facilities while Conducting Work.

1. Sanitary Facilities: Campground toilets may be used by the Contractor.

2. Electrical Power: The contractor shall furnish his own electrical power.

3. Potable Water: The existing potable water system to be demolished on under this contract is the only potable water system at the site. With C.O. approval, the Contractor may use the system as a water source while construction is underway provided the Contractor’s actions do not interfere with public use of the system. The C.O. may revoke permission to use the existing water system at any time should he feel that the Contractor’s actions interfere with public water use.

4. Camping: No camping on Forest Service lands except by written approval of the Bozeman

District Ranger.

(n)– Asbestos Containing Materials. It is assumed that the vent pipes in the existing wooden toilets to be demolished are asbestos containing material (asbestos cement). The pipe is in good condition. The contractor shall remove, transport, and dispose of the pipe without breaking, abrading, cutting, or in any way damaging it and shall dispose of it in a legal manner at a State licensed landfill that accepts non-regulated asbestos containing materials. Upon removal and before storage or transport, the pipe shall be double-wrapped in 6 mil polyethylene material.

106 - Acceptance of Work

106.01_nat__us03_29_2005

106.01 Conformity with Contract Requirements.

Delete Subsection 106.01 and substitute the following:

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request.

Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

(1) Sampling method;

(2) Number of samples;

(3) Sample transport;

(4) Test procedures;

(5) Testing laboratories;

(6) Reporting;

(7) Estimated time and costs; and

(8) Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory.

Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute. The CO will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

(1) Have the work accepted at a reduced price; or

(2) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.
