Government under the terms of a Timber Sale Contract and acting independently or through agents, employees, or subcontractors.
Protected Streamcourse--A drainage shown on the plans or timber sale area map that requires designated mitigation measures.
Road Order--An order affecting and controlling traffic on roads under Forest Service jurisdiction. Road Orders are issued by a designated Forest Officer under the authorities of 36
CFR, part 260.
Schedule of Items--A schedule in the contract that contains a listing and description of construction items, quantities, units of measure, unit price, and amount.
Utilization Standards--The minimum size and percent soundness of trees described in the specifications to determine merchantable timber.

104.06 Use of Roads by Contractor
The Contractor is authorized to use roads under the jurisdiction of the Forest Service for all activities necessary to complete this contract, subject to the limitations and authorizations designated in the Road Order(s) or described in the contract, when such use will not damage the roads or national forest resources, and when traffic can be accommodated safely.
The contractor shall confine his operation of equipment and trucks to existing road surfaces and the cleared areas that are shown on the site plans for each culvert installation.

Add the following before Subsection 105.02(a):
Sources have been designated for the Boulder Creek AOPS 2015 as follows:
Crushed Aggregate Government furnished aggregate, obtain from the existing stockpile that is in the borrow pit near Yantis Ditch, which is near the junction with road
50083 and 50074 in Section 10. T.20 N, R1W.
Riprap and stream simulation– On-Site. Contractor will utilize material from the excavations. Material may also be obtained from the Yantis Ditch borrow pit. Riprap may also be obtained from a commercial source.
Material Disposal Site – Government furnished. A waste site for excess and unsuitable material :
Excess material may also be hauled to the Yantis Ditch borrow pit, and set it on edge of the cut slope of the borrow pit.

(a) Government-provided sources.
Add the following:
Comply with the requirements of 30 CFR 56, subparts B and H. Use all suitable material from the project site unless otherwise designated. Place all unsuitable and excess material at the designated waste-disposal sites. When required, re-establish vegetation in disturbed areas according to section 625.
(b) Contractor-located sources.
Prior to any pit development or use of materials, provide a State certification or have the pit site approved by the CO as being free of noxious weeds as listed on the All States Noxious Weeds
List.

Section 106. - Acceptance of Work

106.01 Conformity with Contract Requirements.
Delete Subsection 106.01 and substitute the following:
Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.
References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.
Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.
Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more stringent.
Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.
When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.
The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the Contractor upon request. Government tests may or may not be performed at the work site. If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the
Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.
Acceptable work conforming to the contract will be paid for at the contract unit bid price. Four methods of determining conformity and accepting work are described in Subsections 106.02 to
106.05 inclusive. The primary method of acceptance is specified in each Section of work.
However, work may be rejected at any time it is found by any of the methods not to comply with the contract.
Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no cost to the Government.
(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the CO. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request.
Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:
(1) Sampling method;
(2) Number of samples;
(3) Sample transport;
(4) Test procedures;
(5) Testing laboratories;
(6) Reporting;
(7) Estimated time and costs; and
(8) Validation process.
If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program.
Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed Government test results or that produced the test results used as a basis for the dispute.
The CO will review the proposed resolution protocol and may modify it before final approval and execution.
The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated, the Government will be responsible for all costs associated with developing and performing the resolution protocol.
If the validity of the Government test results cannot be determined, the Contractor and
Government will equally share all costs associated with developing and carrying out the resolution protocol.
(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:
(1) Have the work accepted at a reduced price; or
(2) Be given permission to perform corrective measures to bring the work into conformity.
The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The CO will determine disposition of the nonconforming work.

Add the following:
The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the CO and in a manner that complies with Federal, state, and local laws and regulations.
Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.
Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information.
Describe how the contractor will comply with the following three methods to minimize fuel/oil leakage from construction equipment into the stream channel. Include the following:
i. Clean all equipment used for in-stream work so that it is free of external oil, grease, dirt and mud, and repair leaks, prior to arriving at the project site. All equipment will be inspected by the Contracting Officer’s Representative before unloading at site. Correct any leaks or accumulations of grease before entering streams or areas that drain directly to streams or wetlands.
ii. Fuel and service equipment used for in-stream or riparian work (including chainsaws and other hand power tools) in an established staging area (site-specifically designated by CO). When not in use, store vehicles in the designated staging area.
The staging area should be in an area that will not deliver fuel, oil, etc., to streams.
iii. Oil-absorbing floating booms, and other equipment such as pads and absorbent
“peanuts” appropriate for the size of the stream, shall be available on site during all

