CLARIFICATION REGARDING SUBMITTAL OF PRICE AND COST AND METHOD OF
PAYMENT
Pricing is to be submitted separately for each project on Page 1 of the Construction Cost Estimate Breakdown0031. Page 2 is to include the pricing and total cost (including overhead and profit) of both projects together. Upon award, a line item for each project will be calculate using the total price of the project multiplied by the overhead and profit percentages. Discrepancies will be corrected before award.
Progress payments will be made and can be for price only, or can include overhead and profit. If the payment is to include overhead and profit, a separate line item for each will need to be on the invoice.
Remove item 3 and replace with the following:
3. Representations and Certifications FAR 52.204-8 and AGAR 452.209-70. If you have completed the Representations and Certifications via SAM.GOV, please only submit a response to Paragraph (b), and complete AGAR 452.209-70. We will not need a response to the rest of 52.204-8, unless there are deviations from your from your on-line response in SAM.GOV.

Remove pages 39 and 40 of the solicitation package, in their entirety, and replace with the following:
PART IV - REPRESENTATIONS AND INSTRUCTIONS
SECTION M - EVALUATION FACTORS FOR AWARD
M- 1 Evaluation Criteria
(a) In the evaluation of proposals, all evaluation factors other than cost or price (listed in this provision), when combined are considered to be significantly more important than cost or price. The relative importance to be placed on the factors in relation to each other is contained in paragraph (e) of this provision. However, the degree of importance or cost or price may increase with the degree of non-cost or non-price equality between the proposals. If a proposal is determined by the Contracting Officer to be “technically unacceptable” as a result of evaluating all factors other than cost or price, the proposal may be rejected from further consideration. The Contracting Officer reserves the right to make award to other than the technically-acceptable offeror with the lowest cost/price proposal if it is determined that the technical benefits of another offeror’s proposal justify its higher cost/price, lower-scored offeror if it is determined that the cost/price premium involved in awarding to a higher-rated, higher-cost/price offeror is not justified. Since technical proposals are being solicited to obtain information to be used in the evaluation, the

Government reserves the right to use information outside of the proposal to evaluate the capability of offerors and the value of offers.
(b) Pursuant to FAR 15.305, a cost or price evaluation may be performed to determine the reasonableness of costs or prices proposed and the offeror’s understanding of, and ability to perform the prospective contract.
(c) The following factors and significant subfactors (if listed), will be considered in evaluating proposals and making the source selection:
(1) Past Performance and Company Experience – Offerors shall demonstrate satisfactory past performance in performing work similar to the type, magnitude and complexity of the work required under this solicitation/contract.
(d) Price Proposal. This criterion will include consideration of cost information provided to support item prices entered on the Construction Cost Estimate Breakdown0031.
(e) The relative importance of the technical factors listed in paragraph (c) are in descending order of importance. The evaluation factors other than price, when combined, are significantly more important than price.
M- 2 Award Statement
Award will be made to the responsible offeror submitting a proposal, which conforms to the solicitation and is most advantageous to the Government considering the factors and any significant subfactors listed in this provision.
The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Proposals should be submitted initially on the most favorable terms, from a price and technical standpoint, which the offeror can submit to the Government. However, the Government may, after evaluation of proposals, conduct further oral or written discussions as appropriate, with all offerors whose proposals are within a competitive range.