phases of construction. For very small streams with few pools or slack water, booms may not be effective. More pads and straw bales to anchor booms may be necessary.
Place booms in a location that facilitates an immediate response to potential petroleum leakage.
Immediately notify the CO of all hazardous material spills. Provide a written narrative report no later than 24 hours after the initial report, and include the following:
Description of the item spilled (including identity, quantity, manifest number, and other identifying information).
Whether amount spilled is EPA- or State-reportable, and if so whether it was reported, and to whom. Follow Federal and Idaho State regulations regarding spills. Report any spills resulting in a detectable sheen on water to the EPA National Response Center (1-
800-424-8802). Report any spills over 25 gallons to the IDEQ (1-800-632-800), and initiate cleanup within 24 hours of the spill.
Exact time and location of spill including a description of the area involved.
Containment procedures.
Summary of any communications the Contractor had with news media, Federal, State and local regulatory agencies and officials, or Forest Service officials.
Description of clean-up procedures employed or to be employed at the site, including final disposition and disposal location of spill residue.
When available, provide copies of all spill-related clean-up and closure documentation and correspondence from regulatory agencies.

151.01
Add the following:
This work includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands.
Wash the sides, tops, and undercarriages of all construction equipment with a high-pressure washing system. Perform all work at a location designated on the plans or other locations approved in writing. Provide the CO with an opportunity to monitor the washing and inspection.
Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment.
Only equipment cleaned and inspected will be allowed to operate within the project area. All subsequent move-ins of equipment to the project area will be treated in the same manner as the initial move-in. This requirement does not apply to cars, pickup trucks, dump trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.
Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment or components, or the need for specialized inspection tools, is not required.
Notify the CO in writing at least 7 days before moving any construction equipment onto the
National Forest, and at least 24 hours before changing locations within the project area. Include an agreed-upon location where the equipment will be available for inspection. Inspection is required after every cleaning.
Use methods of cleaning and locations for cleaning approved by the C.O.
For work on National Forest System lands, use a washing system that traps all wash water and either stores it for removal from National Forest System lands or recycles the water for continued use. If the equipment recycles the water, provide adequate filters for seed removal. Dispose of the filter material and removed seeds offsite in a legal and approved manner. Do not mix soaps, detergents, or other chemicals with the wash water.
For work at a commercial washing facility, use an approved facility.
New infestations of noxious weeds of concern to Forest Service and identified by either
Contractor or Forest Service, on the Project Area or on the haul route, shall be promptly reported to the other party. Contractor and Forest Service will agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found. A current list of noxious weeds of concern to Forest Service is available at each Forest Service office. A list of known infestations along roads to be reconstructed will be available to the Contractor before work begins.

156.03 General. Unless otherwise provided for in Table 156-1, keep existing roads open to all traffic during road improvement work, and maintain them in a condition that will adequately accommodate traffic.
This contract will allow closure of each road at the point of the stream crossing.
Perform no work that interferes or conflicts with traffic or existing access to the roadway surface until a traffic-control plan has been approved. Post construction signs and traffic-control devices in conformance with MUTCD. Have all required signs in place and approved prior to beginning work on project.
If the Contractor agrees in writing to allow public traffic to use a new road being constructed prior to completion, it will be considered an existing road for traffic-control purposes.
156.04 Temporary Traffic Control. Install and maintain temporary traffic-control devices adjacent to and within the project as required by the approved traffic-control plan and the
MUTCD. Install and maintain traffic-control devices as follows:
(a) Furnish and install traffic control devices before the start of construction operations.
(b) All detours outside of clearing limits will be approved in writing by the Contracting
Officer as part of the traffic control plan.
(c) Install only those traffic control devices needed for each stage or phase.
(d) Relocate temporary traffic control devices as necessary.
(e) Remove devices that no longer apply to the existing conditions.

(f) Immediately replace any device that is lost, stolen, destroyed, or inoperative.
(g) Keep temporary traffic-control devices clean.
(h) Remove all temporary traffic-control devices upon contract completion, or when approved.
(i) When required, use flaggers certified by the American Traffic Safety Services
Association, the National Safety Council, the International Municipal Signal
Association, a State agency, or other acceptable organization. Perform the work described under MUTCD Part 6. Use type III, VII, VIII, or IX retro-reflective sheeting on flagger paddles. Do not use flags. Flaggers must wear high-visibility safety apparel as required by MUTCD 6E.02.

156.05 Temporary Closures
Prior to closing roads during construction, give written notice to the Contracting Officer at least
14 days in advance, so the Forest Service can post a notice in the local newspapers. The written notice shall include a complete work schedule showing stages of construction and planned completion and re-opening of the road to the public.
On each site where construction is occurring, install a Type III barricade on each side of the work area, with a white and black sign that says ROAD CLOSED. Barricades are needed at both sides of the work area to warn motorized traffic as well as people on foot or horse who could approach from the back side.

4. For work in stream channels with running water, a detailed dewatering plan. Convey water around the construction area during the operating season and higher flows in the event of a storm. Notify the COR at least 10 days in advance of any stream work or dewatering.
The COR will notify the District Fish biologist who will be available during dewatering to move fish from the dewatering area using a combination of dip-netting and electrofishing.
Schedule the start of dewatering to occur in the mid-morning, so the fish crew will have the afternoon to remove the fish. After the COR approves the stream simulation placement, re-water the area slowly to help the movement of fish.

In perennial channels, which includes all four sites on this contract, pre-wash the reconstructed stream channel into a reach equipped with sediment-capture devices such as Sedimat, or settling pond prior to reintroduction of flow to the stream. Remove the turbid water by pumping to an infiltration area, or letting the sediment settle in the settling pond.
Re-water the construction site slowly to prevent loss of surface water downstream as the construction-site streambed absorbs water and to minimize a sudden increase in turbidity.
Use in-channel sediment-abatement barriers such as Sedimat to capture sediment that is liberated during re-watering of dewatered channels. Clean out and remove barriers, and dispose of captured sediment so it is not reintroduced into stream channels. Maintain such barriers throughout the related construction and remove only when construction is complete and erosion control is assured.
5. The location of each temporary stockpile site for the excavated material, and location of erosion control measures to prevent sediment from washing off of stockpile.
6. Keep a supply of erosion-control materials (e.g. silt fence, straw bales, and/or straw wattles) on hand to respond to sediment emergencies. Use only sterile straw or certified
“weed-free” straw to prevent introduction of noxious weeds.

Add to the third paragraph:
Upon completion of construction at the site, remove all temporary dewatering materials and equipment from Government property. This includes items such as pumps, pipes and hoses, and sandbags.
Adhere to the following practices:
a) In order to protect aquatic organisms, insure that drafting hoses are fitted with screens with a 3/32 inch mesh and the appropriate surface area for the pump to achieve a mazimum water velocity of 0.4 ft/ sec at the screen surface, consistent with NOAA guidelines.
b) Centrifugal pumps used for drafting water from live streams or removing water from structure excavation (if needed) shall sit in a secondary spill container with sufficient capacity to contain the quantity of fuel in the pump fuel tank.
c) Construct the Dewatering and Sediment Control according to the Contractor’s approved plan.
d) Maintain the roads and stockpiles of material in a manner that prevents direct entry of sediment into the stream, by either preventing the erosion of sediments or collecting the sediments before it reaches the stream.
e) Construct permanent and temporary control features to intercept sediments. A settling basin will be constructed, or a portable one used, that is able to handle the volume of water anticipated, and that provides filtering capability. Dewatering of the excavation

site, (of ground water from the excavation) will be done by pumping water to the settling basin, and the basin shall be cleaned out when full of sediments.
f) Any sanitation facilities established by the Contractor shall be located as designated by the CO.
g) Cease all project operations, except efforts to minimize storm or high-flow erosion, under precipitation and high-flow conditions that result in uncontrollable erosion in the construction area.
157.04 Controls and Limitations on Work.
Add the following to the second paragraph:
Place temporary erosion-control measures at the end of each day’s operation if greater than 30 percent chance of rainfall is predicted. Earthwork operations may be temporarily suspended by the CO if significant rainfall is forecast.
157.08 Water Crossings.
When there is water flowing through a channel crossing, dewater that site by rerouting the flow around the site before and during excavation and embankment operations that have the potential for sediment delivery to the live stream. If pumps are used, install screens on pump intakes with maximum openings of 3/32 inch to protect aquatic organisms.

Section 203. - Removal of Structures and Obstructions

203.01 Description.
Add the following:
Dispose of the existing culverts by method (a) remove from project.
The existing corrugated metal pipe culvert and related appurtenances shall be removed and disposed of away from Forest land according to all applicable local, state and federal regulations and 203.05 (a). Temporary soil erosion control measures shall be in place prior to commencing.

203.05 Disposing of Material.
Add the following:
(e) Windrowing Construction Slash. Place construction slash outside the roadway in neat, compacted windrows approximately parallel to and along the toe line of embankment slopes. Do not permit the top of the windrows to extend above subgrade. Use construction equipment to matt down all material in a windrow to form a compact and uniform pile. Construct breaks in windrows of at least 15 feet at least every 200 feet and at every draw and ridge and for wildlife trails. Do not place windrows against trees. Obtain approval for pioneer roads. A pioneer road may be constructed to provide an area for placement of windrows, provided the excavated material is kept within the clearing limits and does not adversely affect the road construction.
(f) Scattering. Scatter construction slash outside the clearing limits without damaging trees.
Limb all logs. Place logs and stumps away from trees, positioned so they will not roll, and are not on top of one another. Limb and scatter other construction slash to reduce slash concentrations.
(g) Chipping or Grinding. Use an approved chipping machine to grind slash and stumps greater than 3 inches in diameter and longer than 3 feet. Deposit chips or ground woody material on embankment slopes or outside the roadway to a loose depth less than 6 inches. Minor amounts of chips or ground woody material may be permitted within the roadway if they are thoroughly mixed with soil and do not form a layer.
(h) Debris Mat. Use tree limbs, tops, cull logs, split stumps, wood chunks, and other debris to form a mat upon which construction equipment is operated. Place stumps upside down and blend stumps into the mat.
(i) Decking Firewood Material. Remove brush from decks. Limb and deck logs that do not meet Utilization Standards according to Subsection 201.04, as directed by the CO. Cut logs to lengths less than 30 feet. Ensure that logs stacks are stable and free of brush and soil.

(j) Removal to designated locations. Remove construction slash to designated locations.

Haul the tops and limbs and stumps to the borrow site or other area approved by the CO. Place and construct piles so that if the piles are burned, the burning will not damage remaining trees.

(k) Piling. Pile construction slash in designated areas. Place and construct piles so that if the piles are burned, the burning will not damage remaining trees. Keep piles free of dirt from stumps. Cut unmerchantable logs into lengths of less than 20 feet.
(l) Placing Slash on Embankment Slopes. Place construction slash on completed embankment slopes to reduce soil erosion. When placing slash on embankment slopes, start at the toe of the fill and place as flat as practicable on the completed slope. Do not place slash closer than 2 feet below subgrade. Priority for use of available slash is for: (1) through fills; (2) insides of curves;
and (3) ditch-relief outlets.
Section 209. – Structure Excavation and Backfill

209.01

This Section includes all work to excavate road embankments, sort the materials, stockpile the materials as approved by the CO, excavate for the footings and pipe, backfill the footings and the arch and the pipe, and construct new embankments to the lines and grades of the finished subgrade shown on the drawings.
209.04 General
Add the following:
Submit in writing a plan of work. Describe the procedures, methods, materials, and equipment proposed to conduct excavating operations, including details of shoring, cribbing, and cofferdam construction, and/or plans for construction of earthen or rock-fill dikes, dams, or embankments in lieu of a cofferdam. Submit the plan of work to the Contracting Officer for approval at least 14 days before operations begin.
Use suitable material in the construction of the roadway embankment and for structural backfill.
Field drain and dry excessively wet material that is otherwise suitable for embankment before placement. Place and shape unsuitable or excess material in the Yantis ditch borrow pit, see
FSSS 105.

Compact each layer, using compaction equipment designed for this purpose, until visual displacement ceases.
Complete the backfilling of the embankment outside the 12 inch zone around the pipe with suitable roadway excavation or unclassified borrow, and compact according to
Subsection 209.11, Compacting.
Place the material in layers that, when compacted, do not exceed 6 inches in thickness.
209.12 Acceptance.

Have the borrow source for replacement material approved by the CO.
2. If additional rock is needed, the Contractor may obtain the rock from the existing borrow pit at Yantis Ditch.
Construction Requirements

The pockets of topsoil shall be placed in the riprap at locations above the normal highwater level. Use the topsoil salvaged from the excavation for the arch.

308.05 Compacting Crushed Aggregate.
Delete 308.05 in its entirety and replace with the following:
Compact each layer full width. Roll from the sides to the center, parallel to the centerline of the road.
Roadway aggregate. Compact the aggregate using one of the following methods:
(1) Method 1. Moisten or dry the aggregate to a uniform moisture content suitable for compaction. Operate a vibratory steel-wheeled roller having a minimum weight of 5 ton, equipped with amplitude and frequency controls, over the full width of each layer until visual displacement ceases, making not fewer than three complete passes.
(2) Method 2. Compact each layer of aggregate to a density of at least 95 per-cent of the maximum density, as determined by ASSTO T99, method C or D.
Blade the surface of each layer during the compaction operations to remove irregularities and produce a smooth and even surface.
308.06 Acceptance.

Ensure that the average of all the strength tests representing the concrete in each structural element meets the following requirements:
Not more than 10 percent of the strength tests shall have values less than the specified strength, and the average of any three consecutive strength tests shall be equal to or greater than the specified strength.
If concrete strength tests fail to meet the requirements of this specification, the CO may order the
Contractor to have a testing laboratory that is acceptable to the Forest Service take and test core samples of questionable concrete, in accordance with AASHTO T-24. The CO may order all low-strength concrete removed and replaced if core strengths are below specified strengths. All costs connected with concrete coring and removal and replacement of concrete that fails to meet these requirements shall be borne by the Contractor.
